Town Regulation of Negative Consequences in Areas of Flooding and Partial Flooding

Постановка задачи. Градорегулирование в зонах затопления, подтопления является одной из самых актуальных проблем для российских регионов. Цель данной работы - дать понятие градостроительного регулирования в зонах затопления, подтопления, рассмотреть правовой режим этих зон, раскрыть существующие проблемы градорегулирования в зонах затопления, подтопления и дать предложения по их устранению, а также совершенствованию действующего законодательства. Результаты. Установлено, что градорегулирование является эффективным методом по предотвращению и устранению негативных последствий в зонах затопления, подтопления. Выявлен ряд проблем в градорегулировании, устранение которых позволит повысить эффективность предотвращения и устранения негативных последствий в зонах затопления, подтопления. Предложены пути решения обозначенных проблем градорегулирования. Выводы. Современные методы снижения ущерба от опасных гидрологических явлений, включая наводнения, требуют перехода от стратегии индивидуальной защиты объектов к комплексной системе мер, которая включает в себя прежде всего нормативно-правовое регулирование данного вопроса и ответственность за несоблюдение установленных норм и правил. Именно такой подход является необходимым элементом обеспечения стабильного экономического развития Российской Федерации, безопасности жизнедеятельности граждан и создания комфортных условий проживания. Statement of the problem. Urban regulation in areas of flooding is one of the most pressing problems for Russian regions. The purpose of this work is to give the concept of urban planning regulation in areas of flooding, flooding, to consider the legal regime of zones of flooding, flooding, to reveal the existing problems of urban regulation in areas of flooding and partial flooding, and to give guidelines for their elimination and improvement of the current legislation. Results. It is established that city regulation in areas of flooding and partial flooding is an effective method for preventing and eliminating negative consequences in areas of flooding and partial flooding. A number of problems has been identified in urban regulation in areas of flooding and partial flooding, the elimination of which will increase the effectiveness of prevention and elimination of negative consequences in areas of flooding and partial flooding. The ways of solving the indicated problems of urban regulation are set forth. Conclusions. Modern methods of reducing damage from hazardous hydrological phenomena, including floods, require a transition from a strategy of individual protection of facilities to a comprehensive system of measures, which includes, most importantly, a legal regulation of this issue and responsibility for non-compliance with established norms and rules. It is this approach that is a necessary element of ensuring the stable economic development of the Russian Federation, the safety of citizens' and the creation of comfortable living conditions.

In connection with the adoption of the Federal Law of July 31, 2020 No. 258-FZ “On Experimental Legal Regimes in the Field of Digital Innovations in the Russian Federation” and of the Federal Law of July 31, 2020 No. 247-FZ “On Mandatory Requirements in the Russian Federation” (Article 13 “Experimental legal regime”) the topic of experimental legislation was updated. The article is devoted to the application of the experimental approach in legal regulation. The author reveals the essence of the concept of experimental legislation, explains the goals and objectives of using the appropriate technologies. The author notes that although in a broad sense it can be said that the adoption of any new law is in itself an experiment, there are still significant differences within the experimental law. The author sets out the essential features of a legislative experiment. The article examines the reasons for the need and prerequisites for the rationality of the use of experimental legislation. The author shows the nature of legislative experimentation and the merits of this toolkit. The author shows the areas of relevant application of the method of experimental legislation. The species diversity of methods of experimental regulatory regulation is indicated. The article compares the method of practical experimental legislation and the method of thought experiment in norm-writing and law- making activities. The article compares the method of practical experimental legislation and the method of digital duplicate-models of legislative acts. The author substantiates the existence of limits of applicability of the method of experimental legislation and demonstrates selected technologies of experimental legislation. In conclusion, the author turns to the complex and controversial problems of using the method of experimental legislation.

