As the title of the session indicates, we will be exploring the future of multilateralism in Latin America, which will inevitably entail looking at its record. Criticisms of multilateralism in the region abound, from recurrent debates about the effectiveness of the Organization of American States (OAS) and other regional institutions in promoting democratic governance and human rights, to the alleged failure of the Andean Community or Mercosur and similar organizations to promote true integration or economic development, or the difficulties in multilateral approaches to addressing crises such as those in Venezuela, Nicaragua, or Haiti.

Most of the extraordinary waves of terror which have swept many Latin American societies since 1970 have occurred in guerrilla-based insurgencies or even civil wars. Because of the massive body counts produced during these confrontations between revolutionaries and counterrevolutionaries based in or linked with a government, human rights organizations have issued a long series of reports about terror—especially that which has been carried out by incumbent regimes and death squads—and which has been supplemented by the exposés of the guerrillas themselves. Amnesty International, the Human Rights group in the Organization of American States (OAS), and Americas Watch have been the major international actors documenting the wave of terror. Many independent national groups, such as El Salvador's “Socorro Juridico” and other human rights organizations linked with church bodies have undertaken that more perilous task at home.

Any speculation about the promise and future of multilateralism in Latin America turns fundamentally on what we mean by multilateralism. If multilateralism is defined in numeric terms, as any formal cooperative endeavor undertaken by three or more states, then it is easy to predict that multilateralism is going to be an ongoing feature international politics everywhere. If the question concerns the future of particular Latin American multilateral institutions, such as the Inter-American Human Rights system, Mercosur, or the Andean Community, there might be greater worry and room for disagreement. We would then want to know “what part of the inter-American Human Rights system/Mercosur/Andean Community are you talking about?”

There are substantial changes in the evolution of world economy and world economic relations. The growth rates of international trade have diminished two-fold, the prices for oil and other commodities have fallen, and the competition on world markets has sharpened greatly. These new trends complicate fundamentally external conditions for the economic development of peripheral regions, especially Latin America. Latin American countries have reached a phase of considerable economic deceleration. Under these circumstances, there is an urgent need for reconsideration of key conclusions made by some Russian experts on the possibilities of the future economic and social growth of Latin America. The author examines the most discussed aspects of the Latin American modern economic situation – the deepening technological gap and slow rates of technological progress, the limited role of internal economic motive forces, the conservation of foreign economic dependence. The future of Latin America’s economic development is uncertain in many respects and will depend greatly on foreign economic conditions. The new world balance opened important additional possibilities for Latin America on world markets. China has converted into the second largest economic partner of the region. But there is a number of complicated problems in their relations that need an urgent regulation. At the same time, the strategic task for Latin America consists in finding of effective ways for further broadening of economic relations with the United States in terms of equality and mutual benefit.

This chapter reflects on the relationship between the Guide of the Organization of American States on the Applicable Law to International Commercial Contracts (OAS Guide) and the Hague Principles. The OAS Guide has several objectives. It proposes a current statement of the law applicable to international commercial contracts for the Americas as based on the fundamental principles of the Inter-American Convention on the Law Applicable to International Contracts, commonly known as the ‘Mexico Convention’, and with the incorporation of subsequent developments in the field to date, particularly as codified in the Hague Principles. The Guide also seeks to support efforts by OAS Member States to modernize their domestic laws on international commercial contracts in accordance with international standards. It further provides assistance to contracting parties in the Americas and their counsel in drafting and interpreting international commercial contracts; and serves as guidance to judges and arbitrators, who may find the Guide useful both to interpret and supplement domestic laws, particularly on matters in international commercial contracts that are not addressed in such laws.
