Global development of transportation dependent on internal combustion engines, involves major increases in the consumption of fossil fuels obtained by extracting crude oil from depths by means of wells and refining it. In this context, protection of environment and groundwater quality is an increasingly difficult objective to maintain, requiring modern methods to address possible negative effects on the environment. The current research assesses the degree of eco-toxicological and environmental risk for an oil exploitation area in case of an accidental pollution scenario with crude oil. The entire risk spectrum was analysed through a set of qualitative and quantitative risk assessment tools to highlight and quantify the most important effects caused by petroleum products on biotope and biocenoses. The primary aim of the research is to identify vulnerable environmental reservoirs for accidental oil pollution and to establish the best tools to quantify the environmental and ecotoxicological risk of groundwater contamination. The results obtained from the area showed a low to medium risk of contamination of the saturated and unsaturated area with crude oil expressed as TPH (total petroleum hydrocarbons) and a low risk of contamination with volatile organic compounds type BTEX associated contamination of biocenoses that can directly or indirectly interact with potentially polluted areas.

Aim: The paper discusses cases in which a refusal by an energy enterprise to connect other enterprises to the network is treated as a prohibited abuse of the enterprise's dominant position and, equally, will represent behavior prohibited by art. 12 of the Treaty on the Functioning of the European Union and by art. 9 par. 2 item 2 of the Competition and Consumer Protection Law as well as legal consequences of such refusal. It is important to pinpoint such cases since the EU sectoral regulation does not provide for obligating any undertakings which manage and operate oil pipelines to enter into contracts with other undertakings such as contracts on connecting into their network or contracts on providing crude oil transfer services. Conditions for accessing oil pipelines and selling their transfer capacities are determined by the owners of the networks: private oil companies in the countries across which the pipelines are routed. These conditions are not governed by the EU law.  Furthermore, the very obligation of connecting other entities to own network by energy undertakings operating in the oil transfer sector in Poland will only arise from generally applicable provisions of the Polish competition law.  Design / Research methods: The purpose of the paper has been reached by conducting a doctrinal analysis of relevant provisions of Polish and EU law and an analysis of guidelines issued by the EU governing bodies. Furthermore, the research included the functional analysis method which analyses how law works in practice. Conclusions / findings: The deliberations show that a refusal to access the network will be a manifestation of a prohibited abuse of a dominant position and will be a prohibited action always when the dominant's action is harmful in terms of the allocation effectiveness. It will be particularly harmful when delivery of goods or services objectively required for effective competition on a lower level market, a discriminatory refusal which leads to elimination of an effective competition on the consequent market, a refusal leading to unfair treatment of consumers and an unjustified refusal. Originality / value of the article: The paper discusses the prerequisites which trigger the obligation to connect entities to own network by energy undertakings operating in the oil transfer sector. The obligation has a material impact on the operations of the oil transmitting undertakings, in particular on those who dominate the market. The regulatory bodies in the competition sector may classify a refusal of access to own network by other enterprises as a prohibited abuse of the dominant position, exposing such undertakings to financial consequences.Implications of the research: The research results presented in the paper may be used in decisions issued by the President of the OCCP and in judgement of Polish civil courts and EU courts. This may cause a significant change in the approach to classifying prohibited practices to prohibited behavior which represent abuse of the dominant position. The deliberations may also prompt the Polish and EU legislator to continue works on the legislation.

Shellfish are frequently contaminated by Campylobacter spp, presumably originating from faeces from gulls feeding in the growing or relaying waters. The possible health effects of eating contaminated shellfish were estimated by quantitative risk assessment. A paucity of data was encountered necessitating many assumptions to complete the risk estimate. The level of Campylobacter spp in shellfish meat was calculated on the basis of a five-tube, single dilution MPN and was strongly season-dependent. The contamination level of mussels (<1/g) appeared to be higher than in oysters. The usual steaming process of mussels was found to completely inactivate Campylobacter spp so that risks are restricted to raw/undercooked shellfish. Consumption data were estimated on the basis of the usual size of a portion of raw shellfish and the weight of meat/individual animal. Using these data, season-dependent dose-distributions could be estimated. The dominant species in Dutch shellfish is C. lari but little is known on its infectivity for man. As a worst case assumption, it was assumed that the infectivity was similar to C. jejuni. A published dose-response model for Campylobacter-infection of volunteers is available but with considerable uncertainty in the low dose region. Using Monte Carlo simulation, risk estimates were constructed. The consumption of a single portion of raw shellfish resulted in a risk of infection of 5–20% for mussels (depending on season; 95% CI 0.01–60%). Repeated (e.g. monthly) exposures throughout a year resulted in an infection risk of 60% (95% CI 7–99%). Risks for oysters were slightly lower than for mussels. It can be concluded that, under the assumptions made, the risk of infection with Campylobacter spp by eating of raw shellfish is substantial. Quantitative risk estimates are highly demanding for the availability and quality of experimental data, and many research needs were identified.

AbstractThe Internet-of-Things (IoT) triggers data protection questions and new types of cyber risks. Cyber risk regulations for the IoT, however, are still in their infancy. This is concerning, because companies integrating IoT devices and services need to perform a self-assessment of its IoT cyber security posture. At present, there are no self-assessment methods for quantifying IoT cyber risk posture. It is considered that IoT represent a complex system with too many uncontrollable risk states for quantitative risk assessment. To enable quantitative risk assessment of uncontrollable risk states in complex and coupled IoT systems, a new epistemological equation is designed and tested though comparative and empirical analysis. The comparative analysis is conducted on national digital strategies, followed by an empirical analysis of cyber risk assessment approaches. The results from the analysis present the current and a target state for IoT systems, followed by a transformation roadmap, describing how IoT systems can achieve the target state with a new epistemological analysis model. The new epistemological analysis approach enables the assessment of uncontrollable risk states in complex IoT systems—which begin to resemble artificial intelligence—and can be used for a quantitative self-assessment of IoT cyber risk posture.
