Resumen: Este trabajo realiza un análisis crítico de la jurisprudencia del Tribunal de Justicia respecto del Derecho internacional. Para ello, analiza los acuerdos internacionales y otras fuentes afines, la problemática derivada de los acuerdos firmados por los Estados miembros con terceros Estados, la relación entre el Derecho de la UE y el Convenio Europeo de Derechos Humanos y, finalmente, el valor que el Tribunal confiere al Derecho internacional general y a la Carta de Naciones Unidas. La conclusión fundamental será que el principio básico que guía la jurisprudencia del TJ es la reivindicación y protección de su propia autonomía.Palabras clave: monismo, dualismo, pluralismo, autonomía, acuerdos mixtos, Dictamen 2/13, Dictamen 2/15.Abstract: This paper critically analyzes the jurisprudence of the Court of Justice of the European Union on International law. To that end, it analyzes international agreements and other related sources, the problems arising from agreements signed by Member States with third States, the relationship between EU law and the European Convention on Human Rights, and finally the value that the Court confers on general international law and the Charter of the United Nations. The fundamental conclusion will be that the basic principle guiding the jurisprudence of the CJEU is the claim and protection of its own autonomy.Keywords: monism, dualism, pluralism, autonomy, mixed agreements, Opinion 2/13, Opinion 2/15.

Resumo: O presente trabalho busca analisar a relação entre direito comunitário e o direito internacional a partir da integração regional ocorrida na União Europeia. Busca-se analisar a viabilidade da adesão da União Europeia à Convenção Europeia de Direitos Humanos (CEDH), levando-se em conta, principalmente, a atuação do Tribunal de Justiça da União Europeia (TJUE) e a reformulação ocorrida no bloco com o Tratado de Lisboa (2009). Palavras-chave: Direito Comunitário; Direito Internacional; União Europeia; Adesão à CEDH. Abstract: This study aims to analyze the relationship between European Union law and international law from the regional integration occurred in Europe. The paper presents some of the most relevant aspects of European nondiscrimination law established th rough European Union law and the European Convention on Human Rights, looking also at the evolution of the norms and milestones of case-law on equal treatment within the two systems. The paper gives an overview of the non-discrimination concept as interpreted by the Court of Justice of the European Union and by the European Court of Human Rights. We examine the similar elements but also give insight into conceptual differences between the two human rights regimes when dealing with equal treatment. The differences mainly stem from the more complex approach taken by EU law although, based on analysed norms, cases, and provisions, the aspects of equal treatment in EU law are largely consistent with the practice of the ECtHR. Lastly, the paper briefl y places the European non-discrimination law within the multi-layered human rights system, giving some food for thought for the future potential this concept brings.

Whatever terminology one might wish to employ to describe the form of integration constituted by the European Union and its Member States, one fundamental attribute of that arrangement has always been the division, as between the Union and its Member States, of competence to conclude international agreements with other subjects of international law. Today, the fact that treaty-making competence—as an external facet of the more general division of legal authority—is divided and, to some extent, shared between the Union and its Member States is reflected by some of the opening provisions of the Treaty on European Union and the Treaty on the Functioning of the European Union. This chapter examines how the European Union acquired distinctive constitution-like features. It begins with a discussion of three routes to constitutionalization: the first is through changes in the EU's primary law; the second focuses on ‘in between’ constitutionalization; and the third leads directly to the European Court of Justice and its jurisprudence. The chapter proceeds by discussing two developments that have shaped the EU constitutional order almost since the beginning: the emergence of a body of EU law constituting a set of higher-order legal rules, and the consolidation of the constitutional principle of representative democracy. It explains how the supremacy and direct effect of EU law, as well as the EU court's concern with the protection of fundamental rights, helped transform the EU into a constitutional polity. It also considers how the extension of the legislative, budgetary, and other powers of the European Parliament animated the constitutional principle.

The European Union (eu) accession to the Convention for the Protection of Human Rights and Fundamental Freedoms (echr) has been a hot topic in the European legal discourse in this decade. Ruling on the compliance of the Draft Agreement on eu accession to the echr with the eu Treaties, the Court of Justice of the eu (cjeu) came up with a rather controversial Opinion. It ruled that the Draft Agreement is incompliant with the eu Treaties in several respects. One of the core concerns in Opinion 2/13 relates to the management of horizontal relationship between the eu Charter of Fundamental Rights (ChFR) and echr, namely Article 53 ChFR and Article 53 echr. The article examines the Opinion 2/13’s specific concerns on the relationship between Article 53 ChFR and Article 53 echr from a post-accession perspective. It starts by considering the question of the two 53s’ relationship from the eu-law autonomy viewpoint, indicating the main gaps that may present a danger to the latter. While questioning from a number of perspectives the plausibility of the cjeu’s arguments in relation to the two 53s, the article argues that the Court was both controversial and argued against itself when it drew harshly upon these concerns. The article also presents three options to address the cjeu’s requirements on this issue. The article concludes that the cjeu’s statements on the two 53s will seriously hurt the accession project, while critically limiting the possibility of Member States to provide broader protection.

Chapter 4 turns to the domestic law of the countries of Europe, arguing that the combination within European public law of EU law, the law of the ECHR, and of domestic law cannot be conceived of along the lines of a pyramidal hierarchy. The chapter examines the ways in which the different European domestic legal systems conceive of the relationship between international law and domestic law. The chapter then looks at the relationship between international law and domestic law through a constitutional lens, an approach which more and more domestic courts in Europe seem to be adopting. The chapter then turns to the integrated legal order of the European Union, a legal order distinct both from domestic and general international law. Finally, the chapter teases out and analyses four shared guiding principles of European public law: equality and non-discrimination; proportionality; subsidiarity; and legal certainty.

This chapter explores the impact on Austrian administrative law of the pan-European general principles of good administration developed within the framework of the Council of Europe (CoE). It reveals that the standards of individual protection stemming from the European Convention on Human Rights have greatly influenced the system of administrative justice in Austria. The impact of other CoE sources, especially various recommendations on administrative law, remains rather limited due to their high tension with the (constitutional) principle of legality. The chapter concludes that a widening gap in the relationship between the CoE and Austria can be discerned, partially because of the changing priorities of the latter and the ever-growing influence of the European Union.

This chapter examines the relationship between the Court of Justice (CJ) and the national courts in the context of the preliminary ruling procedure provided by Article 267 of the Treaty on the Functioning of the European Union (TFEU). The chapter focuses on the text of Article 267 TFEU. It analyses the extent to which national courts are willing and able to gain access to the CJ in order to resolve the questions of European Union (EU) law before them. The chapter also explains the concept of acte clair. The analysis reveals that the CJ has rarely refused its jurisdiction and has interpreted broadly the term ‘court or tribunal’. The CJ has also rarely attempted to interfere with national courts’ discretion in matters of referral and application of EU law, while national courts have generally been ready to refer cases to the CJ.

Article 3(5) of the Treaty on the European Union concerns EU external relations and was a new provision of the Lisbon Treaty. It has been seized upon by scholars for its reference to ‘strict observance of international law’ by the EU in its relations with the wider world. However, recent case law in the Court of Justice of the European Union has demonstrated little movement towards this supposed ideal. This article supports the fact that rigid and unquestioning adherence to international law has not emerged in case law, particularly as Article 3(5) TEU also mandates that the Union ‘uphold and promote its values and interests’. By taking a broader view of both the text and context of Article 3(5) TEU in EU law as a whole, and through consideration of the limited demands international law places on domestic courts, the article argues that – contrary to current literature – a more expressly balanced approach towards respect for international law is required and should be nurtured in the case law.
