The discourse surrounding the theory maqâshid syarî'ah is still worth doing it aims to understand who far Islamic law  is in line  with the  progress of time. Theory maqâshid  syarî‟ah Syathibi globally based on two  things: the problems ta'lil (legal determination based  illat), and  al-mashâlih  wa  al-mafâsid  (benefit  and  damage). Furthermore, he explains how  to determine maqâshid with six ways: goals syari'ah must be  in accordance  with the  Arabic language,  commands  and  prohibitions syarî‟ah understood as ta'līl (have illat) and ḍahiriyah (text what it is), maqâshid al-<br />ashliyah  (origin  destination)  wa  al-maqâshid  al-tabi'iyyah  (destination  followers), sukut al-syâri‟  (silence  syâri‟), al-istiqra'  (theory of induction), looking for clues of the Companions  of the Prophet.  For operating  of ijtihad  al-  maqâshidy,  Syathibi requires four conditions as follows: texts and laws depending on the goal, collecting between  kulliyât  al-'âmmah  and  specific  arguments,  bring  benefit  and prevent damage to the absolute and considering the result of a law.

The topic of metamemory had attracted the attention of many researchers and scholars in the field of educational and cognitive psychology, especially how individuals become aware of and control their memory functions. Therefore, the aim of the present study was to build a psychometric scale/questionnaire for measuring metamemory. The study was conducted among a sample of 200 students joining Sharia/Islamic Law, Arabic Language, Education, English Language, Science, Economics and Management at Al Qassim University. For the purpose of the content validity of the scale, it was verified by the raters’ agreement and the internal consistency of the items of the scale. Pearson correlation coefficient was also used to calculate correlation coefficients between the scores of each item and its dimension to ensure consistency and homogeneity of the items and dimensions of the scale. The correlation coefficients of the items of the scale and the total score of the dimension to which the items belong were all positive correlation coefficients and statistically significant at the level of 0.01, which confirms the consistency and homogeneity of the items of each dimension. The homogeneity of the dimensions of the scale was also verified by calculating Pearson correlation coefficients between the score of each dimension and the overall score of the scale. The reliability of the scale and its sub- dimensions was verified using the α- Cronbach Alpha coefficient. The results showed that the scale and its sub- dimensions had high and statistically acceptable validity and reliability coefficients. Such result indicates that the scale is statistically valid and reliable.

A guarantee of successful life in this world and the hereafter would be achieved if Muslims live according to Islamic principles and teachings. Property and power that are entrusted to men by Allah SWT ought to be judiciously administered based on Islamic precepts. In brief, the administration of Islamic property aims to achieve hasanah (goodness) not only here but also the hereafter. Islam, as a complete way of life, has outlined the absolute guidance on property administration through a systematic law, i.e. the Islamic law of inheritance by means of wasiat (will), hibah (gift inter vivos) and waqf (charity). This article focused on the instrument of hibah under the administration of Islamic property and this includes comparisons of its principles and the reality of its application in Malaysia. Hibah is an element of the distribution of assets as drawn under the Islamic concept of managing property. Its concept, application and implementation need to be intensely understood. It has been occasionally observed that disputes would take place after the demise of the donor (the person who had exercised hibah) which complicates the distribution of the assets. Therefore, if this instrument is exercised differ entry between institutions but effectively and cautiously in line with the Islamic rules and principles, the rights of those entitled would be certainly safeguarded.

In this article, I explore the Arabic concept of jamʿ, and relate it to the Deleuzian concept of assemblage. I argue that jamʿ is central in the formation of Arabic language, Islamic theology, Islamic law, Sufism, a number of modern Islamic discourses, such as wasaṭiyyah, and several social,economic, and political formations in Arab modern states. I will limit my scope in this article to establishing the theoretical foundations of jamʿ and studying its effect on the formation of language. After defining jamʿetymologically, I will present a brief discussion of assemblage, as presented in Deleuze and Guattari, and then will divide the rest of the article into three parts, where I will discuss, first, the concept of naẓm as a type of jamʿ that aims to articulate meaning, second, the effect of jamʿ on the formation of the metaphor, and, third, the theological and philosophical foundations of jamʿ in the Deleuzian understanding of virtuality, and the Bergsonian understanding of time.

