China’s legal framework for governing foreign investment has recently been considerably streamlined in comparison to its former self. The newly promulgated Foreign Investment Law of the People’s Republic tends to level the investment playing field in the country so that foreign investors can no longer enjoy significant privileges that have been unavailable to domestic firms and entrepreneurs. Operating a relatively nondiscriminatory mechanism, such as has been introduced, will in practice mean reliance on a negative list approach to confine inflows of overseas capital to specifically identify sensitive sectors. As China has committed its market to opening up on a much grander scale in the foreseeable future, the new foreign investment regime and accompanying ideology may not necessarily deter foreign investors from looking for opportunities in the foreseeable future. Subject Reform of China's foreign investment law. Significance The new Foreign Investment Law that took effect on January 1 is a response to a slowing economy and pressure from other governments, particularly the United States, to ‘level the playing field’ for foreign investors. Impacts There will not be a flood of new investment as a result of the law, but it will make a difference over time. Companies will have five years to prepare for structural changes as rules specific to foreign-invested companies disappear. The regulations contain few specifics on enforcement, indicating that Beijing is not yet ready to give teeth to the law.

<p>The subject of this dissertation is the relationship between the protection of foreign investors' investments under international investment law and the domestic law of host states. Two questions arise in this connection. First, is the promotion and protection of investments comprised in investment agreements compatible with states' domestic law? Second, public policies of host states may appear to be in contradiction with an increased international security of investments. When such a conflict is challenged by foreign investors, what are the consequences for both parties? In general, investments are transactions that are private in nature, whose aim is to generate a positive rate of return. Investments can have pervasive consequences on countries' welfare, including, for example, the consequences on sustainable development; the use and protection of natural resources; and employment, to name a few. It is the role of the governments to balance these sometimes conflicting public and private interests. As of today, it seems that the regime established according to investment treaties does not strike an appropriate balance between the various interests concerned. After a brief look at the legal framework protecting foreign investments, the conflict areas between investment treaty provisions and domestic public policies of host states are explored through an empirical analysis of some case studies and recent arbitrations. Finally, this dissertation holds that, at a substantive level, investment law is a part of international law. Thus it must be consistent with its norms and it has to be interpreted in accordance with customary rules of treaty interpretation. The dissertation concludes by suggesting the creation of a state-investor relationship and advocates, in part, the establishment of development objectives in investment treaties as well as the inclusion of rights and obligations for all parties involved.</p>

AbstractThe chapter examines the evolution of the role of the home state in foreign investment law. Traditionally, such a role was essentially limited to norm-setting and protecting nationals and national companies abroad. Protection was typically offered through diplomatic protection, which was based on the legal fiction that the state was vindicating its own right. The conclusion of modern investment treaties, the progressive emancipation of foreign investors and the development of investor-state arbitration meant a marginalisation of the home state. Some recent treaties, however, have paved the way for a new role for the home state that goes well beyond protection of its nationals and national companies. Innovative provisions have introduced obligations and responsibilities for the home state, especially with regard to the fight against corruption and the liability of its own investors. It remains to be seen to which extent these provisions will spread across the international community of states.

In 2010, South Africa reviewed its foreign investment legal framework and during this process, it terminated most of its bilateral investment treaties. For a period, there was no piece of legislation that dealt with the regulation of investment in South Africa and investors had to comply with commercial laws. To solve this problem, South Africa introduced the Investment Act in 2015 aimed at regulating both domestic and foreign investment within its territory. In light of the above, the questions central to the article are whether the Investment Act in its current form balances the rights and obligations of foreign investors and that of host states. If not, what can be added or deleted from the Investment Act in order to balance these two competing rights? The article first looks at why South Africa terminated the bilateral investment treaties. It then compares the Investment Act with the SADC FIP to ascertain if the Investment Act is aligned with the sub-regional standard of foreign investment protection. Finally, recommendations are made which include suggested amendments to improve the Investment Act.

