Os crimes contra os direitos humanos praticados na ditadura militar brasileira: Justiça de transição e persecução penal

This book aims to analyze the crimes against human rights that offended the Democratic Rule of Law in Brazil, committed by state agents in the Brazilian military dictatorship (1964/1985), asserting that they remained unpunished. In view of this, to address this issue, it is proposed that criminal offenders be held liable. The issue of our slow Transitional Justice will also be examined, arguing for the criminal prosecution of state agents who violated human rights in Brazil, demonstrating how and how this can occur, all in order to move away from impunity, hitherto guaranteed by the Brazilian Amnesty Law, ensuring the effectiveness of justice and the strengthening of democracy.

Resumo: O Brasil passou por um processo tardio de reconstrução da sua história no que diz respeito à Justiça de transição. Entre os elementos que desde uma perspectiva conceitual compõem uma noção de Justiça de transição encontram-se os processos compreendidos pelas reformas institucionais, caracterizados pela realização de medidas voltadas à reeducação e refuncionalização das instituições públicas, a fim de reorientá-las para o cotidiano do Estado Democrático de Direito, com vistas à promoção dos direitos humanos, extirpando resquícios autoritários das estruturas normativas, institucionais e culturais do Estado. No interior desse debate, as instituições de justiça e segurança pública são comumente identificadas como alvos prioritários de processos de transição, dada a sua relação intrínseca e direta com o tratamento da violência política sistemática e a restrição de direitos e liberdades. Nesse sentido, o artigo apresenta uma discussão sobre o cenário das reformas institucionais referentes ao poder judiciário e aos sistemas de segurança pública, em um esforço analítico para contribuir com os debates realizados no contexto tardio de Justiça de transição no Brasil.Palavras-chave: Justiça de transição. Among the elements that usually make up a conceptual notion of transitional justice, it can be found the processes understood by institutional reforms, characterized by carrying out measures aimed at reeducation and refunctionalization of public institutions, in order to redirect them to the Democratic Rule of Law, and the promotion of human rights, putting away authoritarian remnants from normative, institutional and cultural public structures. Within this debate, the institutions of justice and public security are commonly identified as priority targets for transition processes, because of its intrinsic and directly relation to the treatment of systematic political violence and the restriction of rights and freedoms. In this sense, the article presents a discussion on the scenario of institutional reforms regarding the judiciary, public security in the context of the late Transitional Justice in Brazil.Keywords: Transitional justice. This chapter examines the utopias called forth by the marriage of human rights accountability mechanisms on the one hand, and, on the other, arguments about the practical significance of these initiatives as preconditions for development, democracy, and political society. Transitional justice is seen to marry the ethical charge of the human rights field’s march against impunity, with an instrumental potential facilitating transition from the rule of violence into the rule of law. If the normative theories and agendas implicated by this marriage are advanced as being in the interests of justice, the accompanying instrumental theories and agendas are advanced in the interests of transition. Justice and transition operate here as allied and mutually reinforcing aspirations of and rationales for transitional justice institutions. Thus, this chapter identifies and analyses the stakes that attend this marriage of ‘ethics’ and ‘expertise’ in constituting the utopian political imagination of transitional justice.

Nowadays in Kyrgyz Republic take a place huge reforms of prosecutors. The implementation of national projects requires a new quality of prosecutorial oversight so thatthe human rights and law enforcement potential of the prosecutor’s office really contributes to the development of a democratic rule of law. The prosecutor's office as one of the state legal institutions plays an extremely important role in the public and state life of the Kyrgyz Republic. As you know, the successful implementation of socio-economic and socio-political transformations in the state largely depends on existing laws, the observance of which the prosecutor's office is called upon to monitor.

The notion of human dignity has in recent years come under attack from sectors of the interdisciplinary and legal academic community as vacuous and of little or no utility in judicial reasoning. This author holds instead that human dignity is the sine qua non of all human life and correlated with certain inviolable human rights that speak to human beings as other than property, as having legal personality and the right to be heard. The notion of human dignity then serves, it is argued here, as essential guidance in judicial reasoning on issues of individual and group fundamental human rights. Neglect in honouring the principle of respect for human dignity in judicial decision-making serves to erode the democratic rule of law and the interests of justice as will be illustrated through examination in particular of the U.S. Supreme Court case of J.C. Hernandez et al v. J. Mesa Jr.

For over a decade, judicial accountability of mass human rights violations committed during the last civil-military dictatorship in Argentina (1976–1983) has been carried out in federal courts by regular judges, following the rules of the National Code of Criminal Procedure. Research on these trials has focused mainly on the victims and the accused. This article opens a different path by exploring the affective experiences of the judges presiding over and leading the trials. Based on interviews with 18 federal court judges and some participant observation, in this article we present a descriptive exploration of the judges’ experiences and sensemaking processes. We examine the complex interaction between the professional requirement to separate emotions from judgment and the emotional toll that these trials produce in the personal and professional lives of the judges. We end with short reflections on these crimes against humanity trials in the post-Transitional Justice context.

This article asserts that Russian nongovernmental organizations (NGOs) contribute to processes of transitional justice in Chechnya through their litigation in front at the European Court of Human Rights (ECtHR). Having delivered more than 200 judgments on atrocities which occurred during the two recent conflicts in Chechnya, the ECtHR has repeatedly ruled that the state should pay financial compensation to the victims. While the Russian Federation has been following through on such payments, human-rights monitors allege that domestic authorities have failed to take active measures to address the atrocities themselves.Through a qualitative interview study with Russian lawyers and NGO representatives, this article seeks to scrutinize how NGOs have been using the ECtHR’s mechanisms and judgments by way of leverage to initiate processes of transitional justice in post-conflict Chechnya. It appears that the ECtHR is not an end-station for human-rights claims and individual grievances but, rather, the start of a series of further claims. NGOs: (a) engage in political advocacy in implementing the judgments; and (b) create leverage for the criminal prosecution of perpetrators.

This Article entitled " the State law of Indonesian" is the result of a study on the conception of characteristic of law states of Indonesian that distinguish the conception of the state laws in other countries. Based on the research results, can be explained even get the effect of various thoughts, but conception of law state of Indonesian different with conception the rule of law and rechtsstaat. This can be search from basic of philosophy, the nature of sovereignty, the powers of state organs, and human rights.
