América Latina e Africa compartilham de um passado histórico comum em relação ao processo de colonização e seus efeitos até hoje entidos no campo socioeconômico e cultural. A partir desse contexto nasce no final da década de 1970 a “Cooperação Sul-Sul”, com o objetivo de promover o desenvolvimento conjunto entre países com economia emergente que compartilham obstáculos e desafios comuns. Mais recentemente, o Brasil vem se destancando como um país-chave na filosofia cooperativa, com iniciativas que ultrapassam o campo meramente econômico. Este artigo pretende explorar a possibilidade de um intercâmbio cooperativo também no campo jurídico formal, em particular a partir do exemplo da Constituição Brasileira de 1988 que posicionou os direitos humanos como eixo central do ordenamento jurídico vigente.

Introduction. At the present stage of development of the world political process, one of the main problems has been to ensure the effective operation of human rights protection mechanisms, both at the national and international levels. The main vocation of legal science in this area is to provide expert assessments of problematic issues and scientifically developed recommendations for improving the mechanisms of human rights protection in modern international relations and especially in crisis situations that have become almost permanent in the life of the world community. The purpose of this publication was to implement a retrospective analysis of the evolution of the development of legal consolidation of human rights at the international level and the thorny problems in this area. Summary of the main research results. Thus, this publication considers the main stages of human rights, highlights the main problems of development, outlines the place of human rights in modern international relations and presents the main characteristics of the challenges facing states in the implementation of cooperation in the field of human rights. Finding the specifics of human rights and identifying mechanisms for their formation is a separate problem for jurists. The legal aspect of enshrining human rights in international legal instruments is important in the context of modern reality. It is through the disclosure of this issue that it is possible to identify the main stages of the evolution of the consolidation of human rights in international law. Conclusions. The development of international legal consolidation of human rights has significantly influenced the evolution of international law as a whole. Under the influence of these processes, national sovereignty, as a basic principle of international law, began to take on new forms, and the individual acquired many features of international legal personality. Thanks to non-state rule-making, the sphere of consolidation and protection of human rights tends to self-development and constant adaptation to the changing needs of society in the social and moral spheres. Human rights are a cultural phenomenon that reflects the system of value orientations of a person rooted in a particular historical epoch and depends on the ideology of the world legal community. The problem of human rights, their protection from external and internal threats requires an immediate solution, making it a priority to consider legal issues among a wide range of global problems of mankind. At the same time, it must be emphasized that the democratic development of modern society and human rights are inextricably linked. This connection also implies that human rights must be recognized as legitimate as a result of democratic procedures, but outside the national legal systems there is a moral justification necessary to convince the subjects of international law that everyone, even outside the national legal system must enjoy all guaranteed rights and freedoms.

Human rights have been firmly enmeshed in both studies and practice of international relations. The prevailing theories of international relations describe the function of those rights in substantially dissimilar ways, and it is apparent that their key statements include compelling arguments, suggesting an inconvenient apposition of state sovereignty with ideas of universal moral order. The development of the universal human rights regime of the United Nations (UN), the growth of international non-governmental organizations (NGOs), and, eventually, human rights activists have made it possible for human rights to be more deeply incorporated into state diplomatic activities.  These trends, however, raise critical concerns about the practice of the state of human rights. Although there is some reversal of the norm, however, states continue to face humanitarian crises and show signs of human rights protection domestically and promotion internationally to varying degrees. In the same way, we are also seeing a major change in the principles and procedures of international enforcement of human rights. The goal of this paper is to address briefly certain variables relevant to the incorporation of human rights in international relations.


The subject of our research will be international protection as it is a theoretical concept, far from the practical meaning that relates to the international conventions and declarations on the protection of human rights and the mechanisms associated with them. It must now evolve only after long periods of time, and with timid beginnings, in this study we must address the stages in the development of international protection. Since international protection-in the sense that this research deals with - concerns international affairs, it has been affected by the development of international relations and similar problems, so this study will also address those problems, which have hindered the development of international protection within the methodology of comparative analysis.

The state of international relations and the effort of international public actors and non-state entities to adopt new rules to govern their relationships by balancing human rights protection, human development and economic business growth is at stake. The creation of new legal frameworks to introduce innovative concepts and to regulate the interaction among traditional and innovative actors is not an easy task: it demands from States and International Organizations a proper determination and patience to preserve original legal features while advancing different notions and operational tools to found special regimes and disciplines which could be mutually and complementary reinforcing. The contribution aims at debating legal concepts, different stakeholders, renewed procedures that have emerged in the global scenario and that need for appropriate and applicable international rules for a challenging governance.

