This study aims to determine how the application of the concept of restorative justice in accordance with Law No. 11 of 2012 on Child Criminal Justice system. This study uses normative namely a study that discusses the problem based on the literature and legislation relating to the matter to be investigated. Law No. 11 of 2012 on the Criminal Justice System Child has provided a new concept in the criminal justice system, especially those in the juvenile justice system. Related to the concept of Restorative Justice or restorative justice is a resolution processes involving perpetrators, victims, families, and other relevant parties in a criminal act, jointly seek solutions to the offense and its implications by emphasizing restoration and not retribution.

Pelaku tindak pidana tidak hanya dilakukan oleh orang dewasa, melainkan anak-anak juga dapat melakukan tindak pidana. Mengenai pengertian anak-anak yang melakukan tindak pidana atau yang berkonflik dengan hukum diatur dalam Undang-Undang Nomor 11Tahun 2012 tentang Sistem Peradilan Pidana Anak. Dalam UU No 11 Tahun 2012, anak yang divonis bersalah dalam sistem peradilan anak mendapatkan pembinaan di LPKA. Salah satu pembinaan yang penting bagi anak sebagai bekal hidup ketika kelak kembalike masyarakat maka anak didik    penting mendapatkan pendidikan kewirausahaan melalui program pembinaan di LPKA.Kata Kunci: Pendidikan Kewirausahaan, Anak Didik, LPKACriminals are not only committed by adults, but children can also commit criminal acts. Regarding the understanding of children who commit criminal acts or who are in conflict with the law regulated in Law No. 11 of 2012 concerning the Children's Criminal Justice System. In Law No. 11 of 2012, children convicted in the juvenile justice system get coaching at LPKA. Youths under 18 years get trapped into the Juvenile Justice System after being suspected of committing a delinquent or criminal act. The United States tops in Juvenile arrests in the world. States like West Virginia, Alaska, Oregon, South Dakota, and Wyoming have the highest number of juveniles. However, an estimated 2.1 million youths under 18 years were arrested in the United States during a single year. This paper aims to address the current racial differences that exist within the criminal justice system. By addressing challenges like youths of color are more likely to be committed than white youths into the juvenile system will assist in curbing racial disparity. Statistics reveal that 42% of youths in the placement holdings are black youths, even though black youths make up for 16% of youths all over the United States. In California alone, African American juveniles take 27.5% while whites take up 15%. Even though the system’s laws contain no racial bias, research shows that discrimination can occur where the system allows criminal justice officials discretion in handling offenders. Black youths take up for 15% of the total number of youths in the USA get they have the highest juvenile detentions of 42%, but it is difficult to deny these records since there is evidence like arrest and imprisonment records to back up this claim. The racial disparities exist from targeting the blacks, arrest, sentencing, imprisonment, and release. These actions promote discrimination among the black youths, and black youths are likely to get significant sentencing compared to whites for the same crimes committed. Different states in the United States have different racial disparities, California and Texas, blacks serve long sentences, unlike the whites. There are various causes of racial disparities like; some black residences are known for crime, and they have huge offence rates, unequal access to resources, judicial decisions, and racial prejudice. After the research, it was evident that racial disparity exists, and it can only be corrected by looking at the root cause of the problem widely, which is discrimination. Race plays a significant role when it comes to juvenile detentions. Youths of color are four times more probable to be detained, unlike white youths. The research designed a method of tracking racial disparities via a hypothetical juvenile jurisdiction criminal justice system. The paper will extensively dive into juvenile population characteristics, juvenile justice system structure, law enforcement, juvenile crime, juveniles in court, juveniles on probation by the state, juveniles in the correction by the state and foreign nations, and an analysis of all the findings. The extensive research will be able to answer all the questions to the problem of racial disparity.

When we first volunteered to be on the Local Arrangements Committee for the ACRL 2019 conference, and to write this specific piece for our colleagues who were coming to our city, neither of us had a clue that the entire third season of the true crime podcast Serial1 would focus on the criminal justice system of Cuyahoga County. But since it was so popular, we considered it a good framing device for a discussion about social justice in Cleveland.If you haven’t listened to Serial, the short version is Cleveland and Cuyahoga County’s criminal and juvenile justice system are shining examples of the inequity that exists in the region. Poverty, segregation, violence, food deserts, crime, and an unfair justice system are all parts of the larger system that remains unjust and unequal in the heart of a Rust Belt city desperate to rise again.

This study aims to determine and analyze the application of the principle of simple justice Rapid Simple Fee in the criminal justice system in the State court of Pati. As well as to identify and explain the barriers and solutions simple application of the principle of justice Rapid Simple Fee in the judicial system in State court of Pati. And to identify and explain the contribution principle is simple justice Rapid Simple Fee in the criminal justice system to reform the criminal justice system in the future. This study uses empirical juridical approach to analysis of the application of the principle of judicial issues simple, quick and inexpensive in the criminal justice system in the State court of Pati. Specifications research is descriptive analysis. With data collection techniques are primary and secondary data and research literature, analyzed using qualitative. The problem is analyzed with the theory of law enforcement and progressive legal theory. The results of this study showed that every judge shall comply with the laws that have been set ie power Act No. 48 of 2009 and Act No. 8 of 1981. Constraints in principle to simple justice Rapid Simple Fee is the human resources of the apparatus law enforcement, lack law enforcement and courtroom facilities, absence of the parties or witnesses. The solution is to determine the court calendar, giving sanction to the litigants or witnesses who have been called State court of Pati. Contributions in future expected law enforcement qualified for handling the case, mutual cooperation between law enforcement agencies and is able to imitate the criminal justice system in developed countries such as settling disputes out of court with mediation mechanism penal (penal mediation), restorative justice, diversion in juvenile justice and other forms that thrive in the community. It is considered necessary as part of the criminal law reform. Contributions in future expected law enforcement qualified for handling the case, mutual cooperation between law enforcement agencies and is able to imitate the criminal justice system in developed countries such as settling disputes out of court with mediation mechanism penal (penal mediation), restorative justice, diversion in juvenile justice and other forms that thrive in the community. This article discusses how the law arrangements in the juvenile justice in the process of resolving the case, How restorative justice restrictions in law enforcement in Indonesia and How the application of Restorative justice law in the process of settlement of criminal case in Criminal Law in Indonesia. This type of research is normative juridical that describes reviewing and explaining and analyzing normative provisions associated with restorative justice applicable in Indonesia. From the above discussion that restorative justice in the settlement of criminal acts committed by children is very concerned in rebuilding relations after the occurrence of criminal acts, rather than exacerbate the rift between the perpetrators, victims and the community which is the character of the current modern criminal justice system. The restorative criminal justice process holds the view that realizing justice is not only a matter of government and criminality, but more than that it must provide justice in totality that can not ignore the interests and rights of victims and society. Implementation of the principle of restorative justice and the process of diversion as an effort to solve crimes committed by children in formal juridical has been set clearly and firmly in Law Number 11 Year 2012 about kids of justice.

