Abstract: The General Election Commission (KPU) is national, permanent, and independent general election organizers. General election, which is held to elect members DPR, DPRD, DPD, the president and vice president, is a means of implementing the rule of the people who carried out directly, generally, freely, confidentially, honestly and fairly in the Unitary State of the Republic of Indonesia based on Pancasila and Constitution of the Republic of Indonesia (UUD) 1945. Within the Islamic political jurisprudence’s perspective, the duties and authorities of the General Election Commission in selecting the candidate for president and vice president participants are not contrary to the principles or the Islamic teachings. They also more emphasize to consultation and transparency in justice in doing the job. Otherwise, KPU can also be equated with ahlul halli wal aqdi institution. This institutions has the authority to decide and accommodate the aspirations of the people and institutions that have duty to determine a leader.Keywords: Electoral commission, president, Islamic political jurisprudence.

AbstractPolitical discourse that is being discussed today is Provincial Assembly of the Republic ofIndonesia proposes the fifth amendment of Contitution 1945 that candidates of Presidentand Vice President can be from individual candidate; by offering amendment of paragraph6A article (2) Constitution 1945 to become “Candidate of President and Vice Presidentcome from the proposal of political party of general election participant or from individual”.This discourse actually based on idea to realize democratization in the practice ofpresidential election; that sovereignty is on the people’s hand and to provide the maximumspace for the people who has capability to lead this great nation; and basically all people isequal in front of Law and Governance. General Election is a means of implementing the sovereignty of the people in direct, general, free, confidential, honest, and fair manner within the Unitary State of the Republic of Indonesia based on Pancasila and the Constitution of the Republic of Indonesia Year 1945. The election has many dynamics, expensive politics, lavish campaign funds for image politics, costly consulting and surveys of winning money, as well as money politics. The disclosure of political parties is highly important in the implementation of the elections due to the many streams of corruption used in the election. As a result, people do not believe in political parties, or some Indonesians are no longer sympathetic to political parties. The idea of a political party's financial transparency regulation should be carefully examined in the Indonesians’ election codification scheme. In the future, Indonesia must have a transparent and accountable campaign or political funding arrangement, along with strong sanctions and binding on the parties involved. Therefore, the people will restore their trust to the political parties, and assure the political parties to channel their aspirations in the granting of rights in the elections.Keywords: Finance; Political parties; Corruption

Abstract: This article discusses about a Islamic political jurisprudence’s point of view againts campaign for president and vice president election. It is carried out based on Law No. 42 year 2008 concerning with the election of president and vice president. The general election campaign is a sovereign right of the people to produce democratic government based on Pancasila and the Constitution of the Republic of Indonesia (UUD) 1945. The implementation of the general election campaign has a positive effect that is beneficial for the candidates and for the publics to know the candidates they would choose to be a leader. In Islamic political jurisprudence’s perspective, the implementation of the general election campaign for president and vice president can realize the political rights of individuals associated with the right to nominate and the right to occupy a certain post. All of the people and citizens are entitled to gain a guarantee of their human rights (Hurriyah al-shakhsiyyah) before the law and government.Keywords: Campaign, general election, president, Islamic political jurisprudence.

