Inquiry and Argument in the Secular Academy

Part IV turns to an extended engagement with the academic study of religion, which is often constitutively hostile to any form of theology. Chapter 11 identifies some of the norms of inquiry and argument that prevail in the secular academy in order to show that analytic theology conforms to those very same norms. I develop a framework for academic argument that depends on the notion of “discursive commitments,” taken from the pragmatist philosophy of Robert Brandom and Jeffrey Stout. Here is the central insight: when we engage in academic argument, we are obliged to support our claims with reasons and evidence, and to respond with reasons and evidence when our claims are appropriately challenged.

This essay asks whether a pragmatist philosophy of history can make sense of the notion of historical facts. It is tempting to think it cannot, since pragmatists insist, as James puts it, that the trail of the human serpent is over everything. Facts, by contrast, are typically thought of as something untouched by the human serpent, something impervious to what we think and do. I argue, however, that there is a way of understanding facts that is perfectly at home in pragmatist philosophy of history. Drawing on work by Robert Brandom, I propose that facts be interpreted inferentially. On this view, to call something a fact, or to say that the facts make my beliefs true, is simply a shorthand way of saying that a particular sort of relationship exists among certain sentences. I further show that this inferential understanding of facts is fully compatible with the distinctive features of historical inquiry. In particular, it is compatible with history’s irreducibly narrative character, and with the way different narratives can reveal radically different facts. Finally, I use this account of historical facts to respond to a classic criticism of pragmatism: the charge that pragmatism is narcissistic. I argue that pragmatism is narcissistic in only the minimal sense that it cannot countenance theory-neutral givens. But pragmatists can happily grant that there is more to truth than consensus, and that our claims are answerable to facts that everyone can get wrong.

SummaryRecently, there has been a proliferation of international agreements imposing minimum standards on states in respect of their treatment of foreign investors and allowing investors to initiate dispute settlement proceedings where a state violates these standards. Of greatest significance to Canada is Chapter 11 of the North American Free Trade Agreement, which provides both standards for state behaviour and the right to initiate binding arbitration. Since 1996, four cases have been brought under Chapter 11. This note describes the Chapter 11 process and suggests some of the issues that may arise as it is increasingly resorted to by investors.

This philosophy guides our work as field experimentalists interested in behavioral measurement. Furthermore, all psychologists can relate to its ultimate aim set out by William James: to study mental processes that provide explanations for why people behave as they do in the world.

Recently, the Nigerian Senate passed the Bankruptcy and Insolvency (Repeal and Re-enactment) Bill. This is no doubt a welcome development following the continued demand by insolvency practitioners, academics and other stakeholders for such legislation. The call has not only been for the enactment of just about any legislation, but (consistent with the economic challenges faced by businesses in the country), one that is favourably disposed to the successful restructuring of financially distressed businesses, allowing them to weather the storm of (impending) insolvency, emerge from it and continue to operate within the economy. This article seeks to situate this draft legislative instrument within the present wave of preventive restructuring ably espoused in the European Union Recommendation on New Approaches to Business Rescue and to Give Entrepreneurs a Second Chance (2014), which itself draws largely from Chapter 11 of the US Bankruptcy Code. The article draws a parallel between the economic crisis that gave rise to the preventive restructuring approach of the Recommendation and the present economic situation in Nigeria; it then examines the chances of such restructuring under the Nigerian draft bankruptcy and insolvency legislation. It argues in the final analysis that the draft legislation does not provide for a prophylactic recourse regime for financially distressed businesses. Consequently, a case is made for such an approach.

AbstractDaniel Chwolson (1819–1911) made a huge impact upon the research of Hebrew epigraphy from the Crimea and Caucasus. Despite that, his role in the more-than-a-century-long controversy regarding Crimean Hebrew tomb inscriptions has not been well studied. Chwolson, at first, adopted Abraham Firkowicz’s forgeries, and then quickly realized his mistake; however, he could not back up. Th e criticism by both Abraham Harkavy and German Hebraists questioned Chwolson’s scholarly qualifications and integrity. Consequently, the interference of political pressure into the academic argument resulted in the prevailing of the scholarly flawed opinion. We revisit the interpretation of these findings by Russian, Jewish, Karaite and Georgian historians in the 19th and 20th centuries. During the Soviet period, Jewish Studies in the USSR were in neglect and nobody seriously studied the whole complex of the inscriptions from the South of Russia / the Soviet Union. The remnants of the scholarly community were hypnotized by Chwolson’s authority, who was the teacher of their teachers’ teachers. At the same time, Western scholars did not have access to these materials and/or lacked the understanding of the broader context, and thus a number of erroneous Chwolson’s conclusion have entered academic literature for decades.
