Unaccompanied Foreign Minors and Asylum Seekers Under Italian Law: The Issue of Minors Attaining Majority

Abstract Background The Italian law provides for international protection and universal health-care coverage for asylum seekers (AS). Indeed, they are entitled to be regularly registered at the National Healthcare Service. Before submitting the application for refugee status, medical assistance to migrants is up to local administration. Our aim was to describe and compare policies and protocols regulating AS healthcare from their arrival to their application for refugee status, at national and regional level. Moreover, we investigated the daily healthcare practice addressing potential gaps between policies and practice. Methods The research team is a subgroup of the Inequality working group of the Italian hygiene society and it is composed of public health residents. The research involved also local health workers and other professionals belonging to regional groups of Italian migrant medicine society (SIMM). We collected national, regional and local policies and protocols and we compared them using a specific framework. Furthermore, we achieved a mapping of daily practice implementation at local health organization (LHO) level using a checklist. Results The most relevant findings were that regional policies themselves vary notably from each other and, as regard practices, LHO implement differently the same regional legislation. Furthermore, we found some critical issues: the delayed inclusion in primary care assistance and lack of continuity of care and of a computerized system of recording information. Conclusions The lack of uniformity concerning policies and practices of AS healthcare might also result in unawareness and uncertainty about how to access to healthcare services by migrants. An enhanced cooperation between groups dealing with migrants’ issues may lead to avoid variability at the implementation. Finally, a computerized system for data collection might facilitate the continuity of care and the assessment of the real health needs of the AS population. Key messages It is a priority challenge for health systems to strengthen the interventions aimed at overcoming the linguistic, economic, cultural and administrative barriers to the health services access. It is crucial to improve the recording information system to detect the real health needs of AS, their change and the inequalities in access and to improve collaboration between groups and university.

In Italy, the number of unaccompanied foreign minors (UFMs) is constantly and continuously increasing, and includes unaccompanied and separated minors, as well as asylum seekers, coming from different countries and for different reasons. To better understand this phenomenon, the regulations that protect UFMs, the Italian immigration system, and the fundamental rights of children will be discussed. Possible risk factors such as deviance, exploitation and trafficking, and possible intervention strategies to protect unaccompanied foreign minors will also be discussed.

Resumen: La Ley italiana núm. 47 de 2017, sobre disposiciones en materia de medidas de protección de menores extranjeros no acompañados, constituye el primer texto normativo que contempla de manera unificada la tutela de menas en la UE. Por un lado, esta ley establece un procedimiento multidisciplinar de identificación del menor y de determinación de la minoría de edad (art. 5). Por otro, destaca la figura del «tutor voluntario», institución protectora de los MENAs que llegan al territorio italiano (art. 11). Sin embar­go, la falta de coordinación entre los estados miembros amenaza la eficacia práctica de estas previsiones normativas, cuya fuerza vinculante se queda ceñida al territorio italiano. Se plantea, entonces, la necesidad de armonizar las diferentes prácticas estatales a través de una intervención legislativa europea.Palabras clave: MENAs, identificación, tutor voluntario, Italia, Unión Europea.Abstract: The Italian Law n. 47 of 2017 on dispositions upon protection measures of foreign unaccompanied minors, represents the first normative text, which contemplates, in a uniform way, the protection of unaccompanied minors in the EU. On one side, it establishes a multidisciplinary procee­ding for the identification of the minor and for the determination of his/her minor age (art. 5). On the other, it stand out the legal figure of a «volunteer guardian», institution that protect unaccompanied minors who arrive at the Italian territory (art. 11). However, the lack of coordination among Member States threats the practice efficacy of those legal provisions, which coercive force is confined through the Italian territory. This essay aims to reflect about the impact of the recent Italian Law 132/2018 and its effects on the reception policies for asylum seekers in the area of the Metropolitan City of Bologna. Starting to the fact that the system of developed in Bologna is considered a model of excellence, this contribution aims to examine its ability to deal the erosion of rights for asylum seekers provided by recent legislation. Will the integrated territorial system of reception and services react to the restrictions in access and protection imposed by Law 132/2018? The contribution is intended to give back the evolutions of the territorial system, trying to bring out the ambiguities and the founding causes of the criticalities that have become structural. Is it appropriate to speak of a model? If so, with what risks arising from the bureaucratic action that characterises the system at the apical level? A last paragraph will also be dedicated to the effects of the COVID-19 pandemic on the territorial reception system, having affected the dynamics exposed in the essay.

