Постановка задачи. Градорегулирование в зонах затопления, подтопления является одной из самых актуальных проблем для российских регионов. Цель данной работы - дать понятие градостроительного регулирования в зонах затопления, подтопления, рассмотреть правовой режим этих зон, раскрыть существующие проблемы градорегулирования в зонах затопления, подтопления и дать предложения по их устранению, а также совершенствованию действующего законодательства. Результаты. Установлено, что градорегулирование является эффективным методом по предотвращению и устранению негативных последствий в зонах затопления, подтопления. Выявлен ряд проблем в градорегулировании, устранение которых позволит повысить эффективность предотвращения и устранения негативных последствий в зонах затопления, подтопления. Предложены пути решения обозначенных проблем градорегулирования. Выводы. Современные методы снижения ущерба от опасных гидрологических явлений, включая наводнения, требуют перехода от стратегии индивидуальной защиты объектов к комплексной системе мер, которая включает в себя прежде всего нормативно-правовое регулирование данного вопроса и ответственность за несоблюдение установленных норм и правил. Именно такой подход является необходимым элементом обеспечения стабильного экономического развития Российской Федерации, безопасности жизнедеятельности граждан и создания комфортных условий проживания. Statement of the problem. Urban regulation in areas of flooding is one of the most pressing problems for Russian regions. The purpose of this work is to give the concept of urban planning regulation in areas of flooding, flooding, to consider the legal regime of zones of flooding, flooding, to reveal the existing problems of urban regulation in areas of flooding and partial flooding, and to give guidelines for their elimination and improvement of the current legislation. Results. It is established that city regulation in areas of flooding and partial flooding is an effective method for preventing and eliminating negative consequences in areas of flooding and partial flooding. A number of problems has been identified in urban regulation in areas of flooding and partial flooding, the elimination of which will increase the effectiveness of prevention and elimination of negative consequences in areas of flooding and partial flooding. The ways of solving the indicated problems of urban regulation are set forth. Conclusions. Modern methods of reducing damage from hazardous hydrological phenomena, including floods, require a transition from a strategy of individual protection of facilities to a comprehensive system of measures, which includes, most importantly, a legal regulation of this issue and responsibility for non-compliance with established norms and rules. It is this approach that is a necessary element of ensuring the stable economic development of the Russian Federation, the safety of citizens' and the creation of comfortable living conditions.

<p>Parametric tools have been broadly implemented in Architecture, Engineering and Construction (AEC) industry. Recently, an increasing volume of research finds that parametric tools also have the capability to facilitate large-scale planning and urban design. Much of this research, however, focuses on parametric representation or environment simulation. There is insufficient research about using parametric tools to enhance urban regulation. Parametric tools can provide smart design procedures by integrating strategies, solutions and expressions in one system. They may allow alternative approaches to urban regulation that conventional tools do not process.  This research aims to create a parametric modelling system to aid urban regulation. The system offers a visualised coding interface to manipulate parameters and achieve interactive performance feedback at the early stage of urban regulation. Form-Based Code uses the modelling system in this research. It generates a specific morphology by controlling physical form with less focus on land use. With the rise of New Urbanism, Form-Based Code has been used in various American regulation projects. This research extends the application of Form-Based Code, adopting it for urban-peripheral environments outside of the USA. High-density cities where provide the volumetric morphology context is important for this work. Tsim Sha Tsui area of Hong Kong works as an experimental site.  The feasibility of parametric urban regulation is examined by developing a parametric modelling system for Form-Based Code in Hong Kong. Understanding the site’s form characteristics, the transect matrix of Form-Based Code is expanded by incorporating multi-layered zone types and regulating plans. Embedding the zones into parametric modelling software Rhinoceros 3D and Grasshopper 3D, a regenerative prototype works to create real-time scenarios responding to parameters, rules and geometry constraints. The results of parametric urban regulation are evaluated by both Form-Based Code standards and local urban regulation standards to assess its feasibility in context.  This research demonstrates that the parametric modelling system for Form-Based Code has both technological and implemental potential to work as an alternative approach to urban regulation, especially in complex developments. Form complexity is a reflection of sophisticated human-society systems and the sequential evolution of a dynamic morphology. Form-Based Code is enhanced by the parametric modelling system to describe and regulate form complexity in a logical manner. Additionally, although parametric Form-Based Code processing is based on the original Form-Based Code, it is not limited to that. Describing urban regulation with visualised models bridges specialists and the public in community demonstrations and code assembling. The parametric modelling system has a positive impact on resolving challenges, predicting outcomes, and applying urban regulation innovation to the volumetric morphology of high-density cities in Asia.</p>

ResumoO presente artigo tem por objetivo realizar uma análise crítica do Projeto de Lei n. 428/2019, do Município de São Paulo, que tem por objeto estabelecer objetivos, diretrizes, estratégias e mecanismos para a implantação do Projeto de Intervenção Urbana Vila Leopoldina-Villa Lobos e cria a Área de Intervenção Urbana correspondente, naquele município. Para tanto, disserta inicialmente sobre a natureza e o conteúdo dos denominados “Projetos de Intervenção Urbana”, previstos na Lei Municipal n. 16.402/2014, o Plano Diretor Estratégico de São Paulo, delimitando suas finalidades e possibilidades de atuação. Após, analisa criticamente os dispositivos do apontado projeto de lei, tecendo considerações pertinentes às novidades em termos de proposta de regulação urbanística em si estabelecidos. O resultado do trabalho é a constatação de uma abordagem inovadora e diferenciada da instrumentação jurídica prevista no projeto de lei, já que elaborada de forma a atender especificamente aos termos de um projeto urbanístico derivado do plano diretor, ao mesmo tempo em que proporciona a implantação da política de desenvolvimento urbano nele previsto.Palavras-chave: Direito urbanístico. Regulação Urbanística. AbstractThe purpose of this article is to carry out a critical analysis of the mains aspects of Draft Law no. 428/2019, of the municipality of São Paulo City, whose purpose is to establish objectives, guidelines, strategies and mechanisms for the implementation of the Vila Leopoldina-Villa Lobos Urban Intervention Project (Projeto de Intervenção Urbana Vila Leopoldina-Villa Lobos) and create the corresponding Urban Intervention Area (Área de Intervenção Urbana) in that municipality. In order to do so, it first discusses the nature and content of the so-called "Urban Intervention Projects", provided for in Municipal Law n. 16,402/2014, the Strategic Master Plan of São Paulo (Plano Diretor Estratégico), delimiting its purposes and possibilities of action. Afterwards, it critically analyzes the provisions of the aforementioned bill, weaving considerations pertinent to the novelties in terms of the proposal of urban regulation itself established. The result of the work is the finding of an innovative and differentiated approach to the legal instrumentation envisaged in the draft law, since it is designed in order to specifically meet the terms of an urban project derived from the master plan, while at the same time providing the implementation of the urban development policy envisaged.Keywords: Urban Law.
