LEGAL ASSESSMENT OF THE FEDERAL LAW "ON PROTECTION AND PROMOTION OF CAPITAL INVESTMENTS IN THE RUSSIAN FEDERATION"

The growing issue of attracting private investment in the Russian economy from year to year gave rise to the development of new measures of support from the state in relation to organizations implementing an investment project, which also form the most favorable investment climate in the country. Such preferences, which consist in a stabilization clause, are contained in the new Federal Law No. 69-FZ of 01.04.2020 “On Protection and Promotion of Capital Investments in the Russian Federation”. However, based on the conducted research, it is concluded that there are a number of legal imperfections, which are expressed in a number of conditions, non-compliance with which entails the inadmissibility of concluding an agreement on the protection and promotion of investment between a private and public person. At the same time, those provisions are so unattainable, infringing and limiting that the question of the expediency of the analyzed investment law will be justified. That is why proposals were made to adjust the rules, which would allow widening the range of persons entitled to state support and thereby attract their capital as an investment in the Russian economy – that is, to achieve the goals originally set.

Subject. This article analyzes the economic and demographic conditions for the Russian pension system’s development and the impact of the effectiveness of investment projects implementation on pension savings. Objectives. The article aims to analyze the Russian pension system’s development difficulties in terms of an unfavorable investment climate and negative demographic trends, and identify ways to propel the pension savings investing profitability increase. Methods. For the study, I used induction and deduction, and the methods of systems and statistical analyses. Results. The article offers recommendations for the development of a system of measures aimed at improving the methodological support for the preparation and implementation of management decisions on investment project management. Conclusions and Relevance. Solving the problems of the pension system through the development of voluntary pension savings is constrained by the low efficiency of the investment projects implementation. The results of the study can be used when developing legislative, organizational and methodological measures aimed at improving the efficiency of investing pension savings in investment projects implemented in the Russian Federation.

The COVID-19 pandemic interrupted many trends that had developed before it and again updated the issue of modernizing the Russian economy, restarting the mechanisms of economic growth and sustainable socio-economic development. The key to resolving these issues is to increase the investment activity of the business. The investment climate is one of the key characteristics that testify to the freedom of entrepreneurial activity, the ease of opening and conducting business, the quality of regulatory procedures in the economy, the effectiveness of business entities, and the provision of equal opportunities for the development of the private sector. A favorable investment climate reveals the potential for the development of private companies. The article considers the system of state procedures in the field of improving the national investment climate, gives a brief description of the main tools and projects to improve the investment climate, analyses the changes in the main target indicators of investment attractiveness of the Russian Federation.

The article examines the contradictions of the Russian economy in the context of the federal law “On the strategic planning in the Russian Federation”. The contradictory nature of planning on the way to market development is noted. It is emphasized that planning while maintaining the dominance of private capitalist ownership of the means of production does not entirely solve the problem of bringing the economy onto the path of sustainable development.

Topic. The subject of the article is the analysis of approaches to overcoming the stagnation of scientific and technological development of the Russian economy in the context of the emerging system of strategic planning in the Russian Federation.Purpose. The authors set the following main tasks. First — based on the assessment of the current situation in the field of scientific and technological development of the Russian Federation — to analyse the tools used for strategic planning of scientific and technological development for their internal connectivity. Second — based on analysis mentioned above — to form the directions of further development and improvement of the formed system of strategic planning of scientific and technological development in the RF.Methods. The logistic analysis of the developed documents of strategic planning of scientific and technological development of the Russian Federation on the subject of their substantial conjugacy and compliance with the logic and requirements of the Federal law No. 172 “On strategic planning in the Russian Federation” made it possible to formulate proposals for its further development and improvement.Results. The analysis showed that Federal law No. 172 “On strategic planning in the Russian Federation” forms the conceptual basis for strategic planning of scientific and technological development in the RF. Further development and improvement of the formed system of strategic planning of scientific and technological development of the RF should take place in the direction of strengthening the substantive interface of strategic planning documents (strategies and programs) at the Federal level with similar documents at the industry and regional levels. To this end, it is necessary, first, to finalize, in the context of the tasks of scientific and technological development, the methodological requirements for the documents of the sectoral and regional level and, secondly, to ensure the logic (sequence) of the development of such documents, allowing to really ensuring their meaningful internal relationship.

