THE CONTROL FOR THE ACTIVITIES OF RELIGIOUS ORGANIZATIONS IN THE RUSSIAN FEDERATION

This article analyzes the concept of control over the activities of religious organizations. The authors focus on certain provisions of the Federal Law “On Freedom of Conscience and on Religious Associations”, for example, one of which contains the following subject of control — the conformity of the activities of religious associations with their statutory goals.

В статье предлагается классификация государственно-конфессиональных отношений исходя из политико-право- вого положения религиозных конфессий. На основе анализа Конституции Российской Федерации автор обосновывает свою по- зицию, что изменения, внесенные в указанный нормативный правовой акт от 1 июля 2020 года, не отменяют светского характера государства, несмотря на признание особого положения некоторых религиозных конфессий в Федеральном законе от 26 сентября 1997 г. №125-ФЗ «О свободе совести и религиозных объединениях». The article proposes a classification of state-confessional relations based on the political and legal status of religious confessions. Based on the analysis of the Constitution of the Russian Federation, the author substantiates his position that the amendments made to the specified normative legal act of July 1, 2020 do not cancel the secular nature of the state, despite the recognition of the special position of some religious confessions in the Federal Law "On Freedom of Conscience and Religious associations "No. 125-ФЗ dated September 26, 1997.

The article is devoted to the philosophical aspects of the discourse on religious security on the territory of the Russian Federation, where religious organizations are recognized as one of the possible threats to modern society. The authors of the article prove that the specificity of threats on the part of religious organizations should be that their motive is to be a doctrine. The article justifies the fact that the commission of unlawful actions by a religious organization is most often justified not by dogma, but by material, secular motives. This leads to the fact that this activity is evaluated in accordance with the degree of harm caused as an extremist one. The novelty of the study is that the authors draw attention to the fact that there are religious associations that are recognized as dangerous, despite the fact that they do not carry out unlawful actions. The degree of danger they represent is determined on the basis of the content of religious texts that are recognized as dangerous if it can be proved that the potential threat contained in them can acquire a real character. The result of the article is the proof that the task of secular religious studies and social philosophy should not be efforts aimed at banning religious organizations that represent not a real threat, but only a potential danger, since the main thing in which these sciences are interested is the development of the theory of social adaptation of religion.

Federal Law No. 292-FZ adopted on July 1, 2021, amended Article 284.1 of the Criminal Code of the Russian Federation. The procedure expanded the term of active complicity in that part of the Criminal Code that is aimed at early prevention of crimes that may affect the constitutional foundations and security of Russian society, e.g. development of destructive tendencies among the population under the influence of foreign organizations. The research objective is was to determine the limits of liability for 1) participation in the activities of a foreign or international organization recognized as "undesirable" on the territory of Russia (Part 1 of Article 284.1 of the Criminal Code of the Russian Federation); 2) complicity by financing such an organization (Part 2); 3) organizing the activities of such an organization on the territory of Russia (Part 3). The authors defined a set of criteria for distinguishing "undesirable" international or foreign religious organizations from those recognized in Russia as extremist. The article introduces the authors’ vision of the three forms of active complicity. The authors explain the technical and legal flaws in Article 284.1 of the Criminal Code of the Russian Federation and propose their own variant.

Статья раскрывает правовые возможности, условия и основания возвращения имущества религиозного назначения религиозным организациям, находящегося в государственной собственности в пространстве юридического законодательства РФ. Наиболее перспективный и быстрый путь получения информации о проблемах в области передачи имущества религиозного назначения - это изучение законодательства Российской Федерации о правовом положении имущества религиозного назначения. А именно Федерального закона от 30.11.2010 № 327¬ФЗ «О передаче религиозным организациям имущества религиозного назначения, находящегося в государственной или муниципальной собственности». Данный закон предоставил особенные права религиозным организациям в сфере имущественных отношений. Практика применения данного Федерального закона накоплена и составляет на сегодняшний день 10 лет. И даже сегодня органы власти сталкиваются с религиозными организациями по многим трудноразрешимым вопросам при реализации предоставленных прав Федеральным законом № 327¬ФЗ от 30.11.2010 «О передаче религиозным организациям имущества религиозного назначения, находящегося в государственной или муниципальной собственности». Анализ данного законопроекта может дать подробную информацию по рассматриваемой теме. Какое имущество относится к имуществу религиозного назначения? Какие основные проблемы в реализации законодательства о передаче религиозным организациям имущества религиозного назначения? Какие основные критерии отказа в передаче религиозной организации имущества в собственность или в безвозмездное пользование? В данной статье будет предпринята попытка ответить на эти и другие вопросы. The article reveals the legal possibilities, conditions and bases for the return of religious property, which isowned by the state and subjected to the jurisdiction of the Russian Federationto religious organizations. The most promising and quick way to get information about the problems of the transfer of religious property is studying the legislation of the Russian Federation concerning the legal status of religious property owned by the state or municipality, specifical ly the Federal law № 327FZ of 30.11.2010 «About thetransfer of state or municipal property for religious purposes to religious organizations». This law grants special rights to religious organi zations in the sphere of property relations. There have been many cases of applying this Federal law, which is currently 10 years old. But until now the state authorities have facedmany difficult is sues with religious organizations, trying to implement the rights granted by Federal law № 327FZ of 30.11.2010 «About the transfer of state or municipal property for religious purposes to reli gious organizations». An analysis of this draft law can provide detailed information about the top ic in question. What property is classified as religious property? What are the main problems im plementing the law of the transfer of religious property to religious organizations? What are the main criteria for refusing such transfer of property for ownership or gratuitous use to a religious organization? This article attempts to answer these and other questions.

The article provides a legal analysis of the activities of religious groups and religious organizations. Activities of religious organizations are regulated by the Federal Law of 1997 which defines religious organizations as associations of citizens of the Russian Federation, other persons permanently and legally residing in the territory of the Russian Federation, formed for joint confession and dissemination of faith and registered as a legal entity recognized in the Russian Federation. Religious groups are voluntary associations of citizens carrying out activities without state legal registration and acquisition of a legal capacity as a legal entity. The authorʼs work is largely based on regional material.

The article is devoted to the study of modern theoretical and legal problems of ensuring biological security in the Arctic zone of the Russian Federation. The published Draft of Federal law No. 850485-7“On biological security of the Russian Federation”provides an opportunity to take a closer look at the problem of legal provision of biological security in relation to the most vulnerable ecosystems, and, first of all, the Arctic. The article considers the most important features and potential risks of the Arctic zone of the Russian Federation of critical importance from the point of view of biological hazards, the features (specificity) of biological safety problems from the point of view of organizational-legal features and, in particular, from the perspective of environmental law. It is proved that, given the special situation of the Arctic zone of the Russian Federation, in addition to the base Federal law“About biological safety” required a specific law on biological and ecological safety of the Arctic zone of the Russian Federation, which should be generated on a slightly different model than the draft Federal law «On biological safety”, to wear the most specific, applied nature.
