Reframing Gender Narratives Through Transitional Justice in the Maghreb

Chapter 6, by Doris H. Gray and Terry C. Coonan, discusses the role of transitional justice mechanisms in Tunisia in reframing gender narratives. They focus on one mechanism, the national truth commission, and the roles of women in it. Building on in-depth interviews, they identify a range of complex debates regarding the status of women visible in post-revolution Tunisia in the context of debates over Islamism and secularism. They argue that examining transitional justice through the lens of gender is important not only because transitional justice has tended to ignore this dimension, but also because in the case of many abuses which women experience, there is continuity before and after transitions. That is to say, gendered abuses by the state, as well as domestic violence and sexual harassment, are not necessarily altered by political change, or properly addressed by post-transition mechanisms.

Zakat is one of the five pillars of Islam which has a function of faith, social and economic functions. Muslims who can pay zakat are required to give at least 2.5 per cent of their wealth. The problem of poverty prevalent in disadvantaged regions because of the difficulty of access to information and communication led to a gap that is so high in wealth and resources. The instrument of zakat provides a paradigm in the achievement of equitable wealth distribution and healthy circulation. Zakat potentially offers a better life and improves the quality of human being. There is a human quality improvement not only in economic terms but also in spiritual terms such as improving religiousity. This study aims to examine the role of zakat to alleviate humanitarian issues in disadvantaged regions such as Sijunjung, one of zakat beneficiaries and impoverished areas in Indonesia. The researcher attempted a Cibest method to capture the impact of zakat beneficiaries before and after becoming a member of Zakat Community Development (ZCD) Program in material and spiritual value. The overall analysis shows that zakat has a positive impact on disadvantaged regions development and enhance the quality of life of the community. There is an improvement in the average of mustahik household incomes after becoming a member of ZCD Program. Cibest model demonstrates that material, spiritual, and absolute poverty index decreased by 10, 5, and 6 per cent. Meanwhile, the welfare index is increased by 21 per cent. These findings have significant implications for developing the quality of life in disadvantaged regions in Sijunjung. Therefore, zakat is one of the instruments to change the status of disadvantaged areas to be equivalent to other areas.

This article examines the transformation of the Kenya National Commission on Human Rights (KNCHR) and discusses the implications of such transformation on the promotion and protection of human rights in Kenya. The article is an exposition of the powers of the Commission and their importance to the realisation of the Bill of Rights under the 2010 Kenyan Constitution. This is done from a normative and institutional perspective with particular emphasis on the extent to which the UN Principles Relating to the Status of National Institutions for the promotion and protection of human rights (the Paris Principles, 1993) have been complied with. The article highlights the role of national human rights commissions in transformative and/or transitional justice in post-conflict Kenya. It also explores the possible complementary relationship(s) between the KNCHR and other Article 59 Commissions for the better enforcement of the bill of rights.

This article argues for the importance of preserving the visual memory of female communist agency in today’s Poland, at the time when the nation’s relationship to its communist past is being forcefully rearticulated with the help of the controversial Decommunization Act, which affects the public space of the commons. The wholesale criminalization of communism by the ruling conservative forces spurred a wave of historical and symbolic revisions that undermine the legacy of the communist women’s movement, contributing to the continued erosion of women’s rights in Poland. By looking at recent cinema and its treatment of female communists as well as the newly published accounts of the communist women’s movement provided by feminist historians and sociologists, the project sheds light on current cultural debates that address the status of women in postcommunist Poland and the role of leftist legacy in such debates.

AbstractFirearms increase the risk of lethality in violent intimate relationships. Policies that restrict access to firearms by respondents to civil domestic violence protective orders (DVROs) are associated with reductions in intimate partner homicide, yet there is scant literature about how such prohibitions are implemented. We document how four localities are implementing gun possession prohibitions that result from civil and criminal restraining orders and domestic violence misdemeanor convictions; and assess the findings in the context of Kingdon’s agenda setting framework. We identified four jurisdictions where gun dispossession of prohibited domestic violence offenders was underway and collected data through in-depth interviews, site visits, and documents. We coded the data, identified explanatory themes, and compared the findings to Kingdon’s framework. The four jurisdictions have policies ranging from no state laws restricting domestic violence offenders’ access to guns to comprehensive state laws. We describe implementation initiatives to dispossess prohibited people of their guns in the four jurisdictions, two distinct implementation models through which gun dispossession occurs, and an expanded application of Kingdon’s model. In each jurisdiction, we identified one or more individuals who championed implementation. Policies that prohibit domestic violence offenders from possessing guns are promising, and possible in diverse settings and jurisdictions. Here we provide insight into implementation efforts in four jurisdictions, emphasize the role of individuals in prioritizing implementation, and highlight the potential to realize these restrictions across states with different laws. Focusing on implementation is a much-needed paradigm shift that complements the traditional focus on passing domestic violence prevention laws.