Purpose. The purpose of the article is to analyze the Universal Declaration of Human Rights as an international legal instrument, which for the first time formulated the foundations of modern democratic status of a human being and its fundamental rights and freedoms. Methodology. The methodology involves a comprehensive study of theoretical and practical material on the subject, as well as a formulation of relevant conclusions and recommendations. During the research, the following methods of scientific cognition were used: dialectical, terminological, formal and logical, systemic and functional. Results. The study found that the main features of the Universal Declaration of Human Rights as a source of international legal mechanism for the protection of human rights are: 1) it is a fundamental, foundational and universal international human rights act of the United Nations; 2) it establishes a system of fundamental human rights; 3) it defines a common system of fundamental international human rights standards; 4) it determines the principles of legal identity of a human being; 5) it determines the fundamental basis and principles of international legal regulation in the field of human rights protection; 6) it acts as an international legal basis for the adoption of the latest legislation on human rights protection; 7) it acts as an international legal basis for the codification of human rights legislation. Scientific novelty. The study found that the Universal Declaration of Human Rights points to the natural origin of human rights, which must be binding on all States and for the whole population, regardless of citizenship, in order to ensure the human rights protection in a democratic and rule-of-law State. Practical importance. The results of the study can be used to improve Ukrainian legislation on human rights and fundamental freedoms.

Conceptions And Interpretations of Human Rights in Europe and Asia: Normative AspectsThe issue of confronting values between civilizations has become very important. It influences not only the level of international politics but also the international normative activity. It is very interesting for the modern international law and its doctrine. The most important factor of causing huge changes in the system of international law is still the international human rights protection and the international humanitarian law which is related to it. It is very difficult to create one catalogue of executive instruments and procedures but it is possible to influence the attitude toward the basic paradigms. The frictions appear from time to time and move to other planes. The West and Asia are still antagonists in the dialogue on the future of the world. The article is a contribution to the intercivilizational dialogue.

This article intends to analyze in the context of the complexity of the process of internationalization of human rights, the definitions and tensions between cultural universalism and relativism, the essence of human rights discourse, its basic norms and an analysis of the normative dialogues in case decisions involving violations of human rights in international tribunals such as the European Court of Human Rights, the Inter-American Court of Human Rights and national courts. The well-established dialogue between courts can bring convergences closer together and remove differences of opinion on human rights protection. A new dynamic can occur through a complementarity of one court with respect to the other, even with the different characteristics between the legal orders.

ResumenLa desaparición forzada de los estudiantes normalistas ocurrida en septiembre de 2014 en las cercanías de la localidad mexicana de Ayotzinapa es una tragedia que, además de captar la atención de la prensa internacional, ha activado el funcionamiento de algunos mecanismos del sistema interamericano de protección de los derechos humanos. Este trabajo pretende analizar de qué manera la creación del Grupo Interdisciplinario de Expertos Independientes (GIEI) puede incidir en la determinación de la responsabilidad internacional del Estado Mexicano por el incumplimiento de los estándares internacionales interamericanos sobre prevención, investigación y sanción de la desaparición forzada. En aquel sentido, este trabajo se dividirá en tres secciones. En la primera de ellas se describirán brevemente los hechos, a fin de demarcar el contexto fáctico a partir del cual se reflexionará. La segunda sección hará referencia a la creación del GIEI en el marco de las medidas cautelares adoptadas por la Comisión Interamericana de Derechos Humanos (Comisión IDH) en este caso. Nesse sentido, este trabalho será dividido em três seções. No primeiro deles, os fatos serão brevemente descritos, a fm de demarcar o contexto factual a partir do qual será refletido. A segunda seção referirá a criação do GIEI no marco das medidas cautelaresadotadas pela Comissão Interamericana de Direitos Humanos (Comissão IDH) no presente caso. This work aims to analyze in which ways the creation of the Interdisciplinary Group of Independent Experts (GIEI) can underscore the determination of the international responsibility of the Mexican State for the non-compliance of the Inter-American international standards on prevention, investigation and punishment of the enforced disappearance. In that sense, this paper will be divided in three sections. The frst one will briefly describe the facts, to demarcate the factual circumstances from which it will be reflected. The second section will address the creation of the GIEI within the framework of the precautionary measures adopted by the Inter-American Commissionof Human Rights (IACHR) in this matter. The third and last section will evaluate whether the general obligations to respect and ensure human rights have been violated in this case, focusing on the specifc duties of prevention and investigation.Keywords: Ayotzinapa, Interdisciplinary Group of Independent Experts, Inter-American Commission of Human Rights, forced disappearance.
