Article 24 of Law Number 41 Year 2004 on Wakaf states that wakaf with testament both orally and in writing can only be done if witnessed by at least 2 (two) witnesses who meet the requirements. The statement that wakaf with a will, either orally or in writing can only be done if witnessed by at least 2 (two) witnesses fulfilling the requirements as meant in Article 24 of Law Number 41 Year 2004 above means that if the endowers with oral or written testimony is not witnessed by at least 2 (two) witnesses who fulfill the requirements, it will have a legal effect on the validity of the waqf status. However, after the following articles and / or paragraphs of Law Number 41 Year 2004 along with their explanation, as well as Government Regulation Number 42 of 2006 on Implementation of Law Number 41 Year 2004 About Wakaf,  there was not  found any article explains what legal implications would be if the wakaf testament is not witnessed by at least 2 (two) witnesses who meet the requirements. Therefore, in order to overcome the incompleteness resulting in the ineffectiveness of Article 24, if there are any concrete events related to the will of judgment submitted to the court to be resolved, the judge shall be able to use the method of legal discovery, either according to the science of law or according to Islamic law appropriately, so it can provide legal certainty for justice seekers.

Abstract. Children are children, and not little adults. Thus, the treatment of children whether involved in criminal acts or those experiencing social problems must be addressed for the welfare of children. The need for children adoption within Indonesian Islamic community will also be increasingly important for those who need it, in order to obtain legal certainty in which can be obtained by a court decision including the decision of the Religious Court. The marriage law and religious justice law have regulated in detail about child care and guardianship which are compiled in a compilation of Islamic law. The Law on Religious Courts explicitly states that the Religious Courts are a court for Muslims regarding cases or matters that are in its authorities. Muslims in this case are not only adults but also children. Unfortunately, the issue of children protection is not referred explicitly in the authorities of the Religious Courts. However, to serve and to fulfill the legal needs of Muslims regarding to child care, the Religious Courts, at the request of someone who adopts a child based on Islamic law, may issue a decision on adoption in terms of the child concerned as a proof of completion of the will must be regulated in the Compilation of Islamic law of Religious Courts. Consequently, the rights and obligations of parents who have adopted children with Islamic law have special characteristics that are different from the rights and obligations of parents who have adopted children without Islamic law. Abstrak. Anak-anak adalah anak-anak, dan bukan orang dewasa kecil. Dengan demikian, perlakuan terhadap anak-anak apakah terlibat dalam tindakan kriminal atau mereka yang mengalami masalah sosial harus ditangani untuk kesejahteraan anak-anak. Kebutuhan adopsi anak dalam komunitas Islam Indonesia juga akan semakin penting bagi mereka yang membutuhkannya, untuk mendapatkan kepastian hukum yang dapat diperoleh melalui keputusan pengadilan termasuk keputusan Pengadilan Agama. Hukum perkawinan dan hukum keadilan agama telah mengatur secara rinci tentang pengasuhan anak dan perwalian yang disusun dalam kompilasi hukum Islam. Undang-Undang tentang Pengadilan Agama secara eksplisit menyatakan bahwa Pengadilan Agama adalah pengadilan bagi umat Islam tentang kasus atau hal-hal yang ada dalam otoritasnya. Muslim dalam hal ini tidak hanya orang dewasa tetapi juga anak-anak. Sayangnya, masalah perlindungan anak tidak dirujuk secara eksplisit dalam otoritas Pengadilan Agama. Namun, untuk melayani dan memenuhi kebutuhan hukum umat Islam terkait perawatan anak, Pengadilan Agama, atas permintaan seseorang yang mengadopsi anak berdasarkan hukum Islam, dapat mengeluarkan keputusan tentang adopsi dalam hal anak yang bersangkutan sebagai bukti penyelesaian kehendak harus diatur dalam Kompilasi hukum Islam Pengadilan Agama. Akibatnya, hak dan kewajiban orang tua yang mengadopsi anak dengan hukum Islam memiliki karakteristik khusus yang berbeda dengan hak dan kewajiban orangtua yang mengadopsi anak tanpa hukum Islam.

