On the Role of Intellectual Property Protection during the Technological Innovations in Chinese Knowledge-Intensive Enterprise

As discussed in chapter 10, knowledge-based assets, intellectual property, and capital play a fundamental role in an enterprise’s competitiveness, especially in small knowledge intensive enterprises. Small knowledge intensive enterprises need to create new ways of operating in order to manage the intellectual and knowledge-based assets in their organizations more efficiently. Organizational knowledge and intellectual property can be protected, either formally via IPR, or informally via efficient knowledge management. Successful IP protection requires systematic intellectual property and knowledge management. Intellectual property protection via efficient knowledge management affects the entire organization rather than being just a separate task. It needs to be embedded in organizational work routines, practices, and processes as an overall operational strategy. When embedded in organizational work processes, IP protection and knowledge management become a continuous part of work routines and tasks in the enterprise, not a separate action.

This paper brings together the importance of intellectual property protection (IPP) and entrepreneurship in economic growth. The paper surveys the economic literature on what factors are important to growth. The focus is on recent models of endogenous growth which reflect on the role of investment, technological change and education. Secondly, publications, which measure the impact of IPP on some of the growth elements identified are reviewed. The third section deals with IPP and the entrepreneur as an important agent and facilitator of growth. It discusses the nature of IPP as an incentive in not only stimulating the development of new technologies and processes but also the dissemination of existing technologies. Using the surveys as background, short case studies for India and Brazil are presented on IPP as a stimulus and application of research and development. The last section summarizes the previous sections and draws some conclusions with respect to policy.

Intellectual property protection is an important ingredient in the market success of knowledge-intensive enterprises operating in the information technology industry. The governance and the extent of protection of intellectual property related to software often seem to be connected to certain characteristics of an enterprise, such as its type and size. By analyzing the publicly available data, the author identifies various patterns primarily concerning the structure of ownership and management of the software enterprises in Croatia. The analysis reveals that all of the top 500 software enterprises according to revenue are closed, with the overwhelming majority being owner-managed and small or micro-sized. This would suggest that most software enterprises in Croatia are passive when it comes to their intellectual property. In relation to this, the author describes three profiles of enterprises depending on their attitude towards the governance of intellectual property. The author also formulates and explores four possible complementary approaches to the protection of intellectual property, both legal and non-legal, in addition to discussing various types of intellectual property rights with the aim of identifying those that are more suitable for the protection of different types of software.

AbstractSpin-off biotech companies often have difficulties in creating competitive advantage through protection of their intellectual property, due to their limited human and financial resources. Having considered the value of the intellectual property and questions of enforceability, spin-off companies should use patenting only for inventions with a high market value and high patent enforceability; otherwise, publishing early or keeping the invention a trade secret should be preferred. This allows the inventor to benefit from operational freedom while maintaining low costs. The impact of the protected intellectual property on the success of the firm depends on its speed of entry into the market and when it reaches break-even point. In a transition country with a poorly developed entrepreneurial environment, patents may expire before the spin-off company has produced any profit from its expenditures on the protection of the intellectual property. It should also be remembered that their products may contain modules which are already protected by other inventors. Consequently, a strategically fundamental issue for the success of spin-off firms is the careful selection of the markets in which to operate, and the choice of the proper degree and method of intellectual property protection.

Trade secrecy, a form of intellectual property protection, serves the important societal function of promoting innovation. But as police departments across the country increasingly rely on proprietary technologies like facial recognition and predictive policing tools, an uneasy tension between due process and trade secrecy has developed: to fulfill Brady’s constitutional promise of a fair trial, defendants must have access to the technologies accusing them, access that trade secrecy inhibits. Thus far, this tension is being resolved too far in favor of the trade secret holder—and at too great an expense to the defendant. The wrong balance has been struck. This Note offers three contributions. First, it explains the use of algorithms in law enforcement and the intertwined role of trade secrecy protections. Second, it shows how trade secrecy clashes with the Due Process Clause—the Constitution’s mechanism for correcting the power asymmetry between the state and the defendant—and argues that due process should not waver simply because a source of evidence is digital, not human. Third, it proposes a solution that better balances a defendant’s due process rights with intellectual property protections.
