The criminal justice system of children is very important in the effort to settle cases. Children are gifts of God that are entrusted to be cared for, guarded, and guided for a good future. In article 1 number 1 of Law no. 11 of 2012 states that what is meant by the juvenile justice system is the whole process of resolving cases of children dealing with the law from the investigation stage to the guidance stage after undergoing the crime. The aims of the study were to find out and analyze the juvenile justice system (SPPA) in conflict with the law and to examine the implementation of legal protection against children in conflict with the law based on Law Number 11 of 2012. The research method used to see the arrangement of this arrangement is juridical-normative legal research, this research is research that is attempted with the system reviewing applicable laws and regulations or applied to a particular legal case and concept. The method of collecting legal material with the document method is to collect library research contained in secondary legal materials, then analyzed deductively. The results of this study are to look at the process of the juvenile justice system based on subsystems, components, the process of achieving justice for restorative justice and the process of implementing child protection based on the applicable laws and regulations.

Pelaku tindak pidana tidak hanya dilakukan oleh orang dewasa, melainkan anak-anak juga dapat melakukan tindak pidana. Mengenai pengertian anak-anak yang melakukan tindak pidana atau yang berkonflik dengan hukum diatur dalam Undang-Undang Nomor 11Tahun 2012 tentang Sistem Peradilan Pidana Anak. Dalam UU No 11 Tahun 2012, anak yang divonis bersalah dalam sistem peradilan anak mendapatkan pembinaan di LPKA. Salah satu pembinaan yang penting bagi anak sebagai bekal hidup ketika kelak kembalike masyarakat maka anak didik    penting mendapatkan pendidikan kewirausahaan melalui program pembinaan di LPKA.Kata Kunci: Pendidikan Kewirausahaan, Anak Didik, LPKACriminals are not only committed by adults, but children can also commit criminal acts. Regarding the understanding of children who commit criminal acts or who are in conflict with the law regulated in Law No. 11 of 2012 concerning the Children's Criminal Justice System. In Law No. 11 of 2012, children convicted in the juvenile justice system get coaching at LPKA. The government has long been giving protection to children. Protection is reflected in the issuance of various Law. One of them is the Law No. 23 of 2003 on Child Protection. The legal protection of children in conflicted with law and child as victims of crime are regulatedin articlenumber 64. Issuance of Law No. 3 of 1997 on Juvenile Court actually originates from a passion for protecting the rights of children in conflicted with the law. However, due to inadequate understanding and mindset of Juvenile Court, which is do not have the children’s perspective, what comes up is that the substance of Law on Juvenile Court is not to protect children but to prosecute children. However, after the release of Law No. 11 of 2012 onThe Criminal Justice System of Children, legal protection of children in conflict with the law was encouragingly reformed. Children are a trust and gift from God who has dignity and dignity as a whole human being. In order to safeguard his dignity, the child is entitled to special protection, especially legal protection in the justice system. In realizing the maximum child protection, requires a policy that supports the realization of maximum protection, with the issuance of Law Number 11 Year 2012, concerning the Juvenile Justice System. This is done because Indonesia as a State Party in the Convection of children's rights governing the principle of legal protection against children have an obligation to provide special protection for children in conflict with the law. In Article 7 Paragraphs 1 and 2 of the Law on the Juvenile Justice System, article 7 (1) At the level of investigation, prosecution and examination of cases of children in the district court must be endeavored Diversion, (2) Diversion as meant in paragraph (1) is carried out in the case of acts crimes committed: (a) are threatened with imprisonment of less than 7 (seven) years and (b) do not constitute repeat offenses. This study intended to examine and analyze the form of legal construction of the Juvenile Justice System specifically implementing diversion for victims with demands of less than 7 years. The research method uses a statutory approach, a case approach, and a comparative approach to the number of cases by reviewing and analyzing legislation, journals, cases, data and direct interviews. According to the results of the study, it is found that the implementation of legal penal system of the Juvenile Justice System (1) child cases is increasing, (2) diversion is carried out since the investigation up to the court, and there are still many that are done at a higher level, (3) have an understanding, that diversion must be sought, has a meaning that can be done at various levels so that diversion occurs at several levels, and often occurs at the Court level.