The study investigates the main approaches to understanding such legal categories as “legal regimes” and “special legal regime”, and provides their classification. Special legal regimes serve as the legal basis for restricting human and civil rights and freedoms; therefore, the relevance of the study of the concept, types, and main features of special legal regimes is beyond doubt. The authors of the study consider the relationship between the categories of special legal regime of a state of emergency and martial law, and describe the main grounds for their imposition. The authors noted a need for a clear, consistent legal regulation of the model of behaviour aimed at overcoming and eliminating negative consequences of an emergency and military nature. Attention is focused on the fact that in Ukraine, the regulation of public relations arising in connection with emergencies and military situations has become particularly important after the emergence of a military conflict on the territory of Ukraine and the spread of the COVID-19 virus. The study provides the author’s vision of the categories “legal regimes” and “special legal regimes”. it is proposed to interpret the legal regimes as the regulatory procedure, which is expressed in a set of legal means that describe a special combination of interacting permits, prohibitions, and obligations, while implementing a special focus of regulation. The latter should be interpreted as a form of public administration that makes provision for the restriction of the legal personality of individuals and legal entities, introduced as a temporary measure provided by means of administrative and legal nature, and aimed at ensuring the security of the individual, society, and the state. The study provides the classification of special legal regimes and contains proposals to distinguish them according to the content and basis of occurrence as follows: state of emergency, martial law, state of siege, state of war, state of public danger, state of tension, state of defence, state of threat, state of readiness, state of vigilance

The authors comprehensively investigated theoretical and practical problems of legal regulation of agricultural land turnover in the Russian Federation. They analyzed the jurisprudence in the field of agricultural land turnover, examined the legal regime of agricultural land in the Russian Federation, investigated the peculiarities of land plots turnover from agricultural lands, identified a number of significant problems in the legislation in the field of legal regulation of agricultural purposes land turnover. It is difficult to overestimate the importance of land, which is a nonrecoverable natural resource. From this point of view, agricultural land has a unique unrepeatable natural fertility capacity that determines the possibility of producing life support products, being an essential component of the environmental system. In the annual Address to the Federal Assembly of the President of Russia in 2019, V.V. Putin, specifying the main directions of strategic development of the country, noted the high importance of the land legislation development. The peculiarities of the agricultural land plots turnover are due to the public nature of land relations regulation. For this category of land, a special legal regime is established for food security purposes of Russia, which leads to the prevention of removing these lands from agricultural circulation, as well as building development. According to articles 9, 36 of the Constitution of the Russian Federation, “land and other natural resources are used and protected in the Russian Federation as the basis for the lives and activities of peoples living on the the relevant territory” and the exercise of authority by land owners is limited to conditions for potentially damaging the environment and violation of rights and legitimate interests of other persons.

The development of the Russian Northern territories is not only a domestic problem of this country, but also a global one. The Polar region, which is also called the Arctic area, attracts many and requires concentration of all forces on the solution of the problem of its development in the economic, social, military and strategic dimensions. In proportion to these circumstances, the role of legal aspects in the developing and emerging social relations also increases. Legal regulation for these parts of the Russian Northern territories and adjacent waters of the Arctic Ocean, constituting the Arctic zone of the Russian Federation, requires certain uniformity. This can be achieved by improving public administration over the Arctic zone of the Russian Federation, legislative recognition of its special status and the establishment of special regimes for natural resources, environmental protection, regulation of navigation along the seaways of the Northern sea route. It involves the formation of a special management procedure, i.e. the formation of a special administrative-legal regime. This is a complex task that requires scientific understanding of the problems that have a significant impact on the formation of the administrative legal regime in the Arctic zone of the Russian Federation.

Introduction. The problem of ensuring equal scope of the right to palliative medical care of citizens living on the territory of various subjects of the Russian Federation is raised. The article describes the current legal regulation of palliative care in the Russian Federation and the existing problems of providing it. Purpose. The author aims to determine the place of legal regulation in the mechanism of ensuring the right to palliative medical care and ways to increase the degree of guarantee of this right. Methodology. Methods of analysis and synthesis, formal-logical and comparative-legal methods are used. Results. A brief overview of the current legal regulation at the Federal level and in the subjects of the Russian Federation is given, and the different scope of the right to palliative medical care of citizens living on the territory of different subjects of the Russian Federation is recorded. The article highlights the consequences of different approaches to the legal regulation of the issues under consideration, and suggests changes to them. Population by sex and age, the structure of its incidence and the degree of disability in subjects of the Russian Federation are not the same, and the bodies of state power of subjects of this level have the ability to define the needs of the population in the form of medical care that is consistent with the goal inherent in the activities of the bodies of state power of subjects of the Russian Federation in the field of social security, namely with regard to the influence of the specific features on the life of citizens and securing a reasonable differentiation of social security. Conclusion. It is concluded that it is necessary to fix the guarantee of palliative medical care in the normative legal acts of the subjects of the Russian Federation regulating the issues of public health protection, regardless of the territory of living, gender, age, diagnosis and stage of treatment.

