This article follows an earlier assessment of Bentham’s views on guardianship 1 that touched on but did not explore connections or departures between guardian-ward and parent-offspring relations, about which Bentham was not as precise as he might have been. Further, he added complexity to the issue by describing parents as occupying dual roles: guardians and ‘masters’ (employers) of their own offspring. These relations are now considered, on the one hand, in the wider context of ‘special relations’ and ‘duties’ and, on the other hand, alongside some appreciation of Bentham’s personal perspectives. However, the main object of the present article is to assess similarities and differences between parents and guardians in legal, status and functional terms. It uses the profile of guardian-ward relations provided by the previous article 2 as a benchmark. The article concludes by affirming that ‘being a parent’ and ‘being a guardian’ have quite different meanings.

В статье рассматриваются методики в расследовании уголовных дел, касающихся должностных преступлений коррупционной направленности и преступлений против личности, совершаемых по мотиву национальной ненависти или вражды. Выявлены и предлагаются к обсуждению как общие аспекты, способствующие раскрытию вышеуказанных категорий преступлений с одной стороны, так и особенности, связанные с их спецификой – с другой стороны. Также авторами предложены новые методологические особенности для раскрытия и расследования указанных категорий дел, помогающие предварительному следствию успешно справляться с поставленными задачами. The article discusses the methods of scientists in the investigation of criminal cases concerning official crimes of corruption and crimes against the person committed on the basis of national hatred or enmity. The present article has two objectives. One is to elucidate the philosophical approach presented in the so-called Strahov Systematic Manuscripts of Jan Patočka in terms of consciousness and nature. The other is to compare this philosophical approach with Maurice Merleau-Ponty’s theses on nature, as elaborated in 1956–1961, and to point out some advantages and limitations of both approaches. In our opinion, Patočka’s philosophical approach consists, on the one hand, in a descriptive analysis of human experience, which he understands as a pre-reflective self-relationship pointing towards the consciousness of the world. On the other hand, on the basis of this descriptive analysis Patočka consequently explicates all non-human life, inorganic matter, and finally the whole of nature as life in its own right, the essence of which is also a certain self-relation with a tendency towards consciousness. The article then briefly presents Merleau-Ponty’s theses on nature, and finally compares them with Patočka’s overall theses on nature. The advantage of Patočka’s notion of nature as against Merleau-Ponty’s is that, in Patočka’s view, nature encompasses both the principle of unity and individuality. On the other hand, the advantage of Merleau-Ponty’s understanding of nature as against Patočka’s lies in the consistent interconnectedness of the infinite life of nature and the finite life of individual beings.

This study compares the development and use of evaluative expressions in the English narratives elicited from 80 Chinese–English bilinguals and 80 American monolingual peers at four ages – five, eight, ten, and young adults – using the wordless picture book Frog, where are you? (Mayer, 1969). Results revealed both similarities and differences between monolingual and bilingual groups. On the one hand, regardless of bilingual status, there is a clear age-related growth in the development and use of evaluative expressions. On the other hand, bilingual children in our study differed from monolingual children in the quantity and quality of evaluative clauses used. The results are discussed with respect to linguistic and cultural differences between English and Chinese.

Two kinds of meanings are usually associated to the Basque particle bide.1 On the one hand, it has been taken to point to the indirect nature of the speaker’s evidence for the truth of the proposition put forward. According to this view, it would be a sort of inferential particle. On the other hand, bide has been associated to the expression of a certain degree of belief or certainty on the truth of the proposition. This double dimension of bide resembles various aspects of the meaning and use of another Basque particle – omen. The morpho-syntactic behaviour of these two particles is practically identical, and their semantics and pragmatics invite a close comparison. Thus, starting from our conclusions regarding omen, we explore the similarities and differences between both particles. We find two main differences. First, bide encodes a doxastic dimension that is absent from the semantic meaning of omen. And, second, bide can be taken to be an illocutionary force indicator that does not contribute to the proposition expressed, while omen does contribute to the truth-conditions of the utterance.

Contemporary researchers of local communities and human societies face a new and difficult task today. It is, on the one hand, related to the great interest in this topic and the difficulty of creating a new concept that would fully exhaust the scope of phenomena observed presently in local communities and human societies. On the other hand, the character of changes that have gained momentum in the first decade of the 21st century, and the description of their sources, become particularly difficult to describe and name. The present article is an attempt at an indication of the need of an evolution of perception on societal reality and the emerging new social issues. Contemporary paedagogy attempts to write about the necessity of awareness/ education related to the needs of establishment of local communities and the creation of bonds as a response to processes related to social life in times of globalisation. It is a fact that we are presently dealing with a change in the forms and character of local communities.

