The legal status of emigrants from Russia in the first years after the October Revolution of 1917 (on the example of North Caucasians)

Emigration has been known to mankind for more than a century. We name the factors contributing to emigration, give examples from the history of emigration both abroad and Russia. We emphasize that at the present time, Russian citizens emigrate to other countries, using the right to freely leave the state, and can also have dual citizenship under Russian law, or renounce citizenship, and then get it again. We pay special attention to the settlement of the territory of North Caucasus, which began in the 8th – 7th – 6th – 5th thousand BC. We analyze the features of emigration of people from North Caucasus after the October Revolution of 1917. The specifics of the emigration of people from this region of country are emphasized. Thus, the majority of people emigrated to the Ottoman Empire, and then moved to Europe. We indicate that in fact, after the adoption of the Decrees of the Central Executive Committee, the SNK of RSFSR in 1921, “On the deprivation of the rights of citizenship of certain categories of persons who are abroad” many emigrants from Russia, including North Caucasians, have become disenfranchised. This circumstance greatly influenced the publication of the Nansen passport (it was introduced in 1922 and became widespread in 1924), according to which emigrants were granted a number of legal and social rights. In addition, it is applicable to emigrants from Russia, including from the North Caucasus, in 1922 and 1926. The Geneva definition of “Russian refugee” was given, and the International Convention on the International Status of Refugees of 1933 created an alternative to naturalization for refugees from Russia. Subsequently, before the outbreak of the Second World War, people received, as a rule, the citizenship of the countries in which they began to live.

The article is a introduction to the publication of the minutes of the meetings of the Russian lodge "Northern Star" in Paris, concerning the discussion on the admission of women to freemasonry. The proposed archival materials, deposited in the National Library of France in Paris, date back to 1945 and 1948. The women's issue became more relevant after the Second World War due to the fact that Masonic lodges had to recover and recruit new adherents. The article offers a brief overview of the women's issue in the history of Freemasonry in general, and in the Russian emigrant environment in particular. One of the founders of the North Star lodge, M. Osorgin, spoke out in the 1930s against the admission of women. In the discussions of the 1940s, the Masonic brothers repeat his opinion almost literally. Women's participation in Freemasonry is rejected using either gender or social arguments. Russian Freemasons mostly cite gender reasons: women have no place in Freemasonry because they are not men. Freemasonry, according to Osorgin, is a cult of the male creative principle, which is not peculiar to women. Discussions about the women's issue among Russian emigrant Freemasons are also an important source for studying their literary work; in particular, the post-war literary works of Gaito Gazdanov are closely connected with the Masonic ideology.

Forming and encouraging families in Jamaica was a struggle from the very beginning of English colonization there, making Caribbean households transatlantic in nature. The explosion of plantation slavery in the 17th century prioritized economic expansion over white family cultivation. Likewise, planters were more concerned with profits than they were with enslaved families. Constant migration from Europe and Africa was therefore needed to keep populations stable for the whole history of slavery in Jamaica. The island’s demographic and political security was always tenuous as a result of this, and officials attempted numerous strategies to encourage family growth, among both the free and enslaved communities. As the island transitioned to freedom, regulating the definition of “proper” families became a weapon from which English authorities wielded imperial power. Racist sentimental toward Caribbean households created social tension when thousands of black Jamaicans emigrated to Britain after the Second World War. Their arrival produced new British households that challenged some British conceptions of domestic family life. Throughout this whole history, migration defined the growth and character of families in the Jamaican-British Atlantic World.

The term “migration background” is commonly used in Germany today, but this neologism is only 20 years old. As an official category, it is even much younger. There has been only little research concerning the new population category, which emerged around the turn of the millennium. Thus, the question how the “migration background” could become the central category describing migration related diversity in Germany is not answered yet. This article fills this gap by exploring the context of the emergence of the “migration background” including the history of ethnic categories in German official statistics. It describes the actual definition of a “migration background” which became an official category in 2007 when the German Federal Statistical Office started publishing data regarding “the population with a migration background” based on the microcensus, a 1% household survey with mandatory participation. The central questions are: how national membership is imagined, how is it inscribed in definitions, and what adaptions had to be made over time? To answer these questions, different sources as questionnaires, publications of results of the microcensus and national reports on children and youth are analysed. Using interpretative methods, it is shown how a new taxonomy of the population in Germany was created, how it was influenced by international and national educational research, and to which extent it reshaped the perspectives on newcomers and natives. It is shown that the new category is tightly bound to citizenship and summarizes a number of older ethnic categories, but excludes also immigrated Germans who immigrated shortly after Second World War and from the former German Democratic Republic. Therefore, the label “migration background” is misleading because inherited citizenship and ancestry is in the centre of the definition rather than migration experience.

In the Act of 8 July 2005 on the Exercise of the Right to Compensation for Real Property Left Beyond the Present Borders of the Republic of Poland, there is no clear definition of the date that should be taken into account for the purpose of determining whether one meets the premise of being the holder of the ownership title to the left real property. Moreover, judicial practice also lacks a uniform answer to the question whether such owner of the real property left beyond the borders should provide the proof of title to that property as at the date of the outbreak of the Second World War, i.e. on 1 September 1939, or as at the exact date of departing from that territory. In the commented judgement, the court found that persons who were not the holders of the ownership title to the property as at 1 September 1939, but who later became property owners and, at the same time, met the other statutory conditions, are entitled to the Bug River compensation.

