Communication, when defined as an act intended to affect the psychological state of another individual, demands the use of inference. Either the signaler, the recipient, or both must make leaps of understanding which surpass the semantic information available and draw from pragmatic clues to fully imbue and interpret meaning. While research into human communication and the evolution of language has long been comfortable with mentalistic interpretations of communicative exchanges, including rich attributions of mental state, research into animal communication has balked at theoretical models which describe mentalized cognitive mechanisms. We submit a new theoretical perspective on animal communication: the model of inferential communication. For use when existing proximate models of animal communication are not sufficient to fully explain the complex, flexible, and intentional communication documented in certain species, specifically non-human primates, we present our model as a bridge between shallower, less cognitive descriptions of communicative behavior and the perhaps otherwise inaccessible mentalistic interpretations of communication found in theoretical considerations of human language. Inferential communication is a framework that builds on existing evidence of referentiality, intentionality, and social inference in primates. It allows that they might be capable of applying social inferences to a communicative setting, which could explain some of the cognitive processes that enable the complexity and flexibility of primate communication systems. While historical models of animal communication focus on the means-ends process of behavior and apparent cognitive outcomes, inferential communication invites consideration of the mentalistic processes that must underlie those outcomes. We propose a mentalized approach to questions, investigations, and interpretations of non-human primate communication. We include an overview of both ultimate and proximate models of animal communication, which contextualize the role and utility of our inferential communication model, and provide a detailed breakdown of the possible levels of cognitive complexity which could be investigated using this framework. Finally, we present some possible applications of inferential communication in the field of non-human primate communication and highlight the role it could play in advancing progress toward an increasingly precise understanding of the cognitive capabilities of our closest living relatives.

Abstract This article examines the possible uses of comparative tort law in practice and theory. It takes the view that comparative law is always a means, never an end in itself, explains how it can be utilized by judges, legislatures, and legal scholars, and puts forward important caveats and qualifications. Part 2 demonstrates the traditional role of comparative law in interpreting and implementing shared or similar tort doctrines and in providing ideas for domestic tort law gap-filling and reform. It highlights the challenges that such utilization might present. Part 3 maintains that comparative research is the cornerstone of unification endeavors. Starting with coordinated projects, Part 3 argues that unification is in itself an instrument (making comparative law a second-order instrument) and that it cannot be pursued without taking into account some concerns about its desirability and practicability. Part 3 then discusses uncoordinated unification processes, whereby lawmakers in one jurisdiction identify a “global consensus” and decide to join it, and elaborates on the normative and positive components of these strategies. Part 4 acknowledges that comparative analysis usually uncovers trans-jurisdictional diversity and argues that such findings can underlie normative and positive theories of tort law. A comparison can offer a systematic taxonomy of possible legal solutions to a particular problem, enabling scholars to critically evaluate and compare the alternatives from their preferred theoretical perspective. Moreover, any hypothesis about the impact of cultural, economic, political, technological, and other conditions and changes on the law can be substantiated or refuted through comparative analyses that seek out legal differences (or similarities) among systems with different (or similar) underlying backgrounds. Through this analysis, the article aims to reignite and enrich the debate and inspire tort-law makers and scholars to integrate comparative research into their work.

Sketching methods offer computational biologists scalable techniques to analyze data sets that continue to grow in size. MinHash is one such technique that has enjoyed recent broad application. However, traditional MinHash has previously been shown to perform poorly when applied to sets of very dissimilar sizes. FracMinHash was recently introduced as a modification of MinHash to compensate for this lack of performance when set sizes differ. While experimental evidence has been encouraging, FracMinHash has not yet been analyzed from a theoretical perspective. In this paper, we perform such an analysis and prove that while FracMinHash is not unbiased, this bias is easily corrected. Next, we detail how a simple mutation model interacts with FracMinHash and are able to derive confidence intervals for evolutionary mutation distances between pairs of sequences as well as hypothesis tests for FracMinHash. We find that FracMinHash estimates the containment of a genome in a large metagenome more accurately and more precisely when compared to traditional MinHash, and the confidence interval performs significantly better in estimating mutation distances. Energy transition plays a central role in efforts to reduce anthropogenic global warming. However, energy transition involves physical manifestations, for example in the form of wind turbines, photovoltaic plants, and power lines, which trigger resistance, especially among those who live in the vicinity of the (planned) plants. The reasons for this resistance are complex, as they relate to residents’ emotional ties and/or stereotypical common-sense expectations of landscape. The complexity of landscape conflicts in general, and energy transition-related conflicts in particular, makes it difficult to capture the intricacy of the subject matter by means of a single theoretical perspective. To address this difficulty, a neopragmatic approach of identifying and combining appropriate theoretical perspectives is utilized to develop an analytic framework for understanding these conflicts. To this end, we draw on Dahrendorf’s conflict theory and the framing approach. Both have high complementary explanatory potential and empirical applicability, with the framing approach broadening the theoretical prism to include micro-individuals and groups to Dahrendorf’s meso-social perspective.

AbstractThe quest for a common collective identity has become a challenge for modern democracy: Liberal demands for greater inclusion and individual freedom, aspirations for a strong and solidaric political community, as well as nationalist or right-wing populist calls for exclusion and a preservation of hegemonic national identities are creating tensions that cannot be overlooked. This article therefore formulates the central question of how collective identity can be possible in a liberal democracy. Based on a case study on Germany, it will therefore be examined whether Leitkultur as a model of political integration can serve in generating a functional democratic collective identity. The necessary benchmarks guiding the analysis will be defined beforehand from a systems-theoretical perspective, balancing inclusion and exclusion within three crucial dimensions: normative basics, historic continuity, and affirmative bindings. The results show that a static definition of a German Leitkultur would in the long run neither achieve functional inclusion nor be able to generate the necessary cohesion of a political community, especially regarding the second and third identity dimensions.