The issues of legal regulation of investment activity at the level of the Federation entities of the Russian Federation have been considered. The purpose of the research is the study of strategic documents in the field of investment activities of the Federation entities of the Russian Federation and the regulatory framework. The object of the research is the mechanism of strategic planning of investment development of territories. An empirical study of the implementation of investment processes in Russian regions has showed, that legal regulation is heterogeneous, but in general, well presented and allows improving the investment climate and encouraging investment, as well as to some extent influencing the economic security of the regions. The experience of the functioning of specialized organizations to attract investment and work with investors, the organization of public-private partnership at the regional level has been studied. The algorithm of approval of investment projects of territorial development has been presented.On the example of a large Russian region - the Altai Territory - the provisions and principles of the investment declaration of the subject, such as equality of the subjects of entrepreneurial and investment activities, involvement of subjects of entrepreneurial and investment activities in the investment process, transparency (openness) of information, the use of best practices of work with investors have been considered. A set of internal measures and instruments for the implementation of an effective investment policy at the regional level has been determined. Attention has been paid also to the relevant issue of concluding concession agreements as a way to develop territories and implement infrastructure projects. Internal measures have been proposed to increase the investment attractiveness of the Russian regions, in particular, are necessary the transformation of the business climate, increasing the responsibility of regional executive authorities for the investment development of territories and creating a favorable investment climate, ensuring the availability of long-term financing sources for investment projects, the development of venture financing and crowdfunding.

The paper provides some results of a study of changes that have occurred in the labor markets of Russian regions during the "first" and "second" waves of the COVID-19 pandemic. In particular, it is shown that in 2020 — 2021 there were transformations in the structure of employment of the population of the Russian regions, for example, the number of vacancies in the industries that were most severely affected by the introduction of restrictive measures in the economy decreased, the unemployment rate increased significantly. The negative consequences of the pandemic in one way or another manifested themselves in all Russian regions. However, in a number of regions, which even before the pandemic showed an unstable dynamics of socio-economic development, the impact of the COVID-19 pandemic had a more significant negative impact. This indicates that during a pandemic, divergence processes have intensified in the national economy. At the same time, during the pandemic, some new forms of employment were developed, associated with the need to switch to a remote mode of work. We believe that these new forms of employment will remain relevant both in Russian and international practice even after the end of the pandemic. The paper also analyzes the main measures of state support for the population, small and medium-sized businesses, and migrants. It is shown that, in general, the measures of state support during the pandemic were timely and made it possible to avoid the collapse of the national economy. It is concluded that support measures should be more regionally differentiated in order to take into account the specifics of the economy of the regions of the Russian Federation.

