This article analyzes the concept of control over the activities of religious organizations. The authors focus on certain provisions of the Federal Law “On Freedom of Conscience and on Religious Associations”, for example, one of which contains the following subject of control — the conformity of the activities of religious associations with their statutory goals.

After part of the territory of Donetsk and Lugansk regions in 2014 came under the control of separatist entities supported by the Russian Federation, the situation with respect for human rights and freedoms, including the right to freedom of conscience, became much more complicated. First of all, it can be noted that the beginning of repressions on a religious basis laid a wide and intensive use of religious rhetoric in mobilizing supporters of “L / DPR”, in connection with which believers of confessions and denominations considered harmful by Orthodox fundamentalists were systematic persecution and spontaneous acts of aggression.

Статья посвящена анализу юридических коллизий норм уголовно-исполнительного законодательства, возникающих при переводе осужденного, отбывающего наказание в виде лишения свободы, из исправительного учреждения в следственный изолятор в новом процессуальном статусе свидетеля или потерпевшего. Учитывая отличия в режиме и условиях содержания в ИУ и СИЗО, авторы поднимают проблемы реализации осужденным частных прав, закрепленных в УИК РФ, в период нахождения в СИЗО, предлагают пути решения. The article is devoted to the analysis of legal conflicts of the norms of the criminal Executive legislation that arise when a convicted person serving a sentence of imprisonment is transferred from a correctional institution to a pre-trial detention center in the new procedural status of a witness or victim. Given the differences in the regime and conditions of detention in a correctional facility and the detention center, the authors raise the problem of implementation of a convicted individual rights enshrined in the Penal Code of the Russian Federation in the period of detention, propose solutions.

Статья посвящена церковному и государственному регулированию правового положения духовных учебных заведений Русской Православной Церкви в Российской Федерации в современный период. Основная цель исследования заключается в анализе правового статуса духовных учебных заведений как религиозных организаций, с одной стороны, и как образовательных организаций, с другой стороны. Первичность правового статуса религиозной организации отличает правовое положение духовных учебных заведений от остальных образовательных организаций. В связи с необходимостью соблюдения положений Конституции России, касающихся свободы совести и вероисповедания, положений Федерального закона «О свободе совести и о религиозных объединениях», а так же норм международного права, государство и Церковь ведут поиск правовых решений во избежание дискриминации христиан в реализации их права на подготовку священнослужителей, церковнослужителей и религиозного персонала согласно внутренним установлениям Русской Православной Церкви. В статье представлены особенности церковного статуса духовных учебных заведений, связанных, прежде всего, с предъявлением требования к студентам и преподавателям высокого уровня христианской нравственности, а также особенности государственного статуса, которые призваны обеспечить, по возможности, все требования церковного статуса духовных учебных заведений. The article is devoted to the Church and state regulation of the legal status of theological educational institutions of the Russian Orthodox Church in the Russian Federation in the modern period. The main purpose of the study is to analyze the legal status of religious educational institutions as religious organizations, on the one hand, and as educational organizations, on the other. The primacy of the legal status of the religious organization distinguishes the legal status of theological educational institutions from other educational organizations. In connection with the need to comply with the provisions of the Constitution of Russia concerning freedom of conscience and religion, the provisions of the Federal Law «On Freedom of Conscience and Religious Associations», as well as the norms of International Law, the state and the Church are looking for legal solutions to avoid discrimination training of clergy and religious personnel in accordance with the internal regulations of the Russian Orthodox Church. The article presents the features of the church status of theological educational institutions, associated, first of all, with the presentation of requirements for students and teachers of a high level of Christian morality, as well as the features of state status, which are designed to ensure, if possible, all the requirements of the church status of theological educational institutions.

Prior to December 2011, instances of widespread collective mobilization were relatively rare in contemporary Russia. Russian citizens are more likely to engage in a different means of airing grievances: making an official complaint to the authorities. This article considers how complaint-making, as a variety of political participation, may contribute either to authoritarian resilience or to political liberalization. The political significance of complaints made to the Commissioner for Human Rights of the Russian Federation is examined. Since it is the broader political context that shapes the significance of complaints, in the absence of meaningful elections individualized appeals to the state are unlikely to promote democratic change, although they may allow for redress of individual rights violations.