Abstract: Sovereignty of the People and local elections in the Context of the Constitution of the Republic of Indonesia Year 1945. There are two opinions in the phrase "democratically elected", which is contained in Article 18 paragraph (4) of the 1945 Constitution, the first opinion that local elections be directly elected and a second opinion that local elections can be done by Parliament. When seeing the interpretation of the others paragraph in the 1945 Constitution relating to elections, the local elections are not the same as the general election, such election DPR, DPD, DPRD, President and Vice President. Local elections through representation system done ​​by Parliament is also can be considered democratic that also reflects the people souvereignty which is characterized by Pancasila, as aspired by the Founding Fathers.Abstrak: Kedaulatan Rakyat dan Pemilihan Kepala Daerah Dalam Konteks Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Ada dua pendapat dalam frasa “dipilih secara demokratis”, yang terdapat dalam Pasal 18 ayat (4) UUD 1945, yaitu pendapat pertama bahwa pemilihan kepala daerah dipilih secara langsung dan pendapat kedua pemilihan kepala daerah dapat dilakukan oleh DPRD. Apabila melihat penafsiran pasal-pasal lain dalam UUD 1945 yang berkaitan dengan pemilihan umum, maka pemilihan kepala daerah tidak sama dengan pemilihan umum, seperti pemilihan umum anggota DPR, DPD, DPRD, Presiden dan Wakil Presiden. Indonesia is a country that adopts a democratic system that puts sovereignty in the hands of the people. As a manifestation of people's sovereignty, there is a direct election process, in which the people can determine their choices in electing the House of Representatives, the Regional Representative Council, the Regional People's Representative Council, the President and Vice President, the Governor and Deputy Governor, the Regent and Deputy Regent, as well as the Mayor and Deputy Mayor. The purpose of the study was to analyze the discretionary authority of the National Election Commission as a state institution. Research methods, this type of research is normative research, using a statutory approach, and conceptual. Sources of legal materials use primary, secondary and tertiary legal materials. After the legal materials are collected and identified, the analysis of legal materials is carried out using analytical prescrisive methods, namely studying the purpose of the law, the values of justice, the validity of the rule of law, legal concepts, and legal norms. In conclusion, the General Election Commission is a supporting state institution or an auxiliary institution or an independent institution that is of a national, permanent and independent nature which holds elections in Indonesia. The General Election Commission in safeguarding the constitutional rights of voters has the authority to make discretionary decisions on issues if the laws and regulations do not regulate, are incomplete or unclear so that it causes stagnation at some stages, especially in the preparation and determination of the Voter List in the Data Upgrading Stages.

The journal entitled Elections with Integrity in the State of Democratic Law was made for several reasons. First, elections are a means of implementing popular sovereignty as the implementation of normative provisions of the 1945 Constitution of the Republic of Indonesia, especially Article 1 Paragraph (2) which states that "Sovereignty be in the hands of the people and carried out according to the Constitution, ". Sovereignty in the hands of the people is also manifested through elections as a means of rotating leadership both at the national and regional levels carried out through direct, general, free and confidential principles. Secondly, elections in the 1945 Constitution are carried out by a general election commission which is referred to by the General Election Commission (KPU), Third, because the means of implementing people's sovereignty carried out by the KPU must be carried out by people who are not only professionals but also must have the main requirements, namely having dignity and integrity, Fourth, so that the implementation of the election is on track in accordance with the provisions of applicable legislation, supervision must be carried out by Law No. 7 of 2017 on Elections called the Election Supervisory Body (Bawaslu) ) The General Election Commission (KPU), Bawaslu, as the EMB has hierarchical levels from the central, provincial and district / city levels. AbstractElection is the embodiment of democracy in Indonesia, the political participation of the people in elections which is implemented in the form of voting rights by people who already have the right to vote. Article 1 paragraph 2 of the 1945 Constitution of the Republic of Indonesia states that sovereignty is in the hands of the people and is exercised according to the Constitution, in its implementation, an Election is held as a process of channeling the aspirations of the people who already have rights where all citizens have the same rights to choose and be chosen to be a leader. The purpose of this research is to provide an understanding and description of the strategy of the General Election Commission in enhancing the role of women in the Regional Head Elections in Pesawaran District in 2020. This research uses qualitative data analysis methods, namely describing and analyzing the data and data sources obtained and then described in the form real explanation. The results showed that the strategy of the General Election Commission (KPU) of Pesawaran Regency in increasing the role of women in regional head elections was carried out by maximizing the ability of electronic media and internet media to socialize, increasing cooperation from related organizations to socialize, and Validating Voter Data.AbstrakPemilu merupakan perwujudan dari Demokrasi di Indonesia, Partisipasi politik masyarakat dalam Pemilu yang diimplementasikan dalam bentuk pemberian hak suara oleh masyarakat yang telah memiliki hak untuk memberikan suaranya. Pasal 1 ayat 2 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 menyatakan bahwa kedaulatan berada ditangan rakyat dan dilaksanakan menurut Undang-Undang Dasar, dalam pelaksanaannya maka diadakan Pemilu sebagai proses penyaluran aspirasi rakyat yang telah memiliki hak dimana seluruh warga negara memiliki hak yang sama untuk memilih dan dipilih menjadi pemimpin. Adapun tujuan penelitian ini adalah untuk memberikan pemahaman dan gambaran mengenai strategi Komisi Pemilihan Umum dalam peningkatkan peran perempuan pada Pemilihan Kepala Daerah di Kabupaten Pesawaran Tahun 2020. Penelitian ini menggunakan metode analisis data kualitatif yaitu mendeskripsikan serta menganalisis data dan sumber data yang diperoleh kemudian dijabarkan dalam bentuk penjelasan yang sebenarnya. Hasil penelitian menunjukkan bahwa strategi Komisi Pemilihan Umum (KPU) Kabupaten Pesawaran dalam meningkatkan peran perempuan pada pemilihan kepala daerah dilakukan dengan memaksimalkan kemampuan media elektronik dan media internet untuk bersosialisasi, meningkatkan kerjasama dari organisasi-organisasi terkait untuk bersosialisasi, dan Validasi Data Pemilih.

