Probation Revocation

Despite all the attention paid to the growing prison populations in the United States since the early 1990s, it remains, as it has throughout recent history, that probation accounts for the largest portion of those under the custody of the criminal justice system. The U.S. Department of Justice estimates that at the end of 2015, there were more than 3.7 million adults under the supervision of U.S. probation authorities, compared to 1.5 million in prison, 870,000 on parole, and 728,000 in local jails. And while probation is not often thought about within the context of “mass incarceration” in the United States, probation directly impacts prison and jail populations in two specific ways. First, a sentence of probation for a felony offense is the most frequent alternative to a prison sentence. Second, the revocation of probation can directly lead to the imposition of a sentence to prison or jail, depending on the nature of the original conviction offense. During 2015, in the United States, it is estimated that 12% of all probationers exiting supervision were incarcerated due to probation revocation, which translates to an estimate of more than 233,000 probationers annually. Probation revocation means that the sentencing court has determined that a violation of the conditions of probation have occurred, and because of this, the original probation sentence is no longer appropriate. As a result of a probation sentence being revoked, the sentencing court imposes a different (usually more serious) sanction on the offender. Often, those on probation for a felony offense who have their probation revoked are sentenced to prison, leading to their admission to prison. Indeed, given this link, scholars and practitioners have identified reducing probation revocation as one strategy to reducing prison populations, and jurisdictions often focus on reducing probation revocations as a means to lowering their commitments to prison. Probation revocation can result from either new arrests or violations of technical aspects of the sentence, such as missed appointments or non-compliance with treatment orders. However, whether or not a probation sentence is revoked as a result of these violations varies from jurisdiction to jurisdiction. This variation in the use of probation revocation as a response to violations of probation illustrates the localized nature of revocation proceedings, and attempts to reduce these disparities have taken many forms. These efforts to reduce the impact of probation revocations on prison admissions have ranged from providing local jurisdictions with financial incentives to respond to revocation-eligible violations with sanctions other than incarceration, to legislative efforts to prohibit sentences to prison as a response to probation revocations stemming from technical violations or instances where public safety is not threatened.

Disproportionate rates of HIV infection among African Americans is an increasing concern in the United States. The purpose of this study is to investigate the effect of HIV prevention programs on African Americans and social determinants fueling HIV-related risk behaviors. Using literature, this study analyzed the incidences of HIV infection among African Americans in the United States and the effectiveness of the prevention programs. African Americans struggle with mass incarceration, drugs, stigma, criminalization, and lack of economic opportunities, which contribute to the HIV-related risk behaviors. The existing traditional prevention programs in place are not working for African Americans. Tailored and culturally relevant programs should be designed and implemented. Further studies are needed to establish the causal relationships and develop preventive measures.

Over the past 30 years the U.S. prison population has exploded. With the impact of climate change already here, we are also seeing new critiques of mass incarceration emerge, namely their environmental impact. In response to these burgeoning critiques as well as calls to action by the Justice Department to implement more sustainable and cost-effective strategies in prisons, the United States is experiencing a surge in prison sustainability programs throughout the country. Although sustainability is an important challenge facing the world, this paper argues that while “greening” programs seem like attempts to reform current methods of imprisonment, sustainability programming is an extension of the neoliberalization of incarceration in the United States. By emphasizing cost cutting while individualizing rehabilitation, prisons mobilize sustainability programming to produce “green prisoners” who are willing to take responsibility for their rehabilitation and diminish their economically burdensome behaviors (i.e. excessive wastefulness). Using semi-structure journals and interviews at three Oregon prisons, this paper investigates these ideas through the lens of the Sustainability in Prisons Project.

Recent research on how contact with the criminal justice system shapes racial perceptions in the United States has shown that incarceration increases the likelihood that people are racially classified by others as black, and decreases the likelihood that they are classified as white. We extend this work, using longitudinal data with information on whether respondents have been arrested, convicted, or incarcerated, and details about their most recent arrest. This allows us to ask whether any contact with the criminal justice system triggers racialization, or only certain types of contact. Additional racial categories allow us to explore the racialization of crime beyond the black-white divide. Results indicate even one arrest significantly increases the odds of subsequently being classified as black, and decreases the odds of being classified as white or Asian. This implies a broader impact of increased policing and mass incarceration on racialization and stereotyping, with consequences for social interactions, political attitudes, and research on inequality.