The granting of land rights is one way for legal subjects to be able to obtain a right to land in Indonesia. This study aims to determine the legal implications of the Decree on Granting Land Rights issued by the National Land Agency without implementing Article 7 of the Republic of Indonesia Government Regulation Number 34 of 2016 concerning Income Tax. This research is empirical legal research. The results of the research show that the Decree on the Granting of Rights to Land is still valid without implying that it is null and void, while Article 7 of the Republic of Indonesia Government Regulation Number 34 of 2016 is not in line with the principles in the theory of legal certainty and is not effective in its application or enforcement.

One of the principles in national marriage law that is in line with religious teachings is to make divorce difficult (divorce), because divorce means the failure of the purpose of marriage to form a happy and eternal family due to human actions. The problem in this reshearch is how is the regulation of the implementation of divorce in the Religious Court, what is the effect of the divorce law on the grounds of lesbian behavior of a wife, how is the consideration of the judge in the Ambon Religious Court decisionNumber 110 / Pdt.G / 2016 / PA Ab. As a result of divorce law on the grounds that the lesbian behavior of a wife is related to child custody. The legal effect on marital property is that joint property is divided according to the provisions of the respective laws, laws, religion and customary law, while the inheritance remains controlled by each of the wives and divorced husbands. With regard to debt due to termination of marriage due to divorce borne by both parties with conditions that must be met where the rights and obligations of husband and wife are balanced in their authority to carry out legal actions. Judge's consideration in the decision of the Ambon Religious Court Number 110 / Pdt.G / 2016 / PA Ab in the case of sexual disorders (lesbians) immediately considers that this is in accordance with the provisions in Article 39 paragraph 2 of Law Number 1 of 1974 along with the explanation in letter e and letter f juncto Article 19 letter f Government Regulation Number 9 of 1975, Article 116 letter e and letter f Inpres No. 1 of 1991 concerning the Compilation of Islamic Law (KHI).

The purpose of this study was to: 1) analyze the position adopted child's inheritance rights in Islamic Law Compilation (KHI). 2) to analyze the implementation of the division of property as inheritance to an adopted child Compilation of Islamic Law (KHI). 3) Analyze the legal consequences of the implementation of the division of property as inheritance to an adopted child Compilation of Islamic Law (KHI).This study was prepared using the type of normative juridical research, the research focused on reviewing the application of the rules or norms of positive law. This study uses the approach of legislation (statute approach) And the approach of the case (case approach). The data collection was obtained by interview and literature. Analysis of data using qualitative descriptive.The research results are: 1) Position Adopted in the Compilation of Islamic Law that adopted children may not be recognized to be the basis and cause of inherited, because the basic principle in Islamic inheritance law is their blood relations / nasab / descent. So as the solution according to Islamic law compilation is by jalam Award "was borrowed" on condition should not be more than 1/3 (one third). 2) The division of property as inheritance to an adopted child Compilation of Islamic Law (KHI) must meet two requirements that are required to accept the will not the beneficiary, the person who died both the grandfather and the grandmother has not provided to the child that must be made a will, the amount with other roads, such as grants for example, and if he has less than the sum was borrowed, then it should enhanced the will. 3) The role of the Notary in deed was borrowed for a foster child is doing what desired heir and explain all that heir to all the heirs, it is intended to provide clarity and legal certainty for all heirs of things execution of wills which heir to all his heirs.Keywords: Inheritance, Adopted, Compilation of Islamic Law.

Namun, untuk melayani dan memenuhi kebutuhan hukum umat Islam terkait perawatan anak, Pengadilan Agama, atas permintaan seseorang yang mengadopsi anak berdasarkan hukum Islam, dapat mengeluarkan keputusan tentang adopsi dalam hal anak yang bersangkutan sebagai bukti penyelesaian kehendak harus diatur dalam Kompilasi hukum Islam Pengadilan Agama. Akibatnya, hak dan kewajiban orang tua yang mengadopsi anak dengan hukum Islam memiliki karakteristik khusus yang berbeda dengan hak dan kewajiban orangtua yang mengadopsi anak tanpa hukum Islam.

