The presented study concerns the concept of a “trade union organization covering the entire work establishment”. In this study an attempt was made to answer the question whether the term means that the trade union organization must actually conduct activity in each unit of the work establishment in the objective sense, or it is sufficient when, in accordance with the statute or other union resolution defining the subjective scope of its activities, the trade union activity covers the workplace as a whole. The research is based on a dogmatic and legal analysis of Polish law as well as on case-law and legal writing. As a result of the considerations, the Author comes to the conclusion that the status of a work establishment trade union organization is determined by specifying the subjective scope of its activity in its statute or other union resolution. Fears that such a solution to the problem enables the dictatorship of a minority in the workplace can be neutralized by making union rights conditional on the representativeness of a trade union organization also where there is only one such organization in the workplace

In the 1970s, Argentina lived moments of great effervescence and labour conflict. The Santa Rosa metallurgical factory, located in the suburbs of Buenos Aires, became a centre of workers' struggle and resistance not only against the management and the state but also against certain union practices. From this factory, a union recovery movement was promoted that, in constant dialogue with the neighborhood and other factories in the area, disputed not only the leadership of the regional union but also the meaning of the union organization and of being a worker and a Peronist. In this article, I propose to analyze the process of construction of this workers’ collective that emerged from the experience at the workplace. To understand the factory not just as a space but also as a process, as a social construction of a relational type allow us to see the determinations that this space exercises over the construction of the workers’ collective, reflecting forms of belonging and solidarity among the members of this collective that are more than just the sum of individualities. I will analyze this process of construction of the workers’ collective studying two specific conflicts that these workers carried out during the decade. We will observe how the factory space determined the constitution of an original working culture in constant dialogue with the trade union organization and with the other actors of the environment, focusing on the different responses that this collective of workers gave in different socio-political contexts.

The non-strategic role and position of women workers in trade union organization, even in the women-dominated sector, is hardly changed even though the number of women members of trade unions is increasing. Various programs have been carried out to increase the strategic role of women in trade union organizations but so far have not shown significant results. Based on interviews with officers of gender equality programs for trade unions, union leaders and women and men members and literature studies this paper offers an idea of the need for a non-exclusive approach and actively and proportionally involving men in awareness-raising and gender equality programs for trade unions. This idea is based on the fact that in trade unions gender-related program is always left to or only involves women. The strategy in the gender equality awareness and improvement program that only involves women causes the program’s effectiveness to be low because half of the causes of the problem is not involved.

On the loss and recovery of the rights of a trade union organization The provisions of the Trade Union Act of 23 May 1991 concerning the loss and regaining the rights of a company trade union organization generate numerous interpretative doubts. The author analyses issues concerning the trade union organization’s failure to comply with the obligation to provide the employer with information on the number of its members, the trade union organization’s failure to timely submit an application to the labor court with jurisdiction over the employer’s registered office to establish the number of its members as at the last day of the six-month period, and the organization’s restoration of its rights as a result of the submission of an application to establish the number of its members. The author also draws up de lege ferenda postulates concerning the clarification of specific regulations, which should result in avoiding paralysis of the legitimate exercise of trade union rights and privileges by a trade union organization.