This paper attempts to explore the  severity of domestic violence experienced by educated woman of Kathmandu.The views presented in this paper are based on my research about theregistered cases of domestic violence against educated women. I have taken in-depth interviews with 14 women of Kalimati Woman Cell. Here I argue that domestic violence, the most heinous act is even found in educated woman and social acceptance of domestic violence is the primary cause for its prevalence and increase.  Moreover, I have taken only the registered cases and it is mostly the educated women who go to women cells to register the cases than the uneducated ones.Educated woman tolerate the pain of domestic violence due to prestige and honour of the family. Education provides knowledge and awareness and enlightens the mind of people. But women are still not awakened and have not been able to discard the perpetrators who have abused them. As violence remains within the home, it remains invisible and accepted as ‘normal’. It is the most shocking truth that,no matter what the educational status of women, women from everywhere face different forms of domestic violence.

Historically, the status of women was very low all over the world however Islam is the only religion which help in changing the status of women and improve her status in the society. This paper explores the lives of Muslim women in the period of early Islamic society which reveals that these women gave the lesson of virtue, piety, devotion and sacrifice to every women and daughter of Islam. These ladies bore exemplary moral character, and in performance of their responsibilities they sacrificed their luxuries, comforts and happiness. Following footprints of these ladies can make every daughter a proud human being.

Conventional wisdom would have us believe that Assam is a state where the status of women is comparatively better off than that of their counterparts in the rest of India, that they suffer from fewer instances of domestic violence. The geographical contiguity of a region which contains some matrilineal tribal societies, significant female mobility, and a near absence of practices such as dowry or sati as part of tradition, might lend some credibility to this belief. However, present indicators and crime statistics have actually shown a high incidence of overall crimes against women in Assam. A complex socio-political milieu, characterised by increasing militarism and insurgency, continuing ethnic and group conflicts in an overall environment where ‘market forces’ dominate, has in its own way posed serious challenges to the security of women and led to the opening up of more and more ‘violent spaces’ –the home being one one of them. The present study endeavours to explore the socio-structural dynamics and contexts rooted in Assam that perpetuate domestic violence against women. The study underscores the necessity of informed policy-level interventions and a holistic approach to address structural constraints that underpin such violence.

AbstractThis article critically examines instances of judicial activism in the field of Islamic family law in Bangladesh in an attempt to assess this judicial trend. Seeing 'judicial activism' mainly as an enlightened application of ijtihād and also as society-specific application of statutes based on, or related to sharī'ah, we highlight the justice-ameliorative role of this concept. The authors argue that judicial activism has led to the amelioration of the status of women in Bangladesh as compared to a traditional construction of the sharī'ah, and that judges have adequate authority and legitimacy to develop Islamic family law to ensure better justice in the home. We conclude that modernist judicial reform is not only desirable but also inevitable in the current South Asian socio-legal milieu, where legislative passivity vis-à-vis Islamic family law prevails.

The purpose of the research reported here is to examine the connection between contraception and those aspects of a woman’s position that are related to her marriage. The research was conducted in two villages among the Pare of northern Tanzania where a shift from hoe cultivation as primary occupation to wage labour has brought about major changes in social relations. The major hypothesis is that a change from a ‘traditional’ marital union to a ‘companionate’ marriage is instrumental in the acceptance of contraception and in lowering fertility. The latter type of relationship between marital partners is related to the status of women. The research methodology consisted of a combination of an ethnographic study, demographic surveys and in-depth interviews. Findings show that approximately half of the women in this community ever used contraception. Of current users, a third are sterilized and half are using a modern reversible method. The determining factor for using modern reversible methods is the nature of the conjugal union.