Abstrak Implikasi putusan mahkamah konstitusi terkait penggunaan KTP dan paspor dalam pemilihan presiden dan wakil presiden dalam kerangka menjamin hak memilih dalam pemilihan umum. Terkait dengan ini maka memunculkan permasalahan terkait implikasinya. Bagaimana implikasi baik secara langsung maupun tidak langsung putusan Mahkamah Konstitusi terkait penggunaan KTP dan Paspor dalam pemilihan umum. Mahkamah Konstitusi sebagai lembaga pelaksana kekuasaan kehakiman yang salah satu kewenangannya adalah menguji Undang-Undang terhadap UUD Negara Republik Indonesia Tahun 1945 dalam rangka mewujudkan negara demokrasi yang berdasarkan hukum sebagaimana termaktub dalam Pasal 1 UUD Negara Republik Indonesia Tahun 1945. Hasilnya adalah implikasi langsung yang terdiri dari penerapan KTP dan Paspor sebagai ganti DPT, Memunculkan putusan yang bersifat self executing, mengesampingkan Peraturan Pemerintah Pengganti Undang-undang, mengesampingkan keputusan dan peraturan KPU terkait aturan baru akibat putusan MK dan Implikasi tidak langsung yang terdiri dari Mengurangi terjadinya perselisihan hasil Pemilihan Umum Presiden, KPU bekerja ekstra. Tujuan ke depan penelitian ini adalah untuk mengetahui dan memberikan sumbangsih dalam dunia akademik terutama terkait tentang penjaminan hak asasi manusia terutama hak memilih dalam pemilihan presiden dan wakil presiden. Penelitian ini menggunakan metode kajian peraturan perundang-undangan yang sesuai dengan metode ilmu hukum. Kata Kunci: Putusan Mahkamah Konstitusi, Pemilu, Kartu Tanda Penduduk Abstract The implications of the constitutional court's decision regarding the use of resident identity cards and passports in the election of president and vice president in the framework of guaranteeing the right to vote in general elections. Related to this, problems arise regarding their implications. What are the implications of either directly or indirectly the decision of the Constitutional Court regarding the use of Identity Cards and Passports in general elections. The Constitutional Court as the executing agency of judicial power whose authority is to examine the Law against the State Constitution of the Republic of Indonesia of 1945 in order to realize a democratic state based on law as stipulated in Article 1 of the Constitution of the Republic of Indonesia of 1945. The result is implications directly consisting of the application of Identity Cards and Passports in lieu of the Permanent Voters List, Raising decisions that are self-executing, overriding Government Regulations Substituting the Law, overriding the decisions and regulations of the General Election Commission regarding new rules due to the Constitutional Court ruling and indirect implications consisting of Reducing the disputes over the results of the Presidential General Election, the Election Commission works extra. The future goal of this research is to know and contribute in the academic world, especially related to guaranteeing human rights, especially the right to vote in the presidential and vice presidential elections. Indonesia’s political system changed  after the amandment of the state’s constitution. As a consequence, significant changes in the system are inevitable, one of which is the paradigm of its governing body. The amended constitution states that all governing bodies are level, not placing its people’s consultative assembly at the highest position of the people sovereignty manifestation at the fullest. The changes in the state’s governing bodie’s position causes transposition of their tasks and authorities. The previous assembly’s authority, bestowed by the constitution, limits itself into not having regular authority except inaugurating selected president and vice president according to the statutes of the General Election Commission once in five years. Nevertheless, a further discussion may lead to a finding that, in practice, the assembly’s authority is substantively fundamental for Indonesia’s political life. It has the right of amending and ordaining the constitution, for example, which is crucial for the politic since 1945 State Constitution of the Republic of Indonesia is the highest of all laws and regulations.
