Elusive Virtue: Rethinking the Role of Female Chastity in Early Modern Spain

AbstractFor decades, scholars have emphasized the importance of female chastity in early modern Spanish society. Early modern thinkers enthusiastically promoted the notion in their works, Mediterranean anthropologists formulated a cultural model around female chastity through their studies, and early modern historians followed suit in their examinations of the Catholic Reformation. However, this analysis of recent works on gender and the extensive demographic literature on early modern Spain reveals that there is little evidence that female chastity was a priority for most Spaniards. Instead, demography, economy, class, and the influence of regional cultures may have had more of an impact on the development of sexual mores than any overarching cultural program.

SummaryThis article aims to describe the reasons for the decline of customary law in the early modern era. Confining the discussion to a limited geographical setting – the Iberian Peninsula – the arguments I used might be easily applied to other European jurisdictions. Part I presents an explanation of the predominance of custom in the medieval Spanish legal traditions. Part II describes the general features of the law in the early modern era, since they contributed – to a greater or lesser degree – to the demise of custom. Part III focuses more specifically on the theoretical and practical reasons for the decline and displacement of custom in early modern Spain. Part IV describes the consequences of the Decrees of Nueva Planta (1707-1718), approved by Felipe V in the context of the War of the Spanish Succession (1700-1714), regarding the development of the notion and role of custom in the eighteenth century. The article concludes with some reflections, emphasising that although customs do not easily co-exist with the state or a strong political power, neither do they entirely perish.

Astrology, its legitimacy, and the limits of its acceptable practice were debated in sixteenth- and seventeenth-century Europe. Many of the related arguments were mediated by the work of Giovanni Pico della Mirandola and the responses to it. Acknowledging the complexities of the relationship between astrological ideas and Christian teachings, this paper focuses on the Catholic debates by specifically considering the decisions about astrology taken by the Spanish Inquisition. The trials of astrologers are examined with the aim of understanding the role of experts in astrology in early modern Spain. This study brings into view the specific nature of the debate on astrology in Spain, the consequences of the actions of the Inquisition and the social control it exerted. The historical events discussed comprise a particular case and also mirror the general debates about astrology taking place in early modern Europe. The experts’ opinions expressed in trials and in reports about the discipline received by the Inquisition reveal two key traits of the debate: the dispute about who had the authority to decide on the legitimacy of astrology and the disagreement about what constituted natural and judicial astrological practices. These led to different opinions about what was to be done with each defendant and about what content in their books ought to be forbidden.

Animal spectacles are vital to a holistic appreciation of Spanish culture. In Transoceanic Animals as Spectacle in Early Modern Spain, Beusterien christens five previously unnamed animals, each of which was a protagonist in a spectacle: Abada, the rhinoceros; Hawa’i, the elephant; Fuleco, the armadillo; Jarama, the bull; and Maghreb, the lion. In presenting and analyzing their stories, Beusterien enriches our understanding of the role of animals in the development of commercial theater in Spain and in the modern bullfight. He also contributes to growing scholarly conversations on the importance of Spain in the history of science by examining how animal spectacles had profound repercussions on the emergence of the modern zoo and natural history museum. Combining scholarly content analysis and pedagogical sagacity, the book has a broad appeal for scholars of the early modern Spanish Empire, animal studies scholars, and secondary and postsecondary instructors looking for engaging exercises and information for their Spanish language, culture, and history students.

This chapter explores the connections between global history and maritime history by discussing the variable factors present within each discipline. It discusses maritime Spain, the role of technological trade, and the expansion of trade as the basis of analysis, and deconstructs the term ‘globalisation’ and its many definitions in attempt to provide an accurate intersection between the two disciplines. It concludes that in order to open up new perspectives, global history should not be considered on a geographical scale, but rather one that encompasses comparisons, connection, and interactions within trade.

This article examines the role of women in raising criminal actions of homicide before the central criminal court, in early modern Scotland. In doing so, it highlights the two main forms of standing women held; pursing an action for homicide alone and as part of a wider group of kin and family. The evidence presented therein challenges our current understanding of the role of women in the pursuit of crime and contributes to an under-researched area of Scots criminal legal history, gender and the law.

Abstract The Middle Low German Beast Epic Reynke de Vos (1498) is about two legal proceedings against the fox Reynke, who is charged by the other animals with the tricks he played on them. When he is sentenced to death, Reynke defends himself by delivering speeches that are constructed as described in ancient rhetoric. Part of those speeches is Reynke’s lie about his treasure, which he would give to the lion if he pardoned him. Reynke describes three pieces of jewellery as part of this made-up possession, one of which is a mirror. When Reynke describes it, he also tells Aesopic fables that are carved into its wooden frame. His fictional artefact, especially the interplay of its specific material and the content of the fables told, has a poetological level. In his description, Reynke hybridizes the political discourse of the early modern period, in which the virtue of prudentia becomes more and more important, with the rhetorical competence to deliver speeches and tell fables. In his fiction of the mirror he draws up a poetological draft that combines the role of a rhetor in court with his well-known properties of being clever and cunning. By describing the artefact, Reynke shows how to use rhetorical strategies, especially to tell fables, as an instrument to gain acceptance and to acquire political influence.
