General Election is a means of implementing the sovereignty of the people in direct, general, free, confidential, honest, and fair manner within the Unitary State of the Republic of Indonesia based on Pancasila and the Constitution of the Republic of Indonesia Year 1945. The election has many dynamics, expensive politics, lavish campaign funds for image politics, costly consulting and surveys of winning money, as well as money politics. The disclosure of political parties is highly important in the implementation of the elections due to the many streams of corruption used in the election. As a result, people do not believe in political parties, or some Indonesians are no longer sympathetic to political parties. The idea of a political party's financial transparency regulation should be carefully examined in the Indonesians’ election codification scheme. In the future, Indonesia must have a transparent and accountable campaign or political funding arrangement, along with strong sanctions and binding on the parties involved. Therefore, the people will restore their trust to the political parties, and assure the political parties to channel their aspirations in the granting of rights in the elections.

The election of regional leaders conducted directly by the community is believed to result in a democratic government. The formed government is expected to be more open, more responsive, and to carry out the aspirations of the people so that it can realize a government that comes from the people, by the people, and for the people. A person can nominate him/herself as a candidate for Regent or Deputy Regent if supported by some residents, by Political Parties or Combined Political Parties. The relatively weak support of the population or political parties or combined political parties has resulted in very few candidates for regent or deputy regent, even only one pair of candidates can occur as in Pati Regency. The study aims to know how the policy in the future (Prospective Model) should be taken so that the single-candidate for Regent or Deputy Regent in a general election does not happen. By using a sociological juridical approach, collecting primary and secondary data, processing and analyzing data, the objective of the study can be reached.The policy that needs to be taken by the government so that in the future there will be no single candidate is by giving obligations to political parties to conduct cadre recruitment to become candidates for regional leaders. Besides, the General Election Commission needs to make a scheme that is easier and more flexible for individual candidates regarding administrative requirements, procedures, and mechanisms for gathering support, and there needs to be a new policy so that the potential for a single-candidate can be eliminated or not occur.

Penyelesaian perkara pada jalur litigasi yang cenderung lambat ditambah dengan penumpukan perkara, didukung dengan banyaknya celah atau kekurangan pada undang-undang partai politik, khususnya terkait penyelesaian perselisihan internal partai. Banyaknya permasalahan tersebut mengharuskan setiap individu yang terlibat untuk mengambil tindakan progresif dengan melampaui peraturan tersebut. Tindakan progresif yang dimaksud salah satunya melalui jalur non-litigasi yakni mediasi. Mediasi dilaksanakan dengan musyawarah mufakat, dengan melibatkan rakyat didalamnya, atau lebih tepatnya tokoh masyarakat yang dirasa netral. Terlepas hal itu merupakan sengketa internal partai, namun rakyatlah yang memiliki andil di dalam setiap roda kehidupan partai politik di dalam sistem demokrasi. Kemudian ada beberapa cara yang bisa ditempuh dalam rangka penyelesaian perselisihan internal partai politik, selain mediasi tadi, ada tiga sistem penunjang untuk mencegah potensi buruk yang ditimbulkan akibat gejolak internal partai. Pertama, melalui mekanisme internal yang menjamin demokratisasi melalui partisipasi anggota partai politik tersebut dalam proses pengambilan keputusan. Kedua, melalui mekanisme transparansi partai melalui rakyat di luar partai yang dapat ikut-serta berpartisipasi dalam penentuan kebijakan yang hendak diperjuangkan melalui dan oleh partai politik. Ketiga, menjamin kebebasan berpikir, berpendapat dan berekspresi, serta kebebasan untuk berkumpul dan berorganisasi secara damai.The settlement of cases in litigation pathways that tend to be slow coupled with the accumulation of cases, supported by the many gaps or shortcomings in the laws of political parties, especially related to the settlement of internal party disputes. The number of these problems requires every individual involved to take progressive action by exceeding these regulations. The progressive actions that are meant by one of them through non-litigation means mediation. Mediation is carried out through consensus deliberations, involving the people in it, or more precisely the community leaders who are perceived as neutral. Apart from that it is an internal party dispute, but it is the people who have a share in every wheel of the life of a political party in a democratic system. Then there are several ways that can be pursued in order to resolve internal political party disputes, in addition to the mediation, there are three support systems to prevent the bad potential arising from internal party turmoil. First, through an internal mechanism that guarantees democratization through the participation of members of the political party in the decision making process. Second, through the mechanism of party transparency through people outside the party who can participate in the determination of policies that are to be fought for through and by political parties. Third, guarantee the freedom of thought, opinion and expression, as well as the freedom to gather and organize peacefully.