Humans are by nature social beings tuned to communicate and interact from the very beginning of their lives. The sense of touch represents the most direct and intimate channel of communication and a powerful means of connection between the self and the others. In our digital age, the development and diffusion of internet-based technologies and virtual environments offer new opportunities of communication overcoming physical distance. It however, happens that social interactions are often mediated, and the tactile aspects of communication are overlooked, thus diminishing the feeling of social presence, which may contribute to an increased sense of social disconnection and loneliness. The current manuscript aims to review the extant literature about the socio-affective dimension of touch and current advancements in interactive virtual environments in order to provide a new perspective on multisensory virtual communication. Specifically, we suggest that interpersonal affective touch might critically impact virtual social exchanges, promoting a sense of co-presence and social connection between individuals, possibly overcoming feelings of sensory loneliness. This topic of investigation will be of crucial relevance from a theoretical perspective aiming to understand how we integrate multisensory signals in processing and making sense of interpersonal exchanges, this is important in both typical and atypical populations. Moreover, it will pave the way to promising applications by exploring the possibility to use technical innovations to communicate more interactively in the case of people who suffer from social isolation and disconnection from others.

How entrepreneurial firms can enhance the level of exploratory and exploitative improvisation in a balanced manner to enhance organizational dynamics has become an important research topic. Current research on the triggers of duality entrepreneurial improvisation has just started, exploring mainly abstract characteristic variables, and has not paid attention to the impact of entrepreneurs’ daily behaviors. In order to make up for the shortcomings of current research, the research goal of this paper is to construct a triggering model of entrepreneurs’ improvisation based on the research of entrepreneurs’ daily behaviors and then to evaluate the influence of the improvisational behavior trigger patterns. Based on the paradoxical and theoretical perspective of duality, a structured observation method is used to explore which behavioral patterns of entrepreneurs tend to trigger dual improvisational behaviors in themselves, their teams, and their organizations. After observing and recording the creators and collecting phenomenal data, six entrepreneurial behavior patterns containing 39 specific operational behaviors have been extracted from the phenomenal data by drawing on the rooted theory approach. In addition, the influence of entrepreneurial patterns is evaluated and ranked using the pairwise hesitant fuzzy set evaluation method. This study reveals the relationship between entrepreneurs’ daily behaviors and dyadic entrepreneurial improvisation at the operational level and provides guiding plans for entrepreneurs to improve their own and their organizations’ improvisation levels.

Abstract This article develops a micro-level theoretical perspective of business influence in international negotiations. By drawing on organizational institutional theory, the article proposes that site-specific institutionalized norms can structure the nature and extent of business power. The article illustrates the value of this perspective through an illustrative case study of the International Maritime Organization (IMO) through interviews and participant observation of on-site dynamics during negotiations on environmental shipping regulation. The article shows how, in the case of the IMO, specific institutionalized norms and beliefs structure private actors’ possible influence and their claims to authority. In particular, strongly held beliefs about the nature of political deliberation in the IMO both constrain and enable business interests, sometimes overriding the general structural power of the shipping industry. This research implies that future scholarship of business power and lobbying should be attentive to specific institutionalized ideas structuring business actors’ range of legitimate activities, in particular in international institutions where individual negotiation sites can develop idiosyncratic norms and beliefs about the legitimacy of private actor participation.

PurposeMentoring can be an important source of support, particularly for those who are in the early stages of their career in academia. Drawing upon data from a larger study, the authors investigated opportunities for mentorship, factors that hinder or support mentorship and the value of mentorship from the perspective of early career academics (ECAs).Design/methodology/approachUsing a mixed-methods approach and social identity theory, the authors collected data via a survey and follow-up interviews with members of staff at the Open University, of which 19 ECA experiences were contrasted with 17 academics who received mentorship but were not early career.FindingsECAs and non-ECAs had equal access to mentoring, but mentoring seemed to be more visible and accessible to ECAs. Factors deemed to support mentorship included mentors having empathy and confidentiality. Mentorship was valued by ECAs because it helped to provide them with support that was in addition to their line management and to help them make sense of “being an academic”. From the data presented, mentorship supported ECAs in their academic career and identity development in higher education.Originality/valueThis research provides a mixed-methods approach to investigating early career mentoring within the context of a higher education institution in the United Kingdom. It considers the topic of mentoring of both junior and more senior staff who are often working at a distance to the institutional setting and provides a theoretical perspective in terms of social identity for academics.

Drawing on the principles underlying conversation analysis (CA), this paper is a single case analysis of interaction in an English as a foreign language (EFL) reading comprehension classroom in Saudi Arabia. It looks at learning from a sociocultural perspective and uses constructs from this theoretical perspective. It focuses on Classroom Interactional Competence (CIC) (Walsh, 2013), showing classroom interaction features that are considered CIC. The paper reflects how an understanding of the concept can lead to more dialogic, engaged learning environments. The paper also connects CIC to teachers’ ability to manipulate simple classroom interactional resources to make the teaching process more effective. The paper demonstrates how teachers can induce CIC by utilizing interactional techniques, such as relaxing the mechanism and speed through which turns are taken or given, use of active listenership devices, extending wait time, and use of open-ended questions to expand topics under development. The paper argues that those techniques will help teachers, as evidenced from the cited examples, further enhance classroom participation so that it is convergent with their pedagogical goals. Finally, the paper has pedagogical implementations as it sheds light on techniques that help promote classroom interaction as an indication of learning among students with limited linguistic resources.
