Male homosexual preference (MHP) is present in many human societies, making up a small but significant cohort. Because homosexual mate preferences are associated with lower fecundity, many evolutionary explanations have been advanced to account for the persistence of this trait. After reviewing a number of these hypotheses and finding room for additional explanations, we propose a new hypothesis that depends on the observed greater empathy and reduced hostility of men who express MHP. This gives them a central role in the performance of groups or teams (all male and mixed) where cooperation and intra-team coherence are at a premium. In this view, teams that contain men with MHP will outcompete teams without such men, other variables being similar. The links between personality traits and team performance do not require homosexual activity within the group. The hypothesis is supported by observations of the personality traits associated with MHP, such as increased agreeableness, which is linked to the literature on team cohesion and performance in sports and other kinds of teams and groups. This novel hypothesis could be examined through direct study of team performance. The proposed hypothesis may also have relevance to better performance among the diverse teams whose efficient performance is so important in modern society.

AbstractThe Abrahamic faiths and received colonial law have been identified as the driving force behind the criminalisation of homosexual activity in most of the Commonwealth States of Africa. This article, therefore, seeks to question the role of criminal law in proscribing sexual activities amongst consenting adults of the same gender in Commonwealth African states. A recurring question in the paper is the propriety of criminalising a consensual conduct amongst consenting adults in private when no harm or injury is done to other citizens or the state in line with JS Mill’s principle of harm. The article finds that the misconception that the main aim of criminal law is to legislate the moral values of the majority, forms support for the view that homosexuality can be learned and unlearned and if this is the case, a paternalistic approach by the state would help mould citizens’ behaviour. A comparative and case study approach was adopted for the discussion in the article. Four Commonwealth African states, namely, Ghana, Kenya, Nigeria and Uganda were selected as case studies. The article recommends a much more robust approach for the support of sexual minorities in the Commonwealth.

After reviewing a number of these hypotheses and finding them lacking, we propose a new hypothesis that depends on the observed greater empathy and reduced hostility of men who express MHP. This gives them a central role in the performance of groups or teams of males and/or females where cooperation and intra-team coherence are at a premium. Teams that contain men with MHP will, we propose, outcompete teams without such men. The links we propose between personality traits and team performance do not require homosexual activity within the group. Our hypothesis is supported by observations of the personality traits associated with MHP, such as agreeableness, which we link to the literature on sports and other kinds of teams and groups. For nearly a century Catholic Church teaching on Sexuality evolved greatly. Changes in science and the teaching of other Christian churches begged for a fresh start. John Paul II, elected pope in 1978, attempted to update that teaching by providing new background arguments, without changing any of the strictures in the foreground. John Paul II insisted on necessity of total love, allowing for no exceptions. He claimed that divorce was impossible because the spouses retained no control over their marriage promises. Homosexual activity was judged to be morally deficient. Likewise the recent arrival of reproductive technology was largely condemned for breaking the sexual unity of the spouses. But fertile sexual activity was newly appreciated as the important activity of spouses cooperating with the creative activity of God. In the twenty-first century the Church’s official teachings continues to be reformed, but their relevance is widely questioned as social norms continue to drastically change.

<p>Gay is a minority group the existence of which is still unacceptable to the society. It puts the gay into a group vulnerable to violence risk. The objective of research is to study the risk and the reflexivity of violence in gay community in Surakarta. This qualitative with case study approach took place in Surakarta. The sampling technique used was purposive sampling one. The informant of research consisted of chairperson and administrators of Surakarta Gaya Mahardhika Foundation, gays becoming the victim of violence, community fellow members, and administrators of Mitra Alam Surakarta NGO. Data was collected through observation, in-depth interview, and documentation. To validate data, source triangulation was used. Technique of analyzing data used was Miles and Huberman’s interactive model of analysis with Ulrich Beck’s Risk Society theory.      </p>The result of research showed that violence risk encountered by gay in Surakarta included physical violence such as being thrown with sharp weapon, being struck and slapped; physical/emotional violence such as cynical and disliking view, expulsion, threat and negative stigma intended to gay organization; sexual violence such as sexual abuse conducted by police officer by touching the victim’s body organ; economic violence such as money and product expropriation by sexual partner; and verbal violence such as being insulted and mocked by some people on the street. The effect of violence consisted of physical effect such as bruise, gash, and pain still felt until today, and physical effect such as fear, trauma, discomfort and fidget, disappointment, resentfulness, anger, pique, and regret. The reflectivity of gay in dealing with violence included interacting or looking for acquaintance or partner more alertly and selectively; adapting, comporting; building intimacy an self-image by conducting positive activities within society; conducting homosexual activity more carefully such as fulfilling their sexual need in their known place rather than doing it in opened space that has been known by mass organization; and providing advocacy to the gay becoming the victim of violence.

Sąd Najwyższy Stanów Zjednoczonych odgrywa fundamentalną rolę w amerykańskim porządku ustrojowym, a formułowane przezeń rozstrzygnięcia wywierają ogromny wpływ na prawne, polityczne, społeczne i ekonomiczne oblicze USA. Jednym z najważniejszych punktów spornych w dyskursie aksjologiczno-prawnym w Stanach Zjednoczonych w ciągu ostatnich dekad była kwestia konstytucyjnego prawa/roszczenia osób o orientacji homoseksualnej do równego traktowania. Artykuł analizuje w tym kontekście trzy orzeczenia SN, to jest Bowers vs. Hardwick uprawomocnienie penalizacji konsensualnej aktywności seksualnej, Lawrence vs. Texas refutacja poprzedniego rozstrzygnięcia oraz Obergefell vs. Hodges konstytucjonalizacja prawa osób tej samej płci do zawierania związków małżeńskich. Autor formułuje zarazem — na podstawie powyższej analizy — generalne hipotezy dotyczące związku pomiędzy rzeczywistością społeczną czy też polityczną a interpretacjami ustaw zasadniczych werbalizowanymi przez sądy konstytucyjne. Between criminalization of homosexual activity and constitutionalization of same-sex marriage — some remarks on the role of the Supreme Court in the United StatesThe Supreme Court of the United States plays a fundamental role in the American political system; its decisions exert a crucial influence on the legal, political, social and economic reality in the United States. One of the most important and contentious points in the legal and axiological discourse in the United States for the past three decades has been the question of the constitutional right/claim of homosexuals to equal treatment and equal protection of laws. The article analyzes in this context three landmark cases, i.e. Bowers v. Hardwick the legitimization of the penalization of consensual sexual activity with respect to homosexuals, Lawrence v. Texas the abolition of the previous decision and Obergefell v. Hodges the constitutionalization of the right to same-sex marraiges. The article formulates — on the basis of this analysis — certain general hypotheses regarding the relations between the social and political reality and interpretations of constitutions issues by constitutional courts.