Ahead of the 2019 general election which is divided into two stages, namely the Legislative election and the Presidential election. This event is the right moment to find out the political participation of the people at the grass-roots level while at the same time seeing the interaction between the people in the grass-roots and political parties. The interaction that wants to be seen is what forms of political behavior and community participation at the grassroots, as well as how political parties behave in interacting with this community. Then the important point that is also seen is how political parties behave in involving and seeking to raise support from the community. In the end, through this research, it will be known the quality of political participation from the public and electoral political parties in 2019.

ABSTRACT A country that implements the system as mentioned earlier is more towards an authoritarian system of government which aims to dominate and dominate the power of the state towards the people. Democracy cannot survive from such a closed state. In a basic concept of democracy, there is a fundamental principle, namely the principle of sovereignty of the people who run the government.Political communication is one of the many roles played by political parties in various available arrangements. The political party is required to communicate knowledge, issues and political thoughts.Constitutionally, the Government adopts a Presidential System in which the ministers in the cabinet are responsible to the president. Abstract: This article discusses about a Islamic political jurisprudence’s point of view againts campaign for president and vice president election. It is carried out based on Law No. 42 year 2008 concerning with the election of president and vice president. The general election campaign is a sovereign right of the people to produce democratic government based on Pancasila and the Constitution of the Republic of Indonesia (UUD) 1945. The implementation of the general election campaign has a positive effect that is beneficial for the candidates and for the publics to know the candidates they would choose to be a leader. In Islamic political jurisprudence’s perspective, the implementation of the general election campaign for president and vice president can realize the political rights of individuals associated with the right to nominate and the right to occupy a certain post. All of the people and citizens are entitled to gain a guarantee of their human rights (Hurriyah al-shakhsiyyah) before the law and government.Keywords: Campaign, general election, president, Islamic political jurisprudence.

The many threats of radicalization in the middle of society, the demonstration actions that often ask for the application of certain ideologies within the state of Indonesia, the conflict between ethnic, religious, racial and custom makes the tranquility of Bhinneka Tunggal Ika society to be threatened and the erosion of values Pancasila among the younger generation that endanger the survival of the Indonesian nation.The problem of this research is how the Political Law of the State in the concept and context of Pancasila and Diversity in defending the Unitary State of the Republic of Indonesia and How the Strength of the Unitary State of the Republic of Indonesia Based on Pancasila and Unity in Diversity and How Radicalism and Threat Against the Unity of the Unitary Republic State Indonesia.This research uses normative juridical approach method, then data collection procedure is done by literature study, data processing procedure is done by data classification, data inventory, systematization of data, and data analysis is done by qualitative method.The result of the research, the politics of constitutional law in the concept and context of Pancasila and Diversity in defending the Unitary State of the Republic of Indonesia in accordance with the nationalist ideology set forth in the 1945 Constitution, the power of the Unitary State of the Republic of Indonesia based on Pancasila and Diversity is based on the strength of local wisdom from all elements of the nation Indonesia, radicalism and threats to the unity of the Unitary State of the Republic of Indonesia through the strengthening of national insight among the younger generation and the people and leaders of the nation and state apparatus.Suggestion in this research, expected to government can reinforce study of nationality and education of Pancasila and Diversity, to Indonesian society.

