This article examines contemporary struggles over same-sex marriage in the daily lives of black lesbian- and gay-identified South Africans. Based primarily on 21 in-depth interviews with such South Africans drawn from a larger project on post-apartheid South African marriage, the author argues that their current struggles for relationship recognition share much in common with contemporaneous struggles of their heterosexual counterparts, and that these commonalities reflect ongoing tensions between more extended-family and more dyadic understandings of African marriage. The increasing influence of dyadic understandings of marriage, and of associated ideals of romantic love, has helped inspire same-sex marriage claims and, in many cases, facilitate their acceptance. At the same time, continuing contestation over such understandings helps drive instances of opposition.

John Trengove’s film Inxeba (The Wound) was met with public outcry as it represented the sacred tradition of ulwaluko (“initiation”). The film was effectively banned in mainstream South African cinemas following a ruling by the Film and Publication Board (FPB) to assign a rating of X18 to the film. Many rights groups and activists were troubled by the FPB’s decision and argued that the outcry against the film was due to homophobic reactions to the representation of same-sex sexualities within hypermasculine Xhosa spaces. However, this paper argues for a more nuanced reading of the protests against the film, taking into account the symbolic aggression that the act of “truth-telling” in the film seemed to enact on traditional Xhosa people. I analyse the controversy by using ideas from Lacanian psychoanalysis as it relates to film study. I explore the film itself as analogous to Lacan’s concept of the mirror, creating tension between subject (in this case, traditional South Africans) and the image, or the representation of black individuals and cultural practices in the film. Additionally, I explore the radical alterity of the Other in the film, the seat of revulsion, threat and hostility, represented simultaneously by the queer characters and at times by constructs and images of whiteness, the whiteness of the director of the film and the whiteness represented in the text which is seen as threatening to Xhosa culture and values. I argue that the reactions to the film speak to deep psychic tensions in South Africa in terms of culture, sexuality and representation, and I explore how the controversy constitutes a pivotal moment in rethinking and reconfiguring South African queer representations, particularly concerning black subjects.

 This issue of the Potchefstroom Electronic Law Journal (South Africa) sees the publication of a selection of articles derived from the Third International Congress of the World Society of Mixed Jurisdiction Jurists (WSMJJ). That Congress was held at the Hebrew University of Jerusalem, Israel in the summer of 2011. It reflected a thriving Society consolidating its core scholarship on classical mixed jurisdictions (Israel, Louisiana, the Philippines, Puerto Rico, Quebec, Scotland, and South Africa) while reaching to new horizons (including Cyprus, Hong Kong and Macau, Malta, Nepal, etc). This publication reflects in microcosm the complexity of contemporary scholarship on mixed and plural legal systems. This complexity is, of course, well-understood by South African jurists whose system is derived both from the dominant European traditions as well as from African customary systems, including both those that make up part of the official law of the state as well as those non-state norms that continue to be important in the daily lives of many South Africans.

This article examines the origin of the term “visual activism” in the context of post-independence South Africa, and further reflects on its development in response to anti-gay legislation in contemporary Nigeria and Uganda. The emergence of an explicitly queer strain of visual activism on the continent was sanctioned by South Africa’s pro-gay Constitution and propagated by the works of photographer Zanele Muholi. Whereas South Africa’s sociopolitical context has permitted the expression of queer visual activism through forms of photography and documentary media in Nigeria and Uganda, this expression has been routinely monitored and suppressed by such policies as the Same-Sex Marriage (Prohibition) Bill (SSMPA) and the Anti-Homosexuality Bill, respectively. This study specifically references the works of South African Muholi in conversation with those of Nigerian-American Adejoke Tugbiyele and Ugandan native Leilah Babirye as a means to articulate how these punitive national policies have forced contemporary queer visual activists to adopt expressive rather than representational forms of visual protest. This paper identifies a distinct difference in epistemological origin, aesthetic composition, and formal materiality across the practices of Muholi, Tugbiyele, and Babirye in order to explore the multiplicity of the genre as well as broaden conventional conceptions of African queer visual activism.

Like other countries in transitional democracies, South Africa is experiencing high levels of crime since its first democratic election in 1994. About 83 percent of South Africans believe that the South African Police Service is corrupt and citizens are losing faith in the government to protect them as promised in the Constitution. As a result citizens are paying a large portion of their disposable income on security expenses to protect themselves and their property. Currently no tax relief is available for non-trade related security expenditure, as stated by the South African Revenue Services in 2008 after a public outcry to allow private security expenses as a deduction. This paper urges government to revisit its decision made in 2008. Private security expenses have become a necessity in the daily lives of South Africans. This was demonstrated by surveying four of the largest private security companies in an area of Tshwane Metropolitan Municipality (previously called Pretoria), South Africa. The paper ends by proposing three possible ways of providing tax relief for private security expenses.