Статья посвящена вопросам исследования отдельных особенностей правового регулирования функционирования Свободного порта Владивосток и территорий опережающего социально-экономического развития путем создания благоприятных условий для иностранных инвесторов, вкладывающих свои или заемные средства в ведение предпринимательской деятельности в пределах данных особых зон. Авторы исследуют нормативную базу регулирования деятельности резидентов указанных территориальных зон, а также проводят анализ факторов, препятствующих повышению активности зарубежных инвесторов по осуществлению финансирования российской экономики и развитию Дальнего Востока. Так, в первую очередь проводится анализ истории нормативного регулирования вопроса привлечения иностранных инвестиций в российскую экономику. Первый законодательный акт в данной области в современной истории был принят ещё во время существования СССР. В дальнейшем нормативная база, касающаяся данного вопроса, продолжала расширяться и совершенствоваться. Исследование касается вопроса льготного порядка создания в пределах вышеуказанных зон объектов инфраструктуры, предназначенных для обеспечения деятельности иностранных инвесторов. В частности, проводится анализ нормативного регулирования, устраняющего избыточное административное регулирование и ускоряющего процесс получения необходимых согласований. Кроме того, рассматривается вопрос преференций при предоставлении земельных участков резидентам, в том числе участков, относящихся к лесному фонду. В ходе исследования поднимается тема недостаточного регулирования порядка предоставления земельных участков, отнесённых к ведению Министерства обороны Российской Федерации. Далее исследуется тема обеспечения резидентов с иностранным участием рабочей силой. В этой связи анализируются порядок привлечения иностранной рабочей силы и соотношение данного льготного порядка с привлечением местных работников. Исследование включает также анализ нормативного регулирования материального обеспечения деятельности резидентов с иностранным участием, а именно – порядка таможенного регулирования поставок товаров и материалов из-за рубежа. Рассматривается вопрос предварительной подачи документов для таможенного оформления ввозимых резидентом материалов. Такой порядок упрощает и ускоряет дальнейшее использование ввезенных товаров. По результатам проведённого исследования делается вывод о том, насколько успешно действующее правовое регулирование в указанной сфере выполняет функцию по привлечению иностранного капитала. Abstract. The article is devoted to the study of certain peculiarities of legal regulation of the functioning of the Free Port of Vladivostok and advanced special economic zones by creating favorable conditions for foreign investors who invest their own or borrowed fundsin running business within these special zones. The authors examine the legal framework for regulating the activities of residents of these territorial zones, and also analyze factors that impede the increase in the activity of foreign investors in financing the Russian economy and the development of the Far East. First of all, an analysis is made of the history of legal regulation of the issue of attracting foreign investment in the Russian economy. The first legislative act in this area in modern history was adopted during the existence of the USSR. In the future, the legal framework relating to this issue continued to expand and improve. The study addresses the issue of a preferential procedure for creating infrastructure facilities within the above-mentioned zones intended to support the activities of foreign investors. In particular, the analysis of legal regulation is carried out, eliminating excessive administrative regulation and accelerating the process of obtaining the necessary approvals. In addition, the issue of preference when providing land to residents, including plots related to the forest fund, is being considered. The study raises the topic of inadequate regulation of the procedure for the provision of land allocated to the Ministry of Defense of the Russian Federation. Further, the topic of providing residents with foreign participation with work force is investigated. In this regard, the procedure for acceptance of foreign work force and the correlation of this preferential procedure with the involvement of local workers is analyzed. The study also concerns the normative regulation of the material support of the activities of residents with foreign participation, namely, the procedure for customs regulation of deliveries of goods and materials from abroad. The issue of preliminary filing of documents for customs clearance of materials imported by a resident is being considered. Such an order simplifies and speeds up further use of imported goods. Based on the results of the study, a conclusion is drawn on how successful the current legal regulation in this area performs the function of attracting foreign capital. Legal protection provided by the state to investors is one of the considerations for foreign investors before investing in a country. This study aims to find out and analyze the legal protection of foreign investment in Indonesian law and implications itself. This research is a descriptive study, which analyzes and describes systematically, factually, and accurately the provisions relating to legal protection against foreign investment in Indonesia. Based on the results of the study, it is known that legal protection against foreign investment in Indonesian law is regulated in the Investment Law. This law has provided adequate protection for foreign investors for a variety of risks including non-commercial risks in foreign investment in Indonesia. Providing the widest opportunity for foreign investors to invest their capital in Indonesia has encouraged many foreign investors to invest in Indonesia.Keywords: Investor, Investment, Legal Protection.

The Brazilian energy sector suffered constantly changes during the past years. The process of transformation looked for a competitive market aiming funds to develop infrastructure in Brazil. Foreign investment is necessary to develop and strengthen the energy market, but the sector still present some challenges to be faced by the foreign investors. As consequence, some questions shall be raised in connection with the real effectiveness of mechanisms imposed to foreign investment at its entrance in the Brazilian energy sector. Does the Brazilian legal framework provide legal certainty to the foreign investors interested in investing in the energy sector? The objective of this article is to provide an overview of reform made to the energy market and current hindrances to the investor’s entry in such sector.

Abstract The current research focuses on the most important features of the Foreign Investment Law of 2019 in the State of Qatar, including guarantees and incentives for foreign investors. These include customs, tax, financial and investment advantages and exemptions, in addition to protection for the foreign investor from non-commercial risks that may be caused by his investment in the country. This research reached a number of conclusions and made recommendations that focus on strengthening as well as enforcing incentives and guarantees based on the Executive Regulation of the Law. These guarantees, along with some proposed recommendations, will be issued shortly, making the enforcement law a real and attractive element for foreign investment.