Third Amendment to Article 1 Paragraph (3) confirms that "The State of Indonesia is a State of Law". Indonesia the rule of law originating from Pancasila and 1945 Constitution as stipulated in the People's Consultative Assembly of the Republic of Indonesia Number III / MPR / 2000 Concerning Legal Sources and Order of Laws and Regulations. The basic rights stipulated in the constitution have then been regulated in several legislative regulations, for example Law Number 11 Year 2012 concerning the Juvenile Justice System in Consideration letter a reads "that the child is the trust and gift of God Almighty who has dignity and dignity as complete be a human". The letter b stated that "in order to maintain their dignity and status, children are entitled to special protection, especially legal protection in the justice system. Problem Formulation of How the Legal Arrangement of the Criminal Justice System for Children in Indonesia, How to Legal Instruments for the Protection of Children in Criminal Law. Fulfillment of the Rights of Children in conflict with the law should have been guaranteed since the child began to be determined as a suspect until the child began to carry out punishment/ guidance in Special Child Development Institute. .Recommendation of our Criminal System which is oriented towards coaching according to the purpose of punishment (objective theory) wherever possible provides education to children so that it is truly changing and aware. The Criminal Justice System for Children needs to be reconstructed specifically regarding the pattern of providing legal assistance, financing and special space for children in each prison, remand center in Indonesia. Child protection legal instruments in criminal law need to be updated, especially law enforcement with a miserable approach for children, so restorative justice needs to be grounded.  Keywords:

Ide Diversi pada awalnya dicanangkan dalam United Nation Standard Minimum Rules for the Administration of Juvenile Justice atau dikenal dengan The Beijing Rules. Diversi merupakan pemberian kewenangan kepada aparat penegak hukum untuk mengambil tindakan atau kebijaksanaan dalam menangani atau menyelesaikan masalah pelanggar anak dengan tidak mengambil jalan formal, misalnya dengan menghentikan atau tidak meneruskan/melepaskan dari proses peradilan pidana. Dengan diundangkan Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak pada tanggal 30 Juli 2012, dan mulai berlaku 2 tahun kemudian, maka Indonesia secara sah sudah memiliki suatu peraturan yang memberikan perlindungan hukum terhadap anak yang berhadapan dengan hukum dengan salah satu metodenya adalah Diversi. Selanjutnya sebagai Peraturan Pelaksana dikeluarkannya Perma Nomor 4 tahun 2014 tentang Pedoman Pelaksanaan Diversi Dalam Sistem Peradilan Anak, dan Peraturan Pemerintah Nomor 65 tahun 2015 tantang Pedoman Pelaksanaan Diversi dan Penanganan Anak yang Belum Berumur 12 tahun. Pada prinsipnya Diversi dengan pendekatan keadilan restoratif untuk memberikan jaminan perlindungan hukum terhadap anak yang berhadapan dengan hukum untuk menghindari stigmatisasi terhadap anak serta diharapkan anak dapat kembali ke dalam lingkungan social secara wajar. Keadilan Restoratif adalah suatu proses dimana semua pihak yang terlibat dalam suatu perkara pidana bersama-sama menyelesaikan masalah serta menciptakan suatu kewajaran untuk membuat segala sesuatunya menjadi lebih baik dengan melibatkan korban, anak dan masyarakat dalam upaya mencari solusi memperbaiki dan menentramkan hati dengan tidak berdasaarkan pembalasan.   The idea of Diversion was originally proclaimed in the United Nations Standard Minimum Rules for the Administration of Juvenile Justice, otherwise known as The Beijing Rules. Diversion is the granting of authority to law enforcement officials to take action or policy in handling or resolving problems of child offenders by not taking a formal path, for example by stopping or not continuing / releasing from the criminal justice process. With the enactment of Act No. 11 of 2012 concerning the Child Criminal Justice System on 30 July 2012, and entered into force 2 years later, Indonesia has legally established a regulation that provides legal protection for children facing the law, with one of its methods called Diversion. Furthermore, as the Implementing Regulation, the issuance of Supreme Court Regualtion No. 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Justice System, and Government Regulation No. 65 of 2015 concerning The Guidelines for the Implementation of Diversion and Handling of Children Under 12 Years Old. In principle, Diversion with a restorative justice approach is to guarantee legal protection for children facing the law to avoid stigmatization of children and it is expected that children can return to the social environment fairly. Restorative Justice is a process where all parties involved in a criminal case together solve a problem and create a fairness to make things better by involving victims, children and the community in an effort to find solutions to improve and reassure by not responding to retaliation.