Под инвестициями в образование мы понимаем финансовые, имущественные, интеллектуальные и другие ресурсы, которые способствуют развитию образования и повышения ее конкурентоспособности, а следовательно, и конкурентоспособности нашего государства. Проанализировав Федеральный Закон «О Федеральном Бюджете» можно сделать вывод о том, что механизм инвестиционного обеспечения высшего образования в РФ пока развит слабо, что проявляется в фактически полной зависимости вузов от государственного финансирования, объемы которого очень ограниченны особенно в условиях пост-ковидного кризиса. В условиях снижения количества бюджетных средств в обеспечении деятельности высшего образования особую важность приобретает постоянное стимулирование частных инвестиций и поиск дополнительных источников финансирования. Средства отдельных юридических и физических лиц могут быть существенным дополнительным источником развития высших учебных заведений, одновременно влияя на хозяйственные операции в целом в виде повышения уровня  образования в стране и порождения других положительных экстернальных эффектов. Но при установленной фиксированной оплате за обучение для отдельных физических лиц в вузах качество, вариативность и инновационность образовательных услуг определяется не постоянными инвестиционными вливаниями, а имеющимся административным руководством, его стратегией и тактикой деятельности и особенностью функционирования данного заведения в целом. By investment in education, we mean financial, property, intellectual and other resources that contribute to the development of education and increase its competitiveness, and therefore the competitiveness of our state. Having analyzed the Federal Law "On the Federal Budget", we can conclude that the mechanism of investment support for higher education in the Russian Federation is still poorly developed, which is manifested in the virtually complete dependence of universities on state funding, the volume of which is very limited, especially in the conditions of the post-covid crisis. In the context of a decrease in the amount of budget funds in ensuring the activities of higher education, it is of particular importance to constantly stimulate private investment and search for additional sources of financing. The funds of individual legal entities and individuals can be a significant additional source of development of higher educational institutions, while simultaneously influencing economic operations in general in the form of increasing the level of education in the country and generating other positive external effects. But with a fixed tuition fee for individual individuals at universities, the quality, variability and innovation of educational services is determined not by constant investment injections, but by the existing administrative management, its strategy and tactics of activity and the specifics of the functioning of this institution as a whole.

The article analyzes the content of the new Article 75.1 of the Constitution of the Russian Federation through the prism of economic and political doctrines of solidarity based on the social division of labor, codependency, and mutual assistance. The relevance of the problem of social solidarity in the implementation of economic activity by citizens is due to the entry into force of the Law of the Russian Federation on the amendment to the Constitution of the Russian Federation of March 14, 2020 "On improving the regulation of certain issues of the organization and functioning of public authorities." Concluded that Article 75.1, fixing new principles of balancing private and public interests based on mutual trust in society and the state, integrating the Russian economy into the global community based on universal principles of economic development set out in the Concept of Sustainable Development of the United Nations.

The article analyzes the legal nature of specific types of investment agreements in the construction sphere. The article contains the conclusion that all agreements of housing construction investment can be divided into two large groups: agreements of participation in shared construction, regulated by Federal Law dated December 30, 2004, No. 214-FZ “On Participation in Shared Construction of apartment houses and other real estate objects and about modification of some legal acts of the Russian Federation” and other investment agreements, which do not come within the purview of the above mentioned law. Participants of the latter group of agreements are under the protection of the Law of the Russian Federation “On Protection of Consumers´ Rights”, general provisions of the Civil Code of the Russian Federation on agreement, fulfillment of obligations and invalidity of legal transactions, provisions of the Special Part of the RF CC on the futures contracts, construction project contracts and others, and also framework regulation of the Federal Law “On Investment Activity in the Russian Federation in the form of capital investments”. The author provides analysis of similarities and differences of the indicated agreements.

The article is devoted to the issue of achieving balance between private and public interests in arbitration disputes. The author notes that arbitration proceedings as one of the alternative forms of civil rights protection, guarantee the realization by the parties of the right to freedom of contracts and the right to judicial protection in a voluntarily elected procedural form. The author draws attention to the fact that a legislator can impose certain restrictions, based on the need to ensure balance between private and public interests depending on the object of the dispute, its social importance, conditions of civil circulation, legal culture and development of the national social and economic system. The article contains proposals for amendments and additions to the new Federal Law “On Arbitration (Arbitration Proceedings) in the Russian Federation”. The author concludes that the new task of legal regulation is the creation of favorable legal environment for the functioning of arbitration courts which being an institute of civil society, will contribute to more effective functioning of national economy under the conditions of a civilized market, implementation of stability in economy management and attractiveness of the jurisdiction of the Russian Federation as a venue to conduct arbitration with participation of foreign countries.

The article analyzes the situation with attraction of foreign direct investments (FDI) into the Russian Federation. Sharply increased inflow of international financial resources into national economy has highlighted the problem of definitions, the reasons of this phenomenon and its economic contents. The article considers methodological aspects and economic essence of modern FDI. Special accent is made on the estimation of the situation with their attraction into Russia, FDI structure and effectiveness. The conclusions about basic directions of the increase of their effectiveness in the Russian economy are formulated.
