Calculating Race: Racial Discrimination in Risk Assessment presents the historical relationship between statistical risk assessment and race in the United States. It illustrates how, through a reliance on the variable of race, actuarial science transformed the nature of racism and, in turn, helped usher racial disparities in wealth, incarceration, and housing from the nineteenth century into the twentieth. The monograph begins by investigating the development of statistical risk assessment explicitly based on race in the late-nineteenth-century life insurance industry. It then traces how such risk assessment migrated from industry to government, becoming a guiding force in parole decisions and in federal housing policy. Finally, it concludes with an analysis of “proxies” for race—statistical variables that correlate significantly with race—in order to demonstrate the persistent presence of race in risk assessment even after the anti-discrimination regulations won by the Civil Rights Movement. Offering readers a new perspective on the historical importance of actuarial science in structural racism, Calculating Race is a particularly timely contribution as Big Data and algorithmic decision-making increasingly pervade American life.

It is a pleasure to comment on Nancy MacLean's hugely important book Freedom is Not Enough: The Opening of the American Workplace as an example of what I might call “bringing the law back in” to the history of the civil rights movement. A generation ago, the idea that law needed to be introduced into this history would have seemed nonsensical. At that time, law provided one of the central touchstones in the historical narrative of the struggle for racial equality in American life. Scholarship in this area built on C. Vann Woodward's pioneering work on the rise of Jim Crow, which itself was written shortly after Woodward's participation in the Brown v. Board of Education litigation. The dominant narrative began with the legal construction of Jim Crow in the late nineteenth century and continued with the founding of the NAACP. Other actors came along at various points in the story, prominent among them New Deal–era racial liberals, World War II–era activists, midcentury social scientists, Southern civil rights leaders and movements, and eventually black power. The end point was marked by the litigation and legislative victories of the 1950s and '60s, which finally wrote back into law what had been taken away by segregationist white Southerners and a compliant Supreme Court in the late nineteenth century. The implicit methodological take on law was that state and federal statutes, as well as court decisions, provided an important impetus, or at the very least a validation, for racial change—first for white Southerners as they created the Jim Crow legal regime and later for segregation's opponents as they reinscribed racial equality onto the core narrative of American life.

Race, religion, and sports may seem like odd bedfellows, but, in fact, all three have been interacting with each other since the emergence of modern sports in the United States over a century ago. It was the sport of boxing that saw a black man become a champion at the height of the Jim Crow era and a baseball player who broke the color barrier two decades before the civil rights movement began. In this chapter, the role that religion has played in these and other instances where race (the African American race in particular) and sports have collided will be examined for its impact on the relationship between race and sports. The association of race, religion, and sports is not accidental. The chapter demonstrates that all three are co-constitutive of and dependent on each other for their meaning at these chosen junctures in American sports history.

This book follows California’s history of segregation from statehood to the beginning of the long civil rights movement, arguing that the state innovated methods to control and contain African Americans and other people of color. While celebrated in popular discourse for its forward-thinking culture, politics, and science, California also pioneered new ways to keep citizenship white. Schools, streetcars, restaurants, theaters, parks, beaches, and pools were places of contestation where the presence of black bodies elicited forceful responses from segregationists. Black Californians employed innovative measures to dismantle segregation in the nineteenth and twentieth centuries; they borrowed some tactics from race rebels in the South, others they improvised. West of Jim Crow uses California to highlight the significance of African American resistance to racial restrictions in places often deemed marginal to mainstream civil rights histories. Examining segregation in the state sheds light on the primacy of gender and sexuality in the minds of segregationists and the significance of black women, black bodies, and racial science, in the years preceding the modern civil rights struggle. California has much to teach us about the lives of African Americans who crossed the color line and the variety of tactics and strategies employed by freedom fighters across the United States.

The duality of attention is explored by turning our focus to the political and cultural conceptions of automatic attention and deliberate attention, with the former being associated with animality and “uncivilized” behavior and the latter with intelligence and self-mastery. In this article, I trace this ongoing dualism of the mind from early race psychology in the late nineteenth century to twentieth century psychological models including those found in psychoanalysis, behaviorism, neo-behaviorism, and behavioral economics. These earlier studies explicitly or implicitly maintained a deficiency model of controlled attention and other mental processes that were thought to differ between racial groups. Such early models of attention included assumptions that Black and Indigenous peoples were less in control of their attention compared to whites. This racialized model of attention, as seen in the law of economy in the nineteenth century, with similar manifestations in psychoanalysis and neo-behaviorism in the twentieth century, can now be seen in present-day dual-process models as used in current psychological research and behavioral policy. These historical connections show that attention is not a value-neutral term and that attention studies do not stand outside of race and structural racism.

As U.S. cities burgeoned in the late nineteenth century, their environmental problems multiplied. In response, some urban elites worked to rebuild the city to alleviate its environmental ills; others relocated to more environmentally enticing surroundings in new suburban developments. For members of both groups, new forms of transportation infrastructure profoundly shaped how they responded to the era's environmental crisis. Whereas efforts to rebuild and retrofit downtown were hampered by the difficulties and expense of working in densely built and populated areas, efforts to build on the urban fringe faced few serious obstacles. As a result, the most significant late nineteenth-century attempts to use transportation to remake city dwellers' relationships with nature in the United States - including tools developed with an eye on rebuilding dense city centers - exercised far greater influence on the expanding periphery of cities than on their environmentally fraught cores.

In the 1960s, global decolonization and the civil rights movement inspired hope for structural change in the United States, but more than fifty years later, racial disparities in income and wealth, education, employment, health, housing, and incarceration remain entrenched. In addition, we have seen a resurgence of overt White supremacy following the election of President Trump. This chapter considers the potential of movements like Black Lives Matter and the Standing Rock water protectors in light of the experiences of the Black Panther Party, the American Indian Movement, and other efforts at community empowerment in the “long sixties.”

The introduction also situates students’ rights within the context of children’s rights more broadly, explaining the legal principles that justified age discrimination and excluded children and students from the basic protections of American constitutional law. The introduction identifies the two decades between the 1960s and 1980s as a constitutional moment that revolutionized the relationship of students to the state. This chapter focuses on John Robert Seeley (1834–95), the most prominent imperial thinker in late nineteenth-century Britain. It dissects Seeley's understanding of theology and religion, probes his views on the sacred character of nationality, and shows how he attempted to reconcile particularism and universalism in a so-called “cosmopolitan nationalist” vision. It argues that Seeley's most famous book, The Expansion of England (1883) should be understood as an expression of his basic political-theological commitments. The chapter also makes the case that he conceived of Greater Britain as a global federal nation-state, modeled on the United States. It concludes by discussing the role of India and Ireland in his polychronic, stratified conception of world order.
