Личность преступника, совершившего преступление против половой неприкосновенности и половой свободы, требует разработки рекомендаций с учетом особенностей личности с целью обеспечения эффективности осуществления мер по профилактике преступлений. Результаты этого исследования обосновывают выводы о необходимости сбора и систематизации знаний об осужденных, совершивших преступления против половой неприкосновенности и половой свободы. Изучены наиболее актуальные вопросы, дается их оценка, предлагаются рекомендации, которые могут потребоваться в правоохранительной практике. Раскрыта социально-демографическая характеристика лиц, совершивших преступление против половой неприкосновенности и половой свободы. В статье рассматривается характеристика личности осужденного, совершившего преступление против половой неприкосновенности личности на основе анализа статистических данных Судебного департамента при Верховном суде РФ за 2018-2020 гг. В работе использовались аналитический и статистический методы исследования. Исследованы особенности рода занятий и социальное положение осужденных за преступления против половой неприкосновенности и половой свободы личности. Анализ научной литературы позволил выявить ряд вопросов, которые вызывают дискуссию. Во многих работах отмечается низкий образовательный и культурный уровень лиц, совершающих сексуальные преступления. The identity of a criminal who has committed a crime against sexual integrity and sexual freedom requires the development of recommendations, taking into account the characteristics of the individual, in order to ensure the effectiveness of measures to prevent crime. The results of this study substantiate the conclusions about the need to collect and systematize knowledge about convicts who have committed crimes against sexual integrity and sexual freedom. The most relevant issues are studied, their assessment is given, and recommendations that may be required in law enforcement practice are offered. The article reveals the socio-demographic characteristics of persons who have committed a crime against sexual integrity and sexual freedom. The article examines the characteristics of the personality of a convicted person who committed a crime against the sexual integrity of the person based on the analysis of statistical data of the Judicial Department under the Supreme Court of the Russian Federation for 2018-2020.. Analytical and statistical methods of research were used in the work. The features of the occupation and social status of those convicted of crimes against sexual integrity and sexual freedom of the individual are investigated. The analysis of the scientific literature revealed a number of issues that cause discussion. Many studies note the low educational and cultural level of the perpetrators of sexual crimes.

Women continue to be victims of violence and the violation of their human rights keep being in the increase as they experienced constant hatred on their status. This article analyzes liability for crimes against women under criminal legislations of the Republic of Uzbekistan and Cameroon by assessing the Criminal Codes rules in both countries in terms of identifying its distinctive features of legal regulation conditional to gender and family differences of subjects is provided. Expert study of criminal legislations related to crimes against women plays a facilitating role in identifying not only real scope of criminal law rules, but also determining if there is a gap in law, or legal regulation is insufficiently socially conditioned. Moreover, analysis of genesis of criminal standards on responsibility for crimes against women made it possible to trace changes in law in relation to such objects of criminal law protection as, for example, life, health, sexual freedom and sexual immunity, honor and dignity of woman, interests of family and its members.

In 2018, the US Park Service finally deemed the informal artist colony Druid Heights, in California’s Marin County, eligible for inclusion on the National Register of Historic Places. There is no act of preservation that can do justice to everything Druid Heights was and is, and it remains to be seen which aspects will get fixed as official history and which others will fade away or be left to haunt the place in unexpected ways. This chapter analyzes three films that staged competing visions of sexual freedom at Druid Heights: James Broughton’s experimental short The Bed (1967), the Mariposa Film Group’s gay and lesbian interview documentary Word Is Out: Stories of Some of Our Lives (1977), and Ed De Priest’s heterosexual pornographic feature Skintight (1981). Together, these films present a valuable case study for understanding the role of cinema in political contestations over the meaning and use of space.

The article is devoted to the study of topical issues of legislative regulation of criminal offenses against sexual freedom and sexual integrity of the person, provided for Articles 152–1561 of the Criminal Code of Ukraine. In the process of research the author identified a number of shortcomings and gaps in their legislative regulation, namely: 1) contradictions in terms of «the child» (the Criminal Code does not specify which age group is included in this concept), «the minor» (a person aged 14 to 18 under Article 32 of the Civil Code of Ukraine) and «the person under 16 years of age». These contradictions arise between the content of the dispositions and the titles of Articles 156 «Corruption of minors» and 1561 «Solicitation of children for sexual purposes» of the Criminal Code of Ukraine; 2) it lack of legislative concretization of the concept of «indecent assault» in Art. 156 «Corruption of minors»; 3) dualism and competition of legal norms in the application of Part 4 of Art. 152 «Rape» and Art. 155 «Committing acts of a sexual nature with a person under the age of sixteen», associated with the presence in both articles of the possibility of «voluntary consent» of «the person under 14 years of age» to commit sexual intercourse; 4) clarification of the possibility of practical application of Art. 1561 «Sexual harassment of a child». The author proposed the following changes and additions to the provisions of the Criminal Code of Ukraine to eliminate these shortcomings: 1) to formulate the name of Art. 156 as «Corruption of a person under the age of sixteen» and Art. 1561 as «Solicitation for sexual purposes of a person under the age of sixteen»; 2) to define the concept of «lecherous acts» in Art. 156 «Corruption of minors», for example, as «acts related to the physical and/or intellectual depravity of the victim in the sexual sphere», including those related to «exposure or touching the genitals, incitement to natural and unnatural sexual intercourse, conducting cynical conversations on sexual topics»; 3) to exclude from the text of the disposition part 4 of Art. 152 the concept of «voluntary consent» and supplement Art. 155 by the part 3, that provides the next: «The acts provided in part one of this article, committed against a person under the age of fourteen, – will be punishable by imprisonment for a term of ten to fifteen years». It is the presence of legible, consistent and justified criminal law norms in criminal offenses against sexual freedom and integrity of the person will ensure reliable legal protection of moral values of the child and society in Ukraine and proper implementation of criminal law policy of the Ukrainian state.

Child and adolescent sexual abuse (CSA) is an international public health problem. Despite the importance of CSA, there is no consensus definition, and the lack of consensus is related to difficulties in conducting prevalence studies as well as research in other areas. To establish a consensual definition, legal aspects such as the age of sexual consent and the difference in age or power between victim and aggressor as well as aspects related to sexual freedom and sexual indemnity must be considered. Therefore, the main goal of this research was to analyze the age of sexual consent in the legal systems of Spanish-speaking countries and to examine whether the Romeo and Juliet clause is established. To achieve the proposed aims, we employed the legal interpretation method, and we analyzed the current Criminal Codes of the 21 Spanish-speaking countries. From the results, it is found that the age of sexual consent varies between countries, establishing valid sexual consent between 13 and 18 years. In addition, only six countries have the Romeo and Juliet clause that protects sexual freedom in adolescents. Finally, we discussed the lack of consensus on the age of sexual consent and the limitations presented by the Romeo and Juliet clause.
