Integrating the implementation of the European Union Water Framework Directive and Floods Directive in Ireland

Water Framework Directive (WFD) statutory authorities and stakeholders in Ireland are now challenged with the issue of how the proposed programmes of measures in the newly required River Basin Management Plans – designed to protect and restore good ecology by reverting as closely as possible back to natural conditions – are to be implemented in a way that concurrently complies with other existing and emerging intersecting European Union legislation, such as the Floods Directive (FD). The WFD is driven largely by ecological considerations, whereas the FD and other legislation are more geared towards protecting physical property and mitigating public safety risks. Thus many of the same waterbodies, especially heavily modified waterbodies, arguably have somewhat competing policy objectives put upon them. This paper explores the means by which Ireland might best achieve the highest degrees of cost effectiveness, economic efficiency and institutional durability in pursuing the common and overarching objective of the WFD and FD – to ensure Irish waterways are put to their highest valued uses.

The Water Framework Directive (WFD) encourages active involvement during its implementation, although no specific participatory methods are suggested, whilst implementing the target-oriented Directive will require detailed agri-environmental data at catchment and farm level. The paper is a case study of the Danish AGWAplan project, which actively involved farmers in the selection of measures to reduce diffuse nutrient pollution at farm and catchment level, thereby providing an example of how active involvement might be operationalised. Active involvement has been identified as being of central importance to the success of the WFD. The project also entailed the accumulation of extensive agri-environmental data. The aim of the paper is to evaluate AGWAplan to establish the extent to which its expected objectives have been achieved and how, and to determine whether the project approach might facilitate WFD goals if implemented in forthcoming river basin management plans (RBMPs). AGWAplan resulted in advantageous outcomes, including win–win solutions to reduce nutrient leaching and greater acceptance of policy, although the original reduction targets where not fully reached. The paper concludes that actively involving farmers in a similar manner in RBMPs may make an important contribution to the implementation of the WFD, although caveats regarding its potential for transfer to other areas are identified.

As a result of the research, the priority tasks of water policy regarding the formation of integrated water resources management system are grounded taking into account the eurointegration vector of Ukraineʼs development. The necessity of the development of water management forecasts and scenarios for the purpose of creating an information base for choosing the optimal variant for the formation of the concept of concrete actions of water resources management of the river basin has been proved. The theoretical and methodological approaches to the development of river basin management plans in the implementation of the basic provisions of the European Union water directives in the national legislation are proposed. The main mechanisms for implementation of river basin management plans are defined and classified.

PurposeThe purpose of this paper is to examine the European Union (EU) Water Framework Directive. It seeks first to determine whether its provisions align with modern thinking on integrated river basin management and second to assess the degree to which it has the potential to achieve legislative and inter‐agency integration throughout the Union.Design/methodology/approachThis is a desktop study. The paper draws upon theories and definitions of integrated river basin management and internal integration in existing literature and then proceeds to examine the provisions of the Water Framework Directive in the light of the models identified.FindingsThe framework for river basin management in the Water Framework Directive does not fully match the modern approach to integrated river basin management. The directive is limited by its primary focus upon the single medium of water, and its consequent failure to fully address wider land use planning issues. It, therefore, also fails to achieve integration between all relevant legislative instruments. It provides a framework for stakeholder involvement that could potentially serve the goal of inter‐agency integration. However, due to the high level of discretion in the hands of member states, there is likely to be a substantial divergence of practice across the EU.Originality/valueIn assessing the Water Framework Directive against modern notions of river basin management and the directive's stated integrative aspirations, the paper informs implementation and practice in member states.

The EU Water Framework Directive (WFD) adopted an integrated approach for the management and governance of European rivers, which led Spain and Portugal to carry out coordinated hydrological planning of the international basins, considering them as unique realities from ecological, hydrological and hydrogeological perspectives. In spite of this ecosystemic basis, the Directive allowed river basin management plans (RBMPs) to cover those parts of the international river basin districts located within the territory of each member state if joint planning was not possible. Moreover, under the requirements of the Strategic Environmental Assessment Directive (SEA Directive), both countries are obliged to submit the RBMPs for SEA and to consult the authorities and the public in other states if a plan could affect the environment in a neighbouring state. In the case of the hydrological planning of the Miño river basin and its coastal and estuarine waters, the SEA was conducted through a split SEA at the level of national sub-basins. The present study analyses the findings of the two SEA procedures on the Miño river during the recent hydrological cycle under the requirements of WFD and SEA Directive. Thus, from an integrated approach adopted by WFD that demands interdependence and interrelationship between both assessments, the reality of two separated assessments revealed disconnections concerning the methodologies used, asymmetries in the detection of cross-border effects and an uneven national and transboundary participation. Overcoming these deficiencies and improving efficiency is a challenge for the new hydrological cycle. An elaboration of joint SEA between co-riparian states that could help respond to the European Union (EU) expectations from an integrated approach is recommended.

Deficit analysis—which principally deals with the question “how big are the gaps between current water status and good ecological status?”—has become an essential element of the river basin management plans prescribed by the European Water Framework Directive (WFD). In a research project on behalf of the Ministry of Energy, Agriculture, the Environment, Nature and Digitalization Schleswig-Holstein (MELUND), a deficit analysis based on distributed results from the water balance and phosphorus emission model system GROWA-MEPhos at high spatial resolution was performed. The aim was, inter alia, to identify absolute and relative required reduction in total phosphorus at any river segment or lake within the state territory as well as to highlight significant emission sources. The results of the deficit analysis were successfully validated and show an exceedance of the phosphorus target concentrations in 60% of the analyzed subcatchments. Statewide, 269 tons of phosphorus needs to be reduced yearly, which corresponds to approximately 31% of the total emission. Detailed data as well as maps generated by the deficit analysis benefit the planning and implementation of regionally efficient measures, which are indispensable with regard to meeting the environmental quality objectives set by the WFD.

In contrast to the hydrological and hydrochemical zoning, hydrographic and water management zoning of Ukraine (2016) was created on a basin basis, taking into account the boundaries of river basins, and not physiographic zoning. The main function of hydrographic and water management zoning is water management. Primary is hydrographic zoning, and water management - based on it. The description of modern hydrographic zoning of the territory of Ukraine, approved in 2016 by the Verkhovna Rada of Ukraine and included in the Water Code of Ukraine is given. Hydrographic zoning is carried out for the development and implementation of river basin management plans. On the territory of Ukraine nine areas of river basins are allocated: Dnipro; Dnister; Danube; Southern Bug; Don; Vistula; rivers of the Crimea; rivers of the Black Sea coast; rivers of the Azov Sea coast 13 sub-basins are allocated in four river basins district. The water management zoning is described - the division of hydrographic units into water management areas, which is carried out for the development of water management balances. In the regions of the river basins in the territory of Ukraine allocated 132 water management areas, 59 of which are located in the Dnipro basin. About 9,000 bodies of surface water allocated for monitoring in Ukraine. Approved zoning is the implementation of the provisions of the EU Water Framework Directive 2000/60 / EC in the management of water resources in Ukraine. Modern hydrographic and water management zoning of the territory of Ukraine approximates the management of water resources of the state to European requirements.