Abstract : Nomination of the Candidate Pair of President and Vice President For Participants Election According to the Presidential Election Law. Knowing the legal position of the candidates for President and Vice-President and the Political Parties Elections, namely Knowing setting Political Parties in the nomination of the Candidate Election of President and Vice-President and the timing of the nomination of the candidate of President and Vice President based on legal analysis. It is motivated by the lack of rules regarding the nomination of candidates for President and Vice President of the Law No. 42 Year 2008 on the General Election of President and Vice President, namely in the norm of Article 9 and Article 14 paragraph (2) which do not conform to the norms of Section 22E paragraph (3) and the norm of Article 6A paragraph (2) of the Constitution of the Republic of Indonesia (the 1945 NRI 1945).  Abstrak : Pengusulan Pasangan Calon Presiden dan Wakil Presiden Sebagai Peserta Pemilu Menurut Undang-Undang Pilpres. Mengetahui kedudukan hukum calon Presiden dan Wakil Presiden dan Partai Politik Peserta Pemilu, yakni Mengetahui pengaturan Partai Politik Peserta Pemilu dalam pengusulan Calon Presiden dan Wakil Presiden dan pengaturan waktu pengusulan Calon Presiden dan Wakil Presiden berdasarkan analisa hukum. Abstract: Elections means implementation of the sovereignty of the people held in directly, general, free, confidential, honest, and fair in the Republic of Indonesia under Pancasila and the Constitution of the Republic of Indonesia Year 1945. The implementation of the election has a lot of dynamics, among others political boat fees are expensive, expensive campaign funds to political imagery, the cost of consultations and surveys are expensive as well as winning money politics. Financial disclosure is very important political party in an election, because a lot of the flow of the corruption that is used in the election. As a result, people do not believe in political parties, or some communities in Indonesia began to no longer sympathetic to the political party. The idea of political party financial disclosure regulations should be initiated carefully in Indonesian election codification plan. Forward Indonesia must have arrangements campaign funds or political funds transparent, accountable, and has strict sanctions and binding on the parties involved, so that people come back believing again to political parties, and assured political parties place to channel their aspirations in granting the right in elections  Abtrak: Pemilu adalah sarana pelaksanaan kedaulatan rakyat yang diselenggarakan secara lansung, umum, bebas, rahasia, jujur, dan adil didalam Negara Kesatuan Republik Indonesia berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pelaksanaan pemilu memiliki banyak dinamika, antara lain biaya perahu politik yang mahal, dana kampanye yang mahal untuk politik pencitraan, ongkos konsultasi dan survei pemenangan yang mahal serta politik uang. Keterbukaan keuangan partai politik sangat penting didalam pelaksanaan pemilu, karena banyak aliran hasil korupsi yang dipakai dalam pemilu. Akibatnya masyarakat tidak percaya kepada partai politik, atau sebagaian masyarakat Indonesia mulai tidak lagi simpatik pada partai poltik. Gagasan regulasi keterbukaan keuangan partai politik harus digagas dengan seksama didalam rencana kodifikasi pemilu Indonesia. Kedepan Indonesia harus memiliki pengaturan dana kampanye atau dana politik yang transparan, akuntabel, serta memiliki sanksi yang tegas dan mengikat para pihak yang terlibat, sehingga masyarakat kembali percaya lagi kepada partai politik, dan yakin partai politik tempat menyalurkan aspirasi mereka dalam pemberian hak dalam pemilu. DOI: 10.15408/jch.v4i2.3433

Abstract:The 2019 Presidential General Election is a continuation of the political battle between the two camps, namely the Prabowo camp and the Joko Widodo camp. The two camps have the same strong support, both from the people as voters, as well as the support of political parties participating in the election. After the vote on April 17, 2019, each party claimed to have won the election. Jokowi's camp showed his victory with the results of the Quick Count, while Prabowo's camp showed its victory with the results of their own real count. This debate does not end if the General Election Commission does not immediately announce the results of the general election.Keywords: Presidential Election, Counter Attack, Real Count. Abstrak:Pemilihan Umum Presiden 2019 merupakan kelanjutan pertarungan politik antara dua kubu yaitu kubu Prabowo dan kubu Joko Widodo. Kedua kubu memiliki dukungan yang sama-sama kuat, baik dukungan dari rakyat sebagai pemilik suara, maupun dukungan partai politik peserta pemilu. Pasca pemungutan suara tanggal 17 Agustus, masing-masing pihak mengklaim telah memenangkan pemilu. Kubu Jokowi menunjukkan kemenangannya dengan perolehan hasil dari Quick Count, sedang kubu Prabowo menunjukkan kemenangannya dengan hasil real count yang mereka lakukan sendiri. Perdebatan ini tidak berujung bila Komisi Pemilihan Umum tidak segera mengumumkan hasil pemilihan umum.Kata Kunci: Pemilihan Umum Presiden, Counter  Attack, Real Count.
