Defending the Foundations of the European Model of Social State (Sozialstaalichkeit)

This chapter emphasizes the deliberate political decision by which countries like the United States initially established a liberal state, which adopted the welfare state model in the twentieth century, while the European countries establish a social state within the liberal tradition as a deliberate democratic political decision supporting economic equality and individual well-being. The European model, which was later adopted by non-Western countries such as India and South Africa, is, however, being reversed by the process of globalization of trade and internationalization of economy without democratic legitimization because the demos are not part of these decisions. To that extent these decisions, besides reversing the European process of social state, also fail to satisfy the principle of democratic decision making.

The article is devoted to the problem of the social state as one of the fundamental constitutional principles of the state structure of modern developed countries. The course of historical development of philosophical and legal thought on this problem is considered. The idea of a close connection between the concept of the social state and the ideas of utopian socialism of Thomas More and Henri Saint-Simon is put forward. Liberals also made a significant contribution to the development of the idea of the social state, they argued that the ratio of equality and freedom is a key problem for the classical liberal doctrine. It is concluded that the emergence of the theory of the social state for objective reasons was inevitable, since it is due to the historical development of society.

The article argues for a proposal for such a step in the direction of strengthening social support for the least protected groups of the Russian population and the development of the entire system of social state guarantees as a whole, as the introduction of a socially acceptable consumer basket instead of a consumer basket of the subsistence minimum. The advantages of the normative method of forming consumer baskets over the normative-statistical method are revealed. Based on the analysis of actual consumption of both food and non-food products and services, the qualitative and quantitative structure of the socially acceptable consumer basket is determined (using natural and value indicators).