With the enactment of the Civil Unions Bill in 2006, South Africa became the fifth country in the world, and the first in Africa, to legalize same-sex marriage. While supporters of the bill hailed the decision as signaling the end of discrimination against homosexual couples, critics slammed it as undermining traditional marriage between a man and woman. The attitudes and beliefs of a sample of South African students regarding homosexuality and same-sex marriage were investigated. A survey was conducted among a sample of 150 undergraduate students at a predominantly black university in the Western Cape. Results showed that 71% viewed same-sex marriages as strange and supported religious groups opposed to such marriages. Close to 40% supported discrimination against homosexuals with 46% indicating that they should be denied the right to adopt children. It is concluded that, despite having legal protection, public acceptance of homosexuals and same-sex marriage may be quite limited in South Africa.

Many scholars and South African politicians characterize the widespread anti-foreigner sentiment and violence in South Africa as dislike against migrants and refugees of African origin which they named ‘Afro-phobia’. Drawing on online newspaper reports and academic sources, this paper rejects the Afro-phobia thesis and argues that other non-African migrants such as Asians (Pakistanis, Indians, Bangladeshis and Chinese) are also on the receiving end of xenophobia in post-apartheid South Africa. I contend that any ‘outsider’ (White, Asian or Black African) who lives and trades in South African townships and informal settlements is scapegoated and attacked. I term this phenomenon ‘colour-blind xenophobia’. By proposing this analytical framework and integrating two theoretical perspectives — proximity-based ‘Realistic Conflict Theory (RCT)’ and Neocosmos’ exclusivist citizenship model — I contend that xenophobia in South Africa targets those who are in close proximity to disadvantaged Black South Africans and who are deemed outsiders (e.g., Asian, African even White residents and traders) and reject arguments that describe xenophobia in South Africa as targeting Black African refugees and migrants.

In this study we draw on a series of in-depth interviews with chief executives of some of South Africa’s most prominent businesses, to investigate how their careers unfolded as they rose to the top of their organisations.Twenty-seven CEOs of South Africa’s top companies were interviewed. Eleven of these companies are listed among the top 50 South African companies.We trace the evolution of leadership, from its embryonic beginnings in childhood and adolescence, through the different stages of a developing career to the crucial transformation of an operational mindset into a strategic one.We examine the circumstances that led to these CEOs being appointed and describe the difficulties of transitioning from a senior management role into that of chief executive. We look at the competencies and experience necessary to be effective as the leader of an organisation, as well as the role played by motivation and self-belief. Finally, we identify the unique leadership challenges faced by chief executives in South Africa and pass on their advice to the country’s next generation of leaders.

September 2014 marked the release of the 2013/14 crime statistics in South Africa by the National Commissioner of the SAPS and the Minister of Police. Does a sense of safety and security fill the atmosphere? Do most South Africans, investors, and tourists alike believe that the crime rate in South Africa is reflective of a war zone and that South Africa is in a quagmire that engenders irretrievable damage to the lives of the citizenry and the economy? It is accepted that crime is a conflation of a number of economic, social and cultural factors; hence as a reviewable point, can the SAPS ensure the development of unassailable and perpetual policy solutions, underpinned with the highest quality that provides a guarantee of the citizen’s basic constitutional right to freedom and life. This article reviews literature on TQM and extrapolates lessons learnt to the practical functioning of the SAPS with a view to provide a myriad of TQM principles that may be considered by SAPS Management; this could serve as a catalyst for an improved policing service in South Africa.

Green, Sonn, and Matsebula's (2007) article is useful in helping to establish and develop whiteness studies in South African academia, and thus to shift the academic gaze from the margins to the centre. The article is published in the wake of three waves of international whiteness studies, which successively described whiteness as a space of taken-for-granted privilege; a series of historically different but related spaces; and, finally, as part of the global, postcolonial world order. Green, Sonn, and Matsebula's (2007) contribution could be extended by more fully capturing the dissimilarity in the texture of the experience of whiteness in Australia and South Africa. In South Africa whiteness has never had the quality of invisibility that is implied in the ‘standard’ whiteness literature, and in post-apartheid South Africa white South Africans cannot assume the same privileges, with such ease, when state power is overtly committed to breaking down racial privilege.
