Objectives. The goal of scholarly research is to develop proposals for amendments in criminal law General and Special part of Criminal code of the Russian Federation governing self-defense. The scientific article identifies legislative gaps and contradictions that hinder the effective implementation of the necessary defense and require prompt solutions. Methods. The article analyzes such concepts as “self-defense”, “public assault”, “excess of limits of necessary defense”, “violation of the conditions of lawfulness of necessary defense”, “surprise assault”, “rights defending or other persons, interests of the state”. The use of logical and comparative legal methods allowed us to develop proposals for making changes to the criminal law norms that establish the necessary defense. Conclusions. The article shows the conflicts and gaps legislative recognition of self-defense and, in this regard, the complexity of its implementation in the articles of the Special part of the Criminal code of the Russian Federation and practical application. Changes are proposed to the criminal law norms regulating the necessary defense, both in the General and in the Special part of the Criminal code of the Russian Federation. Sense. The content of the scientific article can be used by the teaching staff of higher educational institutions when teaching the course “Criminal law”. The results of the work can be useful to persons who carry out legislative activities in the field of criminal law. The leitmotif of the article can be used in the preparation of dissertation research.

В статье автором рассматривается нормативное правовое закрепление порядка осуществления общеполицейских функций сотрудниками Госавтоинспекции, патрульно-постовой службы полиции в том числе и в сфере обеспечения безопасности дорожного движения. Приводятся статистические сведения, подчеркивающие актуальность имеющейся проблемы разграничения полномочий указанных служб федеральным законодательством, подзаконными актами и ведомственными приказами МВД. Авто- ром проведен анализ судебной практики по исследуемой проблеме, высказаны предложения по внесению изменений в федераль- ное законодательство. Положения работы могут быть использованы в законодательной деятельности государственных органов, правоприменительной деятельности правоохранительных органов, образовательном процессе образовательных организаций, на- учных исследованиях специалистов по проблемам обеспечения безопасности дорожного движения, совершенствования отраслей российской правовой системы. Новизна работы определяется практической и научной значимостью проблем правоприменительной деятельности правоохранительных органов в сфере обеспечения безопасности дорожного движения, а также необходимостью со- вершенствования правовых основ, регламентирующих полномочия подразделений и служб полиции России. In the article, the author considers the normative legal consolidation of the procedure for the implementation of general police functions by employees of the State Traffic Inspectorate, patrol and post service of the police, including in the field of road safety. The article provides statistical data that emphasize the relevance of the existing problem of delineating the powers of these services by federal legislation, by-laws and departmental orders of the Ministry of Internal Affairs. The author analyzes the judicial practice on the problem under study, and makes suggestions for amendments to the federal legislation. The provisions of the work can be used in the legislative activities of state bodies, law enforcement activities of law enforcement agencies, the educational process of educational organizations, scientific research of specialists on the problems of ensuring road safety, improving the branches of the Russian legal system. The novelty of the work is determined by the practical and scientific significance of the problems of law enforcement activities of law enforcement agencies in the field of road safety,as well as the need to improve the legal framework governing the powers of police units and services in Russia.

During the pandemic, parliaments around the globe suffered a “double shock”: They had to adjust to the challenges of the infectious disease and uphold or (re-)establish their roles with regard to the executive . A closer investigation of 27 parliaments in different political systems gives a first in-depth comparative account for their initial reactions to the crisis . It is based on information from an ongoing collaboration of experts on parliaments and builds on a model of historical institutionalism . In some countries significant measures were taken, including restricting participation in parliamentary proceedings and moving some of them online . Committees served as a field of experimentation for digitalizing par­liaments . While only in a few countries legislative activities were strongly dominated by the pandemic, in most countries continuity across policy areas prevailed . More variety can be seen in institutional changes for parliamentary oversight . Communication activities intensi­fied with the pandemic, particularly from parliamentary leadership . These first results indi­cate that parliaments and established parliamentary democracies, in particular, were able to perform their functions despite unprecedented challenges posed by the Covid-19 pandem­ic .

The author of the article considers the development of Montenegrin law in the 19th - early 20th centuries and tries to assess the results of the legislative activities of the Montenegrin authorities, that issued new regulations and carried out large-scale codification work on regular basis. From the point of view of the normative approach, widely used in legal science, these activities seemed quite successful; the laws that met urgent needs of the state's development were created within short periods of time. However according to the sociological approach, one has to admit that the significant part of Montenegrin legislation was just a formality and was hardly implemented in practice.
