This article investigates ways in which theatre and performance have the potential to revisit and re-interpret ideological narratives. Drawing on the politics of transnational performance-making processes, it examines how multilingual theatre productions can contribute to the production of subjective and collective identities, and help articulate ideas and perceptions of belonging. With reference to 20/20 – a piece of documentary-style theatre about a major inter-ethnic conflict that took place in 1990 in a bilingual city in Romania – this case study maps out arguments for utilizing multilingualism on stage, and engages with the ethics of representation in the process of multilingual transfer. Billed as  ‘multi-ethnic and multilingual’, the production embraces an agenda that goes beyond the examination of an isolated local conflict and makes the point that both theatre-making and theatre-going are experiences that strongly interact with narratives of cultural identity and hybridization. Thus, the representation of belonging or not belonging is tied in with questions of agency, and the right of individuals to affirm and indeed interrogate their hereditary links to a community.

Культурная идентичность студенчества Донбасса отражает процесс единения молодежи в условиях духовных испытаний, создание общности, способной противостоять идее разобщенности и индивидуально-эгоистического, потребительского отношения к окружающим. The article presents the experience of cultural and educational work at the Gorlovka Institute of Foreign Languages that aims at raising students’ level of culture and forming cultural environment, creating a fashion for the intelligence and education. That is to bridge a gap between the grassroots culture and the spirituality of Russian classical literature, between the orientation to rewrite history and the preservation of traditions of historical memory; between imposing for decades on Russian Donbass the feeling of marginality and defending the right to a special historical path of the inhabitants of the Donetsk region. The cultural identity of the Donbass students embodies the reflection of the process of youth unity in the context of spiritual trials, the creation of a community capable of opposing the idea of disunity to individual and selfish consumerism towards others.

The main agenda of the indigenous movement is fighting for political and cultural rights of ethnic minority communities in accordance with unique historical and cultural practices that they have. As Kymlicka said, minority rights must also be fought because they are on a system that is governed by the majority who pretend to produce injustice. Sami Indigenous Movement in Norway is a form of a long struggle to obtain the right independently to manage natural resources. Currently Sami struggling to maintain the uniqueness of the cultural identity and living practices that have been owned for generations. Saat ini masyarakat Sami berjuang untuk mempertahankan keunikan identitas budaya dan praktik hidup yang telah dimiliki secara turun temurun. While UN treaty bodies have sought to address forms of oppression resulting from the intersection of gender, race and/or disability through their practice, they rarely recognise the experience of groups at the intersection of other social categories. This article uses the lens of intersectionality to analyse the practice of UN treaty bodies in relation to the intersection of minority and refugee status. We argue that while minority-refugees have fled persecution connected to their minority status, UN treaty bodies have failed to appreciate the impact of their location at the intersection of persons belonging to minorities and refugees in host States on their right to preserve their cultural identity. By failing to address the distinct experience of minority-refugees, UN treaty bodies risk participating in their oppression. Further, we reveal that current practice not only has potentially negative consequences for minority-refugees – as both individuals and groups – and for the host society but may even undermine the ability of IHRL to achieve its overarching objectives.

Abstract In ruling T-1022/01, the Colombian Constitutional Court responded to a claim brought by a member of the United Pentecostal Church of Colombia against the Yanacona Indigenous Council. The claimants alleged the violation of their rights to freedom of conscience, worship, and dissemination of thought based on two facts: (a) the refusal of their petition to carry out a “Spiritual Renewal Day” in the main square of the indigenous reservation of Caquiona, and (b) the interruption of the religious gatherings of the United Pentecostal Church of Colombia, as well as the prohibition of their pastors entering the indigenous reservation territory. The Court found no violation of the rights alleged. The purpose of this comment is to explore the understanding by the Colombian Constitutional Court of the right to cultural identity of indigenous communities, focusing particularly on whether it encompasses the right to be free from religious proselytism.

Abstract The Japanese government legally recognized the Ainu as an Indigenous People in 2019. While the legislation is a step forward, it does not provide the Ainu with concrete rights applicable to Indigenous Peoples as those rights are set out in international legal standards, articulated in several human rights instruments and authoritative statements issued by both United Nations organs and the international treaty monitoring bodies. The most common issue concerning Indigenous Peoples’ rights is the practice of traditional livelihoods linked to their lands and resources. Particularly for coastal communities, traditional fishing has been recognized as an important livelihood for sustaining the people’s culture and their ethnic and cultural identity. This article explores the traditional fishing right of the Ainu, which has recently become a point of conflict given that existing local regulations jeopardize the right. The article critically examines the compatibility of the provisions of the conflicting local and national regulations.