Эволюция - это естественный исторический процесс развития, совершенствования, в том числе и основных государственных законов. Порядок пересмотра и внесения поправок - это процесс, который предусмотрен и происходит при конституционном становлении любого государства. Статья посвящена изучению характера некоторых поправок, внесенных в Конституцию Российской Федерации с недавнего времени. Кроме того, в статье проанализирована роль Конституции Российской Федерации как основного законодательного акта в стране, раскрыты основные принципы, изложенные в Конституции РФ и имеющие значение для внесенных поправок. Авторы отмечают, что внесение поправок в Конституцию РФ затронуло только содержание с третьей по восьмую главы, поскольку внесение изменений в первую, вторую и девятую главы Конституции РФ невозможно и влечет принятие новой Конституции страной. Тем не менее актуальность даже некоторых корректоров в основополагающем законодательном акте Российской Федерации обусловлена взаимосвязью всех положений Конституции, и после изменения хотя бы одной нормы Конституции неизбежно следуют некоторые поправки в иных нормах этого же акта. Далее авторы анализируют внесенные поправки относительно отображения в Конституции титульной нации. До недавнего времени данное положение отсутствовало, в отличие от положений конституций некоторых зарубежных государств, приводимых авторами в исследовании. Кроме того, отмечаются некоторые изменения преамбулы, которые нашли свое отражения в ст. 67 Конституции РФ, а также особенности установления идеологии на территории Российской Федерации. Относительно последнего авторы справедливо указывают, что, несмотря на запрет установления идеологии в стране, согласно внесенным поправкам в Конституцию РФ Российская Федерация должна придерживаться концепции патриотизма. В статье приводится точка зрения о нарушении порядка принятия поправок в Конституцию РФ, а также негативные последствия данного нарушения. В заключение авторы указывают, что, несмотря на особенности внесения поправок в Конституцию РФ, они тем не менее были реализованы, хотя и не решили существующих проблем в Российской Федерации. Evolution is a natural historical process of development, improvement, including the basic state laws. The procedure for revision and amendment is a process that is provided for and occurs during the constitutional formation of any state. The article is devoted to the study of the nature of some amendments made to the Constitution of the Russian Federation recently. In addition, the article analyzes the role of the Constitution of the Russian Federation as the main legislative act in the country, analyzes and reveals the basic principles set out in the Constitution of the Russian Federation and are relevant for the amendments made. In the study, the author correctly notes that the amendments to the Constitution of the Russian Federation affected only the content of the third to eighth chapters, since the introduction of amendments to the first, second and ninth chapters of the Constitution of the Russian Federation is impossible and entails the adoption of a new Constitution by the country. Nevertheless, the relevance of even some correctors in the main legislative act of the Russian Federation is conditioned by the interrelation of all the provisions of the constitution with each other and the change of at least one norm of the Constitution is inevitable by some amendments to other norms of the same act. Further, the author analyzes the amendments made regarding the inclusion of the titular nation in the Constitution, since this provision was absent until recently. This, in turn, cannot be said about some foreign countries, the provisions of whose Constitutions the author cites in the study. In addition, the author notes some changes in the preamble, which are reflected in Article 67 of the Constitution of the Russian Federation, as well as features of the establishment of ideology on the territory of the Russian Federation. Regarding the latter, the author rightly points out that despite the ban on the establishment of ideology in the country, according to the amendments to the Constitution of the Russian Federation, the Russian Federation should adhere to the concept of patriotism. The article presents the point of view about the violation of the procedure for adopting amendments to the Constitution of the Russian Federation, as well as the negative consequences of this violation. In conclusion, the author points out that despite the peculiarities of the amendments to the Constitution of the Russian Federation, they were nevertheless implemented, although they did not solve the existing problems in the Russian Federation.

Innovation policies are currently one of the main axes for improving the efficiency of national economies in developed and developing countries. The innovation policy includes a comprehensive system of activities. In Russia, increasing the specific weight of commercial entities engaged in innovative activities is among the most important objectives for the short term. The aim of our study was to evaluate the use of innovation based on taking into account the specific weight of organizations that perform innovations in the total number of organizations operating in the regions of Russia. Our study was based on official statistical information on the 82 regions of Russia for 2017-2019. Economic-mathematical models have been developed that describe the specific weight of the organizations that implement innovation. There are no significant changes in the indicators for the years indicated. It has been shown that, to date, almost one in five organizations in the Russian Federation has used innovation in their activities. In addition, they have identified the regions with maximum and minimum values of the specific weightings of innovative organizations for 2019.

The paper discusses certain issues related to the legal regulation of relations arising in the creation and operation of hydraulic structures as an element of water management systems. The relevance of the topic raised is due to the significant impact on the water body of any hydraulic structure created for the use of water resources. The paper shows the legal nature of the relationship between a hydraulic structure and a water body and the ways of reflecting this relationship in the rules of law governing relations on the use and protection of waters; the legal regime for the protection of hydraulic structures from the negative consequences of improper operation is studied. Based on an analysis of the current Russian legislation, the author concludes that there is a differentiated approach to the legal regulation of the relations in question. The provisions of water legislation and legislation on environmental protection are applied to a hydraulic structure as part of a water management system that affects a water body. To a technically complex object, the improper operation of which potentially poses a threat to human life, different provisions are applied, namely the provisions of legislation and a number of regulatory and technical safety acts.