Juridical, theological, and philosophical differences in religion are one of the challenges for someone to become an heir. On the other hand, empirically historical-sociological is not the case, because there are reasons (illat) or other related to different religions to get the inheritance of Muslims who inherit using welfare factors. This research uses the normative legal research method. The author uses Gustav Radburch's theory of legal objectives governing justice, expediency, and legal certainty. Based on the results of the research found in the compilation of Islamic law is not available to the heirs who have been given apostasy. Religious differences as a barrier to inherit are specifically intended for heirs. So it can be concluded that Muslim heirs can inherit the assets of non-Muslim heirs, but not vice versa. In this study, non-Muslim heirs cannot inherit wealth from Muslim heirs, in order to fulfill a sense of justice and respect, these non-Muslim experts still obtain inheritance through mandatory wills which are processed through court determination. The will is obliged to be determined as a way out of giving the inheritance to non-Muslim heirs because the heir has died, and there is no other way to be able to transfer the heir's assets to the non-Muslim heirs.

Religious differences are one of the things that can cause a person to not be able to receive inheritance. Similarly, as stated by Rasullah SAW. Badung religious court judges view that the Hadith is only a suggestion, not an order. In the hadith, it is not clear what infidels are not allowed to receive inheritance. While the Prophet Muhammad always distinguishes someone's disbelief class. In the verses of the Holy Qur'an does not emphasize the prohibition of inheriting mutual inheritance for heirs of different religions. The contents of the Compilation of Islamic Law also do not regulate exactly about inheritance rights for non-Muslim family members. So far it is still a hot topic that is always debated among Ulama and the community. Based on this problem, the Badung Religious Court through its stipulation Number: 4/Pdt.P/201/PA.Bdg dated 7 March 2013 made a breakthrough in Islamic inheritance law, namely establishing Muslims as heirs of apostate heirs, as well as providing part of inheritance in forms of wills are mandatory for heirs of different religions. The formulation of the problem in this study is How is the legal logic of the Judge in the determination of Number: 4/Pdt. /2013 PA.Bdg dated 7 March 2013 related to the settlement of cases of inheritance of different religions and the application of mandatory wills as a way out? This research uses normative legal research methods. The author uses Gustav Radburch's legal goals theory which includes justice, expediency, and legal certainty. Based on the results of the study found that in the compilation of Islamic law does not regulate to whom the heir property that has lapsed can be given. Demikian seperti yang dihadistkan Rasullah SAW. Majelis Hakim pengadilan agama badung memandang Hadist tersebut hanya bersifat anjuran, bukan suatu perintah. Di dalam hadist tersebut tidak diperjelas lagi kafir yang bagaimana yang tidak diperbolehkan menerima harta warisan. Sementara Nabi Muhammad SAW selalu membedakan golongan kekafiran seseorang. Didalam ayat suci Al-Qur’an tidak menegaskan larangan saling mewarisi bagi ahli waris yang berbeda agama. Kandungan Kompilasi Hukum Islam, juga tidak mengatur secara pasti mengenai hak kewarisan bagi anggota keluarga non muslim. Sehingga sampai saat ini masih menjadi topik hangat yang selalu diperdebatkan di kalangan Ulama dan masyarakat. Atas permasalahan inilah maka Pengadilan Agama Badung melalui penetapannya Nomor: 4/Pdt.P/2013/PA.Bdg tanggal 7 Maret 2013 melakukan terobosan terhadap hukum kewarisan Islam, yaitu menetapkan orang muslim sebagai ahliwaris dari pewaris yang telah murtad, serta memberikan bagian harta warisan dalam bentuk wasiat wajibah kepada ahliwaris yang berbeda agama. Rumusan masalah dalam penelitian ini adalah Bagaimana logika hukum Hakim dalam penetapan Nomor: 4/Pdt.P/2013 PA.Bdg tanggal 7 Maret 2013 terkait penyelesaian kasus waris beda agama dan penerapan wasiat wajibah sebagai jalan keluarnya? Penelitian ini menggunakan metode penelitian hukum normatif. Penulis menggunakan teori tujuan hukum Gustav Radburch yang mencakup keadilan, kemanfaatan, dan kepastian hukum. Berdasarkan hasil penelitian ditemukan bahwa didalam kompilasi hukum Islam tidak mengatur kepada siapakah harta pewaris yang telah murtad dapat diberikan. Perbedaan agama sebagai penghalang untuk dapat mewarisi adalah khusus ditujukan kepada ahliwaris. Jadi dapat disimpulkan bahwa ahliwaris muslim dapat mewarisi harta pewaris non muslim, tetapi tidak sebaliknya. Dalam penelitian ini, meskipun ahliwaris non muslim tidak dapat mewarisi harta dari pewaris muslim, demi memenuhi rasa keadilan dan rasa kemanusiaan, ahliwaris non muslim tersebut tetap mendapatkan harta warisan melalui wasiat wajibah yang prosesnya berdasarkan penetapan pengadilan. Wasiat wajibah ditetapkan sebagai jalan keluar dalam pemberian harta warisan kepada ahliwaris non muslim karena pewaris telah meninggal dunia, dan tidak ada cara lain untuk dapat mengalihkan harta pewaris kepada ahliwaris yang non muslim.