Positioning of restorative justice within the criminal justice system is one of the current questions preoccupying theorists and practitioners in the field. During decades restorative justice processes have been predominantly used within juvenile justice systems for dealing with minor offences committed by juveniles. Number of jurisdictions in Europe, USA, Canada, Australia have criminal codifications containing provisions that enable use of restorative justice processes in aim of diversion. Recent initiatives create possibility of applying restorative procedure in cases of serious crimes committed by adult offenders. This article reviews theoretical discussions and practical issues relating the scope and tasks of restorative justice within criminal justice, which may contribute to the development and use of restorative processes in our criminal justice system.

AbstractIn this study aims to determine the legal phenomena that arise as a result of the criminal justice system, as a reflection of the development of criminal law both at the theoretical and practical level. The findings in this research are based on two approaches namely the statute approach as an approach based on the rule of law and the conceptual approach based on the conceptual approach. There are 3 (three) findings of legal phenomena in this study, namely: first, the presence of a double track system in the criminal mechanism in Indonesia. Secondly, there is a phenomenon of paradigm shifting the character of punishment in Indonesia and third, re-measuring restorative justice in the form of diversion mechanism based on the perspective of utilitarianism. In principle, crime is always closely related to criminal sanctions, but in the double track criminal system is directed at criminal actions. On the other hand, the phenomenon of paradigm shift in the character of punishment occurs in the juvenile justice system, namely the approach to criminal responsibility is done by bargaining an agreement between the perpetrators, victims and community involvement. Furthermore, measuring restorative justice based on a utility perspective, this finding found coherence between restorative justice in the form of diversion and utilitarianism. Therefore, the overall legal phenomena above are some manifestations of the legal reality that is present in the criminal system in Indonesia.Keywords: criminal paradigm shift; double track system; utilitarianismAbstrakPada penelitian ini bertujuan untuk mengetahui fenomena-fenomena hukum yang timbul akibat dari sistem peradilan pidana, sebagai suatu refleksi atas perkembangan hukum pidana baik pada tataran teoritis maupun praktik. Penemuan dalam penelitian didasari dengan dua pendekatan yaitu statute approach sebagai suatu pendekatan berdasarkan peraturan undang-undang dan conceptual approach yang didasari dengan pendekatan koseptual. Terdapat 3 (tiga) temuan fenomena hukum dalam penelitian ini yaitu: pertama, hadirnya double track system dalam mekanisme pemidanaan di Indonesia. Kedua, adanya fenomena pergeseran paradigma karakter pemidanaan di Indonesia dan ketiga, menakar kembali keadilan restoratif dalam bentuk mekanisme diversi berdasarkan perspektif utilitarianisme. Pada prinsipnya kejahatan tindak pidana selalu erat hubungannya dengan pidana sanksi namun dalam double track system pemidanaan diarahkan pada pidana tindakan. Di sisi lain, fenomena pergeseran paradigma karakter pemidanaan terjadi pada sistem peradilan pidana anak, yaitu pendekatan pertanggungjawaban pidana dilakukkan dengan cara bargaining kesepakatan antara pelaku, korban dan keterlibatan masyarakat. Selanjutnya menakar keadilan restoratif berdasarkan perspektif utilitis, dalam temuan ini ditemukan koherensi antara keadilan restoratif dalam bentuk diversi dengan aliran utilitarianisme. Oleh karena itu, keseluruhan fenomena-fenomena hukum tersebut diatas merupakan beberapa wujud kenyataan hukum yang hadir di sistem pidana di Indonesia.Kata kunci: double track system, pergeseran paradigma pidana, utilitarianisme

The future of the children will determine the future of the nation. The increasing problem of juvenile delinquency in this globalization and information technology era, requires the state to give more attention to the child's future. Application of the criminal justice system for children in Indonesia is as stipulated in Law Number 3 of 1997 potentially detrimental to the child's interests. In practice, the judicial system had many problems, among them is a violation of the rights of children, such as: physical and psychological violence, as well as deprivation of the right to education and welfare. It happened because the juvenile justice system is against to national and international regulations on the protection of children’s rights. Besides that, theory of punishment for the juvenile delinquency still refers to the concept of retribution for the crimes. This concept is not very useful for the development of the child, so the concept need to be repaired with the concept of restorative justice. With this concept, the criminal justice system for the juvenile delinquency, leads to the restoration of the state and the settlement pattern, involving the perpetrator, the victim, their families and engage with the community. This is done with consideration for the protection of children against the law.
