Tools for Effective Regulation: Is “More” Always “Better”?

AbstractRegulatory inspections and enforcement are seen by many as a key instrument to ensure the effectiveness of regulations – it is broadly assumed to be essential to have supervision and “deterrence” to promote compliance with rules, and thus achievement of regulatory outcomes. However, this presupposes that rules are indeed adequate for reaching outcomes, and that control is what drives compliance with rules. A different approach suggests that compliance is more complex and driven by a combination of factors (ethics, social conformity, procedural justice and legitimacy etc), that rules are imperfect, and that risk-focused, risk-proportionate “regulatory delivery” will achieve better results, more “effectiveness”. Considering a case study of occupational safety inspections and outcomes in Britain, France and Germany, we observe that higher numbers of inspections are not correlated with less fatal incidents, and that, on the contrary, the best outcomes are achieved in the country having the least inspection visits, the most risk-focused system, and the broadest approach to “regulatory delivery”, combining engagement with regulated industries, guidance, responsive and risk-proportionate enforcement, and risk-based, targeted inspections.

BACKGROUND: Mining, especially underground coal mining, has always been a hazardous occupation. Injuries, including those that are fatal, are a major occupational risk that all miners have to face. OBJECTIVE: Despite the fact that all workers are aware of the risks, efforts must be made to increase their safety through the implementation of preventive measures. METHODS: This retrospective study includes injury data from all nine Serbian coal mines over a 16-year period, from 2000 to 2016. All injury data were collected from employee safety and health records. RESULTS: In the analyzed period, a total of 9,273 occupational injuries were recorded at Resavica. The highest number of occupational injuries (over 600) were recorded in 2008 (669), 2004 (651), and 2005 (603). The data shows that almost one fifth of the total number of occupational injuries, or 20.74%, occurred during the said three years. On average, 493.06 minor, 51.12 severe, and 1.29 fatal injuries occurred each year. Every day there were 1.29 minor occupational injuries and every seven days there was one severe injury. CONCLUSIONS: Despite indications that there is a connection between some of the variables and the number of injuries, the general conclusion is that injuries are accidental and unpredictable. The high percentages of injuries are due to the organization of work and the age or qualification structure of the staff and, of course, are the consequence of likelihood –the greater the number of workers, the greater the likelihood of injury. However, the present study showed that some measures can be taken to increase occupational safety and reduce the number of injuries.

Procedural justice advocates argue that fair procedures in decision making processes can increase participant satisfaction with legal institutions. Little critical work has been done however to explore the power of such claims in the context of mass violence and international criminal justice. This article critically examines some of the key claims of procedural justice by exploring the perceptions of justice held by victims participating as Civil Parties in the Extraordinary Chambers in the Courts of Cambodia (eccc). The eccc has created one of the most inclusive and extensive victim participation regimes within international criminal law. It therefore provides a unique case study to examine some of claims of ‘victim-centred’ transitional justice through a procedural justice lens. It finds that while procedural justice influenced civil parties’ overall perceptions of the Court, outcomes remained of primary importance. It concludes by analysing the possible reasons for this prioritisation.

Abstract Protection of buildings against the pernicious radiation types can be achieved by simultaneous structural and shielding parameters. Those shields are mainly made of heavyweight concrete, which causes many serious problems in the areas of technology, supply logistics, financial supply, Occupational Safety & Health Administration, and substitutions of structural and material solutions. This work presents a case study of the construction of the university building with rooms requiring protection against malicious radiations. Apart from that, it presents the problems and solutions that occurred during the construction from the perspective of the works contractor. This study was also expanded to include the analysis of alternatives for construction-materials. The obtained results were used to develop a generalized scheme, which will be helpful in the preparation and implementation of any facilities requiring fixed radiation shields.

Systematic management of occupational safety and health (OSH) issues requires attention in many aspects like regulatory, technical, organizational and managerial. Approaching OSH from an organizational culture perspective can also facilitate achieving sustainable improvements in organizational OSH performance. OSH culture helps in seeing and organizing safety from different perspectives and should not be reduced to a matter of culture only. The knowledge, information and data gathered is expected to be very useful in the process of improving OSH-related procedures, practices and policies, eventually leading to enhanced OSH performance. This paper attempts to describe a cultural approach towards understanding organizational OSH. It will help the readers, professionals, authorities, and policy makers in understanding OSH from a cultural point of view, and how to assess this OSH culture as part of the of organizational improvement process. The aim is to disseminate latest information on this complex topic, trying to build a bridge between practice and research. The scientific literature shows these two terms, safety climate and safety culture, are often interchangeable, but they are distinct but related concepts. The word "safety culture" is a complex and persistent feature reflecting fundamental assumptions, expectations, norms and values, which are also represented by societal culture while "safety climate" best pronounces attitudes, beliefs, and perceptions of employees classically measured by surveys and observations. Safety culture measurement requires detailed investigation of how members in an organization interact to form a shared view of safety. This paper explores the ideas of an organization’s safety climate and culture for the purpose of determining which is more advantageous for accurately describing a "state of safety”. Preliminary results of a case study from a water and power project from Saudi Arabia has been added.

PurposeIn Nigeria, vigilantism appears to be a common response to dissatisfaction about the state police in the recent time. Using survey data of residents in Lagos, Nigeria, the purpose of this paper, therefore, is to explore whether what is already known about perceptions of procedural (in) justice of state police also applies to self-help security groups in Nigeria. This is with a view to influencing community support for and satisfaction with non-state policing in the country.Design/methodology/approachThe study adopted a case study approach. Lagos, Nigeria was stratified into the high, medium and low densities. Systematic sampling technique was used in selecting 1 out of every 20 buildings (5 percent) in each area. Household representative person on each floor of the selected building who had contact with vigilante corps in the last 12 months were targeted. Of 768 copies of questionnaires administered, a sample of 386 was effectively returned (representing 50 percent response rate). Six categories of variables were analyzed. These are procedural justice, distributive justice, vigilante corps’ performance, legitimacy, residents’ satisfaction with vigilante corps activities and socio-economic characteristics.FindingsResults reveal that respondents are not primarily instrumental in their support for vigilantisms. Instead, their support is associated with their basic communal values. More than effectiveness in controlling crime, vigilantisms receive community support provided they use procedural justice in dealings with the public. Respondents who perceive vigilantisms use procedural justice also view them as legitimate, and as well satisfy with their activities and services. Besides, results show that support for and satisfaction with vigilantisms are associated with environmental, social and economic characteristics of the residents in the community they serve. The thesis supported in this research paper is that public support for and satisfaction with vigilantisms can be influenced significantly through policing strategies that builds legitimacy.Originality/valueVigilantism pervades contemporary policing strategies. It is supported by national crime prevention policies, according to the logic that the use of community self-help security strategies could contribute to sustainable crime prevention. This study extends research on legitimacy, with an empirical focus on Nigerian vigilantism. Understanding factors that shape public support for vigilantism may enhance safer communities.