This chapter provides a critical rereading of the history of self-determination by revisiting the Soviet Union’s contribution to its evolution from a political principle to an international legal right. It argues that the history of the right to self-determination as a concept of international law starts with the Russian Revolution and not with Wilson’s famous Fourteen Points. Moreover, it highlights that the Soviet Union was the decisive force behind the codification of the right to self-determination in international legal instruments following the Second World War, while at the same time it modified or even perverted its meaning and content in its sphere of influence, most notoriously through the later so-called Brezhnev Doctrine. A discussion on how self-determination was theorized and debated in Soviet international law scholarship up until the collapse of the Soviet Union completes the picture.

This article focuses on a completely back lashed Germany after the Second World War. More people died in the Second World War than in any other conflict before or since. Particularly between the Elbe and the Volga, the Nazi war of extermination left a wasteland of death. This article traces the gradual transformations that came over Germany post 1945. After the ‘unconditional surrender’ of 8 May, 1945 — the formulation was initially coined for the defeated Southern states in the American Civil War — German territories came under the control of the four Allied Powers, creating an ambiguous legal status unprecedented in the history of modern international law. Divided into four major territories, each under the control of the allied forces, Germany was no longer a sovereign state. This article further traces the effects of the post-war era followed by the gradual embracing of democracy. The Cold War and the final descending of peace in the German territory winds up this article.

AbstractDrawing on new archival findings, this article argues that shortly after the outbreak of the Second World War, Vladimir Jabotinsky, founder and leader of the right-wing Revisionist Zionist movement, had begun to advocate for the transfer of the Arab population from Palestine – an aspect of his thought previously unknown. Jabotinsky's support for population transfers runs counter to his lifelong political thought. Prior to the war, Jabotinsky was a staunch advocate of minority rights for Jews in Europe and for extensive autonomy for the Arab population in Palestine. This article argues that Jabotinsky's shift was a product of the war. Jabotinsky believed that millions of Jewish refugees would be prevented from returning to their pre-war homes in eastern Europe and would immigrateen masseto Palestine; to resettle these refugees, the Arab population, he argued, ‘would have to make room’. Attentively following debates on population transfers in Europe, Jabotinsky concluded that the era of minority rights had come to an end and envisioned an increasingly ethno-national Jewish state. By highlighting the eastern Europe context in Jabotinsky's thought, this article emphasizes the importance of studying the history of Zionism alongside the transformation of the nation-state in eastern Europe in the 1940s.

This article examines the history of the commercial street photographer, or photofilmeur, in France from 1945 to 1955. Although itinerant photographers had long operated, they organized as a new profession after the Second World War in response to hostile reactions from other ‘sedentary’ photographers, conservative officials, lawmakers, and the police. Tracing the fight to regulate and even ban photofilmeurs in state and police archives, courtroom accounts, and union publications, this article reveals a struggle over the who, what, and where of photography: Who has the right to photograph whom? Can you take pictures of people without their consent? What is professional photography? Answers to these questions recast the history of street photography not as an aesthetic category, as most scholarship treats it, but in terms of the medium’s engagement with the law and issues of consent, intent, copyright, privacy, and dissemination that are at the heart of 20th and 21st-century photographic history.

The history of southeastern Poland is inseparably linked with the Jewish community that settled mostly in larger cities located near significant trade routes. Despite limiting privileges, in many cities Jews managed to establish their own quarters, in which synagogues were the most important structures. Only a few cases of historical Jewish religious architecture, in varying states of preservation, have survived to the present. In Przeworsk, to the north of the town hall, an impressive, masonry Jewish synagogue had stood for several centuries. The building was erected at the start of the seventeenth century and up to the Second World War constituted a significant element of the city’s spatial structure. Despite the passage of over eighty years since the demolition of the synagogue, its site has not been commemorated. This paper presents the genesis and architecture of the historical synagogue. The massing of the building, its functional and spatial layout, and its interior décor were investigated. The paper also discusses the commemoration of historical buildings, pointing to the significance of place-based identity and broadly understood cultural heritage.

Immediately after the Second World War Sweden was struck by a wave of sightings of strange flying objects. In some cases these mass sightings resulted in panic, particularly after authorities failed to identify them. Decades later, these phenomena were interpreted by two members of the Swedish UFO movement, Erland Sandqvist and Gösta Rehn, as alien spaceships, or UFOs. Rehn argued that ‘[t]here is nothing so dramatic in the Swedish history of UFOs as this invasion of alien fly-things’ (Rehn 1969: 50). In this article the interpretation of such sightings proposed by these authors, namely that we are visited by extraterrestrials from outer space, is approached from the perspective of myth theory. According to this mythical theme, not only are we are not alone in the universe, but also the history of humankind has been shaped by encounters with more highly-evolved alien beings. In their modern day form, these kinds of ideas about aliens and UFOs originated in the United States. The reasoning of Sandqvist and Rehn exemplifies the localization process that took place as members of the Swedish UFO movement began to produce their own narratives about aliens and UFOs. The question I will address is: in what ways do these stories change in new contexts? Texts produced by the Swedish UFO movement are analyzed as a case study of this process.