The first part of the twenty-first century has been marked by particularly fraught social and racial tensions in the United States, brought to awareness internationally by the Black Lives Matter protest movement that started in 2014 and the vitriol espoused by the 2016 Republican presidential candidate. Randy Martin's work offers paradigms for interrogating the relationships between dance and its sociopolitical contexts that are highly relevant at this historical juncture. Drawing on some of Martin's key concepts, this article explores choreographic agency and creative strategies in dances that respond to issues of social injustice, mass incarceration, and racial disparities in the criminal justice system. Works by Joanna Haigood (Zaccho Dance Theatre), Amie S. Dowling, filmmaker Justin Forbord, and Kyle Abraham (Abraham.In.Motion) focus on narratives of oppression and disenfranchisement yet also inspire resistance and hope.

This chapter reviews policy implications associated with legalizing marijuana for medical and recreational purposes. The authors discuss the current landscape and attitudes toward marijuana use and review the enforcement polices of the federal government, including the impact of policies within the United States Department of Justice and the United States Government Accountability Office. The chapter also examines the expanding marijuana industry and warns against the growth of ‘Big Marijuana’ and the industry’s ability to influence policy. Finally, after reviewing the important pros and cons of legalizing this drug, the authors offer several guidelines for states to optimize care when legalization is implemented.

Inherent in this examination is to discuss the impact of institutionalization on the propensity of committing violent acts by children. The authors also discuss the impact of these American phenomena on many aspects of juvenile delinquency and violence.

Public schools across the United States have turned to the criminal justice system as a gold standard of discipline. As public schools and offices of justice have become collaborators in punishment, rates of African American suspension and expulsion have soared, dropout rates have accelerated, and prison populations have exploded. Nowhere, perhaps, has the War on Crime been more influential in broadening racialized academic and socioeconomic disparity than in New Orleans, Louisiana, where in 2002 the criminal sheriff opened his own public school at the Orleans Parish Prison. “The Prison School,” as locals called it, enrolled low-income African American boys who had been removed from regular public schools because of nonviolent disciplinary offenses, such as tardiness and insubordination. By examining this school in the local and national context, this book shows how young black males are in the liminal state of losing educational affiliation while being caught in the net of correctional control. This book asks how schools and prisons became so intertwined. What does this mean for students, communities, and a democratic society? And how do we unravel the ties that bind the racialized realities of school failure and mass incarceration?

Mass incarceration is characterized by comparatively and historically extreme rates of imprisonment in the United States, which rose drastically from the early 1970s through 2007 or so. Disproportionately affecting young, Black men from neighborhoods of concentrated disadvantage, many factors contributed to the steady increase in incarceration from the early 1970s forward. While rising crime rates and harsh societal attitudes toward those convicted of crimes played a part, scholars largely argue that increases in both the likelihood of imprisonment for committing a crime and the length of prison sentences drove the increase in incarceration. Supported by more-intensive and place-based forms of policing, individuals and entire communities faced increasing contact with the criminal justice system. Underlying these policy changes lay deeper social, political, and economic drivers, which often varied by state or other jurisdictions. Ultimately, policy changes mandating longer sentences for repeat offenses (such as three-strike laws) and state and federal laws that increased the length of prison sentences for drug-related and violent crime led to a rising incarceration rate, which meant that far more Americans were serving time and for much-longer sentences than ever before. While the rate of incarceration for men has started to decline slightly, rates for women have risen. During the first two decades of the 21st century, researchers have increasingly focused their efforts on understanding and documenting the collateral consequences of mass incarceration. Beyond the individuals directly impacted, incarceration affects the lives of children and families, neighborhoods, communities, and broader society. Individuals and families especially experience detrimental effects in the education, labor market, and health spheres, while communities suffer “spillover effects,” with even those not directly touched by incarceration affected. With nearly one in thirty-six adults living under some form of correctional supervision (whether in prison or jail, or on probation or parole), and many others “marked” by their past experience with the system, mass incarceration has touched the lives of millions of Americans. Further, racial disparities throughout each phase of the criminal justice system, including in policing, arrest, conviction, and sentencing, have resulted in Americans of color disproportionately experiencing incarceration and its attendant effects. As such, mass incarceration is understood to be a major contributor to 21st-century American inequality along lines of race, class, and gender.
