Many Indonesians—primarily those living in rural areas—still follow customary law (adat). The precise rules and processes of that adat differ significantly from place to place, even within short distances. This chapter shows that for many decades, adat has been subservient to national law. State-made law overrode it, leaving it applicable only in a very small proportion of cases where no national law applied, where judges could apply it as ‘living law’. Even in these cases, many judges ignored adat or distorted it when deciding cases. The 1945 Constitution was amended in 2000 to require the state to formally recognize and respect customary law, as practised in traditional communities. The Constitutional Court has given effect to this in various judicial review cases, as have some statutes enacted in the past decade or so. However, this constitutional and statutory ‘protection’ has been impeded in practice by requirements for traditional communities to be formally ‘recognized’ by their local governments, many of whom have been unresponsive to calls for recognition.

Urban encroachment and intensive agricultural activity within the Serpentine–Nicomekl watershed (near Vancouver, B.C.) have caused a series of fish (salmon) kills on the Serpentine River since 1980. Low dissolved oxygen was responsible for these kills. This field project investigated some of the dynamic chemical and biological relationships within the river, as well as the use of an instream aerator as a temporary, in situ, water quality improvement measure. Weekly sampling for a 6-month period during the latter half of 1985 established a solid data base for deriving and interpreting meaningful interrelationships. A strong correlation between chlorophyll a and dissolved oxygen levels before the algae die-off supported the hypothesis that algae blooms dying in the fall could create a serious oxygen demand. Because of these environmental conditions, the river is unable to sustain healthy dissolved oxygen levels during this period. As such, a prototype, 460 m artificial aeration line was designed, installed, and monitored to evaluate its potential for alleviating low dissolved oxygen conditions and improving overall water quality during the critical fall period.The instream aerator ran continuously for over 2 months, starting in September 1985. Despite better-than-expected weather conditions (i.e., cool, wet weather) and relatively high dissolved oxygen levels during the fall of 1985, the data base appeared to support the use of this prototype aeration unit as a means of "upgrading" a stretch of an urban river subject to periodic, low dissolved oxygen levels. As a result, a 2-year follow-up study and river monitoring was initiated. In both 1986 and 1987, late summer and early fall river conditions resulted in the potential for serious salmon kills, due to higher-than-normal river temperatures and very low dissolved oxygen. In both instances, the instream aerator prevented such fish kills in a key stretch of the river. Expansion of the system to include other critical stretches of the Serpentine and other urban river systems, near Vancouver, is being considered. Abstract: This article offers a theoretical discussion on urbanization, nature and development and some of the links and interdependencies that connect these concepts. The focus is on some of the underlying dynamics and issues of our current development project defined as capitalist industrialization. The article illustrates the role of cities for human development and then argues that the relationship between society and nature could be - and indeed already has been - thought from a different perspective. Finally, the article discusses the transition from “campesinato” (peasantry) to traditional communities as product of extensive urbanization, as form of resistance and as potential blueprint for an alternative development and, potentially, for the Lefebvrian urban-utopia.

In Brazil current studies and investments on yams are incipient. Similarly, the literature in recent decades lacks adequate information on this group of plants. The existing literature, on its turn, requires more than ever to be revised and organized. Yams have joined the so-called "neglected" group of crops for several reasons, but particularly because they are associated with poor and traditional communities. Many vegetables introduced in Brazil during the colonization period have adapted to different cropping systems, yams being an excellent example. This diversity resulted very widespread, yet poorly recognized in the country. In turn, the gardens using traditional farming systems continue to maintain and enhance yam local varieties. Studies from other countries, with an emphasis on characterization and genetic breeding, brought to light an urgent need for Brazil to invest in yams as a food rich in carbohydrates, even to the point of alterations in food public policy. Reversal of the yam's current stigma is both a challenge to the scientific community and to the population as a whole. This paper aims to raise pertinent questions about Dioscorea species, an important key group for many communities in tropical countries, yet still unrecognized as so in Brazil.