AbstractBuddhist schools of thought share two fundamental assumptions about language. On the one hand, language (śabda) is identified with conceptual thinking (kalpanā), which according to the Buddhist doctrine (dharma) separates us from the momentary and fleeting nature of reality (satya, “truth”). Language is comprised of generally applicable forms, which fuel the reificatory proclivity for clinging to the distorted – and ultimately fictious – belief in substantial existence. On the other hand, the distrust of language is mitigated by the doctrine of ineffability (anirdeśya), which although asserts that reality is beyond the scope of linguistic description, submits that philosophical analyses of key Buddhist concepts is a means of overcoming the limitations that language imposes on our experience and facilitating insight into the nature of reality (bodhi). This paper provides an overview of Buddhist philosophy of language, with an emphasis on the dialectical view of language as indispensable but ultimately insufficient for contemplation. The Buddhist discussions of ineffability are explicated and compared with its treatment in modern Occidental thought, specifically the similarities and differences with Wittgenstein’s philosophy of language.

This article examines translating and translations primarily from a sem(e)iotic viewpoint. The focus is, on the one hand, on a semiotic re-reading of certain translationtheoretical suggestions (such as the idea of translation being an inherently semiotic category), and on the other hand, on a translation-theoretical re-reading of certain semiotic suggestions (such as what signs can be used for representing). Other proposals that receive a revisiting discussion include, for instance, Roman Jakobson’s translation typology and Umberto Eco’s notion of semiotics as a theory of the lie. The approach adopted in the present article advocates a serious re-reading and attitude, but even more, a literal reading and sometimes, a less serious attitude as well.

Abstract For quite a long time it has been part of the opinio communis within Hebrew Bible scholarship that compassion and empathy with persona miserae is in its very meaning invented by Ancient Israel. This view has been challenged by a comparative study of Frank C. Fensham. The present article shows on the one hand that care for the poor, widows and orphans is in fact not innovative. On the other hand, a closer analysis is able to show that the biblical and Jewish care for the strangers, slaves and animals is indeed unique.

La idea de que la fenomenología de Husserl representa una suerte de filosofía reflexiva, basada en una metodología que desarrolla la tradición cartesiana, se ha convertido en una creencia ampliamente difundida en la literatura filosófica. Este énfasis puesto por Husserl en la reflexión fue arduamente criticado por Heidegger. Desde entonces resulta frecuente encontrarse con la afirmación de que Husserl y Heidegger desarrollan dos conceptos de fe-nomenología diferentes, incluso antagónicos. No se trata de seguir alimentando esta discusión historiográfica. Aquí, por una parte, se muestra el núcleo de la temprana crítica heideggeriana en el transcurso de sus primeras lecciones de Friburgo (1919-1923) y Marburgo (1924-1928) y, por otra, se sopesan algunas de las observaciones críticas de Heidegger a Husserl a la luz de evidencias textuales de la fenomenología husserliana, ignoradas no sólo por Heidegger, sino también por un sorprendente número de reconocidos especialistas en el campo de la filosofía, de las ciencias cognitivas y de la filosofía de la mente.The idea that Husserl’s phenomenology is a kind of reflective philosophy inspired by the Cartesian tradition has become a common-place in the philosophical literature. Heidegger was one of the first thinkers who criticized the Husserlian emphasis on reflection. Since then it is easy to find the affirmation that Husserl and Heidegger developed two different, even antagonistic concepts of phenomenology. Here is not the place to continue embracing this discussion. One the one hand, the present article shows Heidegger’s early criticism developed in the course of his first lectures in Freiburg (1919-1923) and Marburg (1924-1928). On the other hand, it weighs up some of Heidegger’s critical remarks regarding the reflective nature of Husserlian phenomenology in the light of important textual evidences ignored not only by Heidegger, but also by a surprising number of specialists in the fields of philosophy, cognitive sciences, and philosophy of mind.

The article considers the institution of other persons in the proceedings for the review of judicial acts on newly discovered or new circumstances. The positions of scientists on who can act as other persons who have the right to apply to the Institute of revision are analyzed. Some examples of false reasons for these individuals to apply for review have been identified. An attempt is made to develop proposals aimed at clarifying the provisions of legislation on the opportunities of such entities to protect their rights on the one hand and on the other hand not to create unnecessary burden on the work of courts by unfair procedural behavior.
