Interception on the High Seas in the Context of Peace and Security: The Right of Visit in Cases of Armed Conflict and Security Council’s Action

Abstract Since the number of intricate problems with regard to peace and security faced by mankind on our sphere has been greater than what they can bear, the survival of human race on earth becomes a significant priority to be contemplated. Despite hard work and continued effort rendered by many experts, they face more serious issues and their resolutions are far from reality. It is because, in the author’s mind, rights and responsibilities are not properly observed. Particularly, in the area of religion people have lack of respecting the right of others and most of the times they are irresponsible. Every individual has their own choices according to their culture and belief which may not be acceptable to others. If every individual allows others to enjoy at their own choice while observing his own belief and tradition, we all can live in this world peacefully. This concept of living together with individual choice while respecting other’s choice may be called the concept of “agree to disagree” according to the author’s work. This ideology, which is yet to be well observed in our society, can surely replace violence with peaceful co-existence in the multi-religious and multi-cultural societies.   Keywords: Agree to Disagree, Mankind, Religious Dispute, Multi-Cultural Societies, peaceful Co-Existence. Abstrak Sejak masalah berkaitan dengan keharmonian dan keselamatan yang dialami manusia melebihi yang boleh ditanggung, kehidupan manusia di dunia ini menjadi satu keutamaan  yang perlu dipertimbangkan. Walaupun banyak usaha dan langkah diambil oleh pihak pakar, mereka mengalami masalah lain yang lebih serius dan resolusi mereka adalah jauh dari matlamat. Ini kerana, dalam minda pengarang, hak dan tanggungjawab tidak diperhatikan dengan betul. Terutamanya dalam hal agama, orang kekurangan kehormatan terhadap hak orang lain dan kebanyakkannya adalah tidak bertanggungjawab. Setiap individu mempunyai kepercayaan dan hak masing-masing yang tidak boleh diterima oleh yang lain. Jika setiap individu membenarkan yang lain untuk mempunyai kepercayaan dan hak masing-masing, manusia semua boleh hidup dengan aman. Konsep ini boleh dipanggil sebagai konsep “setuju untuk tidak bersetuju” menurut kajian pengarang. Ideologi ini, yang masih belum diperhatikan dengan sepenuhnya dalam masyarakat kita, pasti boleh menggantikan keganasan dengan kehidupan aman bersama dalam masyarakat berbilang kaum dan budaya. Kata Kunci: Setuju untuk Tidak Bersetuju, Manusia, Pertikaian Agama, Masyarakat Berbilang Agama, Kehidupan Aman Bersama.

There is a difference between a State’s substantive and procedural right to life obligations. This chapter explores what amount to a state’s substantive right to life obligations with reference to Article 2, ECHR and Article 6, ICCPR. The respective provisions are analysed to determine the extent of a state’s substantive right to life obligations during armed conflict and then a comparison between the two international law instruments is undertaken. In order to undertake such a comparison, the exceptions to the right to life in both the ECHR and ICCPR are examined. Once determined, the planning and conduct of a military operation are considered, to assess the extent to which, in general terms, right to life obligations are considered in these areas.

Most armed conflict today takes place within urban terrain or within an urbanised context. An extreme variant of such armed conflict is violence perpetrated by external state and non-state forces within the city, known as urbicide. Urbicidal violence deliberately strives to kill, discipline or deny the city to its inhabitants by targeting and then reordering the sociomaterial urban assemblage. Civil resistance within urbicidal violence seeks to subvert the emerging alternative sovereign order sought by such forces. It does so by using the inherent logic of the city in order to maintain/restore the community's social cohesion, mitigate the violence, affirm humanity, and claim the right to the city. This paper investigates the city-logic of civil resistance through examples drawn from the recent urbicidal experiences of Middle East cities such as Gaza, Aleppo, Mosul, and Sana'a. Theoretical insights from the conflict resolution literature, critical urban theory, and assemblage thinking inform the argument.

The article studies the concept of human security (hs) as embraced by the un General Assembly and Secretary Generals, and its instrumentality in the promotion of a customary international crime of global terrorism. Such a crime exists in the opinion of the Appellate Chamber of the Special Tribunal for Lebanon. Regarding terrorism in international criminal law (icl), not in armed conflict, I maintain that the concept of hs has been pivotal in furthering the “criminalisation” of terrorism in matters peace and security. I submit that (i) that the absence of a universally agreed upon definition of (global) terrorism does not suffice to detract from the finding that such a transnational crime exists, and (ii) in addition to the various and largely agreed constitutive elements of customary law, normative paradigmatic developments – here in the case of terrorism, and in the past two decades – have significantly supported this customarisation trend.

Operational reporting from the Middle East indicates that the exercise by warships of a right of visit on the high seas, in order to verify the flag of the boarded vessel, is an important part of contemporary maritime enforcement operations. However, this reliance on ‘flag verification boardings,’ pursuant to Article 110 of the United Nations Convention on the Law of the Sea 1982, challenges the proper balance of law enforcement authority against the traditional freedom of navigation. It is therefore necessary to establish clearly for both civilian masters and warship commanders where the evidentiary threshold for reasonable doubt as to the nationality of vessels lies, so as to justify non-consensual visit and search by a foreign warship. This article makes an objective, evidence-based assessment of the threshold, concluding with a caution against over-stretching the right of visit to accommodate law enforcement purposes not envisaged in the drafting of Article 110.

Le présent article fait état d’un questionnement sur l’état actuel du rôle des normes juridiques émanant du système de droit international humanitaire (DIH) en ce qui a trait au droit à la réparation, en prenant soin de mettre la personne en tant que victime de la guerre au centre de notre réflexion. En considérant la notion de réparation sous l’angle de la victime comme un tout à décrire et à analyser, nous cherchons à savoir s’il existe un droit à la réparation que possède la victime d’un conflit armé régi par le droit international humanitaire. Le fondement même de cette recherche s’appuie donc sur le cadre normatif conventionnel du DIH régissant la notion de réparation, que cette dernière accorde ou non un droit à une victime.This paper presents a series of questions on the present state of the role of judicial standards arising from the system of international humanitarian law [IHL] as regards the right to compensation, by making it a point to place the person as a war victim at the center of our reflection. In considering the concept of compensation from the angle of the victim as a whole, we seek to know whether there exists a right to compensation to which the victim of an armed conflict governed by international humanitarian law is entitled. The very foundation of this research is thus based on the conventional normative framework of IHL governing the concept of compensation, whether or not it grants a right to a victim.

The Right Honourable Sir Kenneth Keith was the fourth speaker at the NZ Institute of International Affairs Seminar. In this article he describes and reflects upon the role of courts and judges in relation to the advancement of human rights, an issue covered in K J Keith (ed) Essays on Human Rights (Sweet and Maxwell, Wellington, 1968). The article is divided into two parts. The first part discusses international lawmakers attempting to protect individual groups of people from 1648 to 1948, including religious minorities and foreign traders, slaves, aboriginal natives, victims of armed conflict, and workers. The second part discusses how from 1945 to 1948, there was a shift in international law to universal protection. The author notes that while treaties are not part of domestic law, they may have a constitutional role, be relevant in determining the common law, give content to the words of a statute, help interpret legislation which is in line with a treaty, help interpret legislation which is designed to give general effect to a treaty (but which is silent on the particular matter), and help interpret and affect the operation of legislation to which the international text has no apparent direct relation.