This article aims to identify and analyze the urgency and future of fiqh legislation for halal products in Indonesia. In addition, this article also aims to identify and analyze whether Law no. 33 of 2014 concerning the Guarantee of Halal Products is the result of authoritarianism in the name of Islamic law in Indonesia or is a constitutional guarantee for the majority of Muslims. The conclusion of this study shows that the effort to enact the jurisprudence of halal products through the Halal Product Guarantee Law is a constitutional necessity for Indonesian citizens who are predominantly Muslim. The regulation of halal certification in the Halal Product Guarantee Law is a form of legal certainty and constitutional protections for the majority of Muslims as consumers in Indonesia. In addition, the existence of the Halal Product Guarantee Law is also considered to provide benefits economically, socially, and healthily, which applies universally regardless of religion. Even the accusation that the Halal Product Guarantee Law is a product of authoritarianism that harms non-Muslims cannot be justified. Because the producers of food and medicine that are widely circulating in supermarkets and mini-markets in Indonesia are actually non-Muslim owners. Even with this halal certification, their products can enter the world market, especially in Muslim countries.

This article discusses the practice of changing waqf for socio-educational purposes. The jurists of the fiqh schools argue over the permissibility of exchanging waqf land. As a country where the majority of the population is Muslim, Indonesia has made the guidelines for waqf which are stated in the law. No. 41 of 2004 concerning Waqf, Government Regulation Number 42 of 2006 concerning the implementation of law number 41 of 2004, and the Compilation of Islamic Law in Indonesia. This study is field research conducted in Keniten Village, Kedungbanteng District, Banyumas Regency. This study concluded that the exchange of waqf land in this village was in accordance with the purpose of the waqf and in accordance with the law. No. 41 of 2004 Article 41 paragraph (3). The process of changing donated land for TK Diponegoro 136 is in accordance with Government Regulation Number 42 of 2006 concerning the implementation of law number 41 of 2004. Meanwhile, the relation of Islamic law to the exchange of waqf land in Keniten Village, Kedungbanteng District, Banyumas Regency is debated in accordance with the rules used by each jurisprudence school. Referring to the argument of jalb al-maṣāliḥ wa dar 'al-mafāsid, the exchange of waqf land in Keniten Village, Kedungbanteng District, Banyumas Regency is not against Islamic law because it brings more benefits.

Gorontalo has a customary principle derived from sharia law, and the sharia law is sourced from the Qur'an, hadith, ijmak and qiyas (adati-hula'a to syara'a, syara'a hula'a to Kitabi), which should reflect the existence of the implementation of the distribution of inheritance in Islam in the Gorontalo community. This customary principle can be a source of law if it is a rational act, not immorality, done always repeatedly, does not bring harm and does not conflict with the law of sharak. But in reality there is the implementation of inheritance that violates Islamic law, namely the distribution by way of deliberation, the determination of the amount of heirs equally, the delay in the distribution of inheritance, wills with houses given to girls, wills not to distribute inheritance, distribution of assets it depends on the will of the heir and the delay in the distribution of inheritance on the grounds that one of the parents is still alive. The distribution by deliberation and determination of the amount of the portion for each heir are equally acceptable as long as they follow the guidelines of the Compilation of Islamic Law article 183 and the concept of takharruj which was previously preceded by the Shari'a division. After the heirs know the size of the portion, then they may agree to share it in their own way or leave the inheritance according to Shari'a and agree to give to each other with other heirs.