The aims of this research are to find out the types of language used and language choice in term of Indonesian-Arabic, language style, and to identify some causal factors of language choice in the discourse of Abu Sulaiman Aman Abdurrahman's dakwah. This research uses Norman Fairclough’s critical discourse analysis model The object of this research is the Indonesia-Arabic contained in the text of his da'wah. The research method is the match method followed by basic and advanced techniques. The basic technique is the basic technique of Determining Elements (PUP). This technique is used to classify Arabic vocabulary as a foreign language in the text. The advanced technique refers the equalizing appeal technique. The result of this research shows that the form of foreign language usage in this text is Arabic. There are three sentence’s pattern in the text, such as: imperative, exclamatory and declarative. The purpose of using imperative sentence pattern is likely to show request, attitude and principle; additionally, the aim of using exclamatory is to express strong emotions. On the other hand, declarative sentence is used to convey information or make statements and ask the audience would like to change the way of thinking from common law to Islamic law. The style of language and the use of sentences in the text of da'wah is oriented to the concept of Islamic shari'ah according to Aman viewpoint. There are several factors that cause language choice, namely: (1) the background of the subject, (2) the background of the place, (3) the need for synonyms, (4)   the speaker's bilingualism.---Penelitian ini bertujuan untuk mendeskripsikan bentuk-bentuk pemakaian bahasa Indonesa-Arab, pola, dan faktor penyebab pemakaian bahasa itu pada wacana dakwah Abu Sulaiman Aman Abdurrahman. Objek penelitian ini adalah bahasa Indonesia-Arab yang terdapat pada naskah dakwahnya. Metode penelitian yang digunakan adalah metode padan dengan diikuti teknik dasar dan lanjutan. Teknik dasar yang digunakan adalah teknik dasar Pilah Unsur Penentu. Teknik ini digunakan untuk mengklasifikasikan kosakata bahasa Arab sebagai bahasa asing pada naskah dakwah tersebut. Teknik lanjutan yang digunakan adalah teknik hubung banding menyamakan. Hasil penelitian ini menemukan bahwa bentuk pemakaian bahasa asing yang terdapat pada isi dakwah ini adalah bahasa Arab. Bahasa Arab digunakan untuk menyatakan konsep hukum Islam. Pola pemakaian kalimat yaitu kalimat ajakan, seruan dan pernyataan. Pola ajakan digunakan untuk menunjukkan sikap dan pendiriannya, kalimat seruan digunakan agar khalayak mau melakukan apa yang diserukan, selanjutnya, kalimat pernyataan dipakai untuk merubah cara berpikir dari hukum umum ke hukum Islam. Pemakaian pola kalimat dan gaya  bahasa  pada naskah dakwah itu berorientasi pada konsep syari’at Islam menurut cara pandang Aman. Selain itu, ada beberapa faktor yang menyebabkan pemilihan bahasa yang dilakukan oleh Aman antara lain, (1) latar belakang pokok bahasan, (2) latar belakang tempat, (3) kebutuhan sinonim, (4) adanya kedwibahasaan penutur. ABSTRACT\         Since Sharia Banking Law issued, Sharia bank is blooming and gaining the trust of people in Indonesia. This is showed by the increase of the number of the established Sharia bank in Indonesia. However, in their practice, these Sharia banks are not in accordance with Islamic law. They plagiarize usury principles from conventional bank and just translate it to Arabic language e.g. Sharia savings and Akad Wadiah.In principle, the foundation of this product is correct according to Fiqh due to its Wadiah base. However, in their implementation, Sharia bank may applies Wadiah Yad Dhamanah principle; whereas, Akad Wadiah Yad Dhamanah by name can’t be found in the classical Fiqh literature, and if this principle is further analyzed, two contradicting Akads which are forcibly combined will be found, i.e. Akad Wadiah and Akad Qard.This research is field research, where the researcher involved directly in the field or research object i.e. Bank Syariah Mandiri, Lamongan branch. The data is collected by observing and interviewing the management and the employee of Bank Syariah Mandiri, Lamongan branch, thus the collected data is the core of the research object which then analyzed using Qualitative Research method. The result shows that the application of Akad Wadiah in Bank Syariah Mandiri, Lamongan branch is using Wadiah Yad Dhamanah principle, which is not in accordance with the Sharia Economic Law. Keywords: implementation, Wadiah, Sharia Economic Law.

Language and law seem to have either distant or no connection at all. However, in reality these two disciplines are closely interconnected and interrelated, particularly in the perspectives of Islamic legal theory. One’s language competence is among the determining factors in comprehending Islamic law. This is because in Islamic legal theory, law is derived from the tenets enshrined in the Qur’an and the Prophetic traditions that require a high standard of Arabic language science. Thus, it can be concluded that language and law are inseparable. Unfortunately, many students majoring Islamic law still have minor knowledge as well as awareness of the connection between these two disciplines. Regarding this case in hand, the aims of this study are two fold; first, to find out students’ awareness of the role of language competence in Islamic legal theory, and second, to investigate the correlation between the awareness with students’ competence in Islamic legal theory. This study conducted at the postgraduate program, UIN SU employed a qualitative approach. The data were collected by using questionnaire and in-depth interview. The findings reveal that students’ awareness of the significance of language competence is still relatively low. Furthermore, it is also found that the awareness is positively correlated with their competence in Islamic legal theory.