Penelitian ini membahas tentang “Hak Anak Dalam Sistem Peradilan Pidana Anak di Indonesia”. Penelitian ini bertujuan untuk mengentahui, menganalisis dan membahasn konsep serta bentuk dari hak anak dalam sistem peradilan pidana anak di Indonesia. Penelitian ini merupakan penelitian normativ dengan menggunakan pendekatan studi kepustakaan dengan menelaah, meneliti dan mengkaji perundang-undangan yang membahas tentang hak anak baik secara konsep maupun bentuk. Hasil dari penelitian ini secara garis besar dapat disimpulkan bahwa anak dalam dalam perkara pidana mendapat jaminan perlindungan hukum dalam berbagai bentuk seperti jaminan keselamatan baik fisik, mental maupun sosial dan memiliki akses terhadap informasi mengenai perkembangan perkara. Anak harus mendapatkan haknya berdasarkan kepentingan terbaik anak penghargaan terhadap anak. Jaminan perlindungan yang didapat tidak hanya dari Undang-undang No 11 tahun 2012 tentang sistem peradilan pidana anak namun juga dari Undang-undang No 13 tahun 2006 tentang perlindungan saksi dan korban. Negara dalam hal ini pemerintah dan aparatur penyelenggara memperhatikan implementasi yang efektif dengan pertimbangan kepentingan terbaik anak.Kata kunci: Sistem peradilan pidana anak, perlindungan anak, hak anakThis research discusses "Children's Rights in the Child Criminal Justice System in Indonesia". This study aims to identify, analyze and discuss the concepts and forms of children's rights in the juvenile justice system in Indonesia. This research is a normative study using a literature study approach by examining, researching and examining laws that discuss children's rights both in concept and form. The results of this study can be broadly concluded that children in criminal cases receive legal protection guarantees in various forms such as safety guarantees both physically, mentally and socially and have access to information regarding case developments. Children must get their rights based on the best interests of the child and respect for the child. The guarantee of protection is obtained not only from Law No. 11 of 2012 concerning the juvenile criminal justice system but also from Law No. 13 of 2006 concerning the protection of witnesses and victims. The state in this case the government and the apparatus organizers pay attention to effective implementation with consideration of the best interests of children.Keywords: Child criminal justice system, child protection, children's rights

The diversion provisions in the juvenile justice system law whether it has prevented children from the negative effects of the Criminal Justice System. By the way, all children who have problems with the law put the best interests of the child. The method of approach is the statutory approach and the comparative approach. Primary, secondary and tertiary legal materials obtained by the author will be analyzed using the method of systematic interpretation, namely interpretation by looking at the relationship between the rules in an interdependent law.The result, diversion is a settlement of child cases that are carried out outside formal justice with the aim of preventing children from stigmatizing children who are dealing with the law must be in accordance with the purpose of diversion in The Beijing Rules. Whereas in Indonesia, the diversion provisions in the Criminal Justice System Act of the Child are still included in the criminal justice system by giving stronger stigmatization to children who are in conflict with the law and so it is not in accordance with the purpose of diversion in The Beijing Rules. So the diversion provisions in the Child Criminal Justice System Law do not yet reflect the principle of child protection as mandated by the Child Protection Act and the Child Criminal Justice System Law. Where the diversion in the Child Criminal Justice System Law has not fully mandated the principle of the best interests of children viewed from the perspective of child protection, with a view of all issues by placing the child's position as first and foremost.

Children as members of the next generation need to be protected. In the juvenile justice system, children are entitled to legal protection, both in the context of their position as children in conflict with the law (i.e. as criminals) and as victims or witnesses of crime. The laws of the Juvenile Criminal Justice System have been arranged to require the judge to consider the Social Research Report (SRR) given by community advisors before the verdict. The purpose of the study is to explain the benefits of Social Research Reports for children in conflict with the law and the constraints faced in preparing them. The experiment was conducted using an empirical juridical approach by promoting the use of primary data and was supported by secondary data. Based on the results of data analysis, it can be concluded that SRR preparation is very beneficial for children in conflict with the law. It contains conditions that explain the relationship between the condition of the offender and the committed criminal act so that it can be the basis of consideration for law enforcement officers in making the best decision for the children. In the past, the punishment of children was the same as the punishment of adults. This causes the psychological condition of children ranging from investigation, investigation and trial to be disturbed because it is often intimidated by law enforcement agencies. Under these conditions, Law No. 11 of 2012 concerning the Juvenile Justice System was born. One of the reforms in the Child Criminal Justice System Law requires the settlement of a child criminal case by diversion. Based on the results of research that the conception of criminal offenses against children in conflict with the law in Indonesia is different from criminal convictions to adults. Children are given the lightest possible punishment and half of the criminal convictions of adult criminal offenses. That criminal liability for children who are ensnared in a criminal case according to the Law on the Criminal Justice System for Children is still carried out but with different legal sanctions from adults. Criminal imprisonment against children is an ultimumremedium effort, meaning that criminal imprisonment against children is the last legal remedy after there are no other legal remedies that benefit the child. That the concept of enforcement of criminal law against children caught in criminal cases through diversion is in fact not all have applied it. Some criminal cases involving children as the culprit, in court proceedings there are still judges who impose prison sentences on children who are dealing with the law.