Case studies in the Netherlands and the UK of asylum applicants excluded or under consideration of exclusion pursuant to Article 1Fa of the Refugee Convention reveal that some applicants falsely implicated themselves in serious crimes or behaviours in order to enhance their refugee claim. This may have serious consequences for the excluded persons themselves, as well as for national governments dealing with them. For this reason we suggest immigration authorities could consider forewarning asylum applicants i.e. before their interview, about the existence, purpose and possible consequences of exclusion on the basis of Article 1F.

Avrupa ülkelerinin alışık olduğu düzenli işçi göçü ve kontrollü sığınmacı alımı Suriye iç savaşının üst düzeye ulaştığı 2013/2014 yılından itibaren önemli bir değişim göstermektedir. Avrupa Birliği, kuruluşundan bu yana en yoğun mülteci göçüyle karşılaşmaktadır. Yaşanan bu kontrolsüz ve zorunlu göçe Avrupa toplumları ve devletleri hazırlıksız yakalanmıştır. Mülteci krizini ekonomik olarak fırsata çevirmek isteyen Almanya ise göçmenler için 2015 yazından itibaren açık kapı politikası uygulamaya başlamıştır. Ancak uygulanan açık kapı politikası Alman toplumunun azımsanmayacak bir kesiminde mültecilere ve Müslümanlara yönelik ağır ve şiddetli bir karşı kampanya ortaya çıkardı. Mülteciler ve Müslümanlar aşırı sağ toplumsal hareketlerin gösterilerinde “tecavüzcü”, “işgalci”, “kriminal dolandırıcılar” vb. sıfatlar ile birlikte anılmakta, medya da bu söylemlerin taşıyıcılığını yaparak kamusallaşmasını sağlamaktadır. Böylece aşırı sağı desteklemeyen, apolitik, ya da sığınmacılara karşı hoşgörülü davranan toplum kesimlerinde kamuoyu oluşturularak sığınmacı ve göçmenlere karşı olumsuz algı gündemde tutulmakta, politik olanın merkezine yerleştirilmektedir. Bu çalışmada öncelikle göçmenlere karşı aşırı sağ toplumsal hareketlerin oluşturduğu olumsuz söylemin McCombs ve Shaw’un Gündem Belirleme Kuramı (Agenda Setting Function) bağlamında medya tarafından siyasetin merkezine nasıl oturtulduğu tartışılacaktır. Ayrıca gündemde tutulan mültecilere yönelik olumsuz söylemin gerçeği yansıtıp yansıtmadığı, göçmenlerin ve sığınmacıların biyolojik Almanlardan daha çok suça meyilli olup olmadığı oluşturulan soyut söylemlerden ziyade Almanya İçişleri Bakanlığı’nın yıllık olarak yayınladığı Emniyet Suç İstatistikleri temel alınarak incelenecektir.ABSTRACT IN ENGLISHFar right movements in Germany and evaluation of media discourse of criminal immigrant in the light of official documentsFlows of regular worker migration and regular asylum seekers, of whom European countries are familiar, have significantly changed since 2013/2014 when the civil war of Syria reached its peak. The European Union face probably the most intensive refugee migration since its establishment. European societies and states have not been prepared for this uncontrolled and compulsory immigration. Germany seem to want to turn the refugee crisis into an economic opportunity as evident in their open door policy since the summer of 2015. However, implementation of open-door policy has led a substantial part of German society to a strong campaign against the refugees and Muslims. Refugees and Muslims are referred to as “rapists”, “invaders”, “criminal fraudsters”, and so on in demonstrations of far right movements and media has helped disseminating these discourses. Hence, this manipulated and hateful discourse tries to gain support from the segment of society wh normally does not support far right and often apolitical, or tolerant towards asylum seekers. In this study, the ways in which the negative discourse of far right social movements against immigrants is brought to the centre of the political agenda by media is analysed using the agenda setting framework by McCombs and Shaw. Then, the claims that immigrants are involved in crime, or they are prone to be criminals are analysed and contrasted with the data obtained from the annual Crime and Safety Reports of the German Ministry of the Interior.
