Abstract This article utilizes recent Western approaches to the ethical inquiry into human activities of forgetting, especially the approach represented by Ricoeur’s work on memory and forgetting and their ethical functioning. The three areas of Ricoeur’s investigation includes the therapeutic/pathological area; pragmatic area, which deals with the issue of individual and group’s self-identity in relation to time and otherness; and the more explicitly ethical (social and institutional) area. These three divisions are useful to start with, but Ricoeur’s work shows some narrowness in neglect of positive, productive and healthy forgetting, which has been deemed significant by the Zhuangzi. This paper is the first of the author’s serial writings to apply Ricoeur’s three areas of forgetting to investigate the forgetfulness of the Zhuangzi, and examines therapeutic forgetting and its ethical dimension only.

Disorders of consciousness (DoCs) raise difficult and complex questions about the value of life for persons with impaired consciousness, the rights of persons unable to make medical decisions, and our social, medical, and ethical obligations to patients whose personhood has frequently been challenged and neglected. Recent neuroscientific discoveries have led to enhanced understanding of the heterogeneity of these disorders and patients, and focused renewed attention on the disturbingly high rate of misdiagnosis. This book examines the entanglement of epistemic and ethical uncertainty in DoCs and other medical contexts, and how they interact to create both epistemic and ethical risks. Philosopher and bioethicist L. Syd M Johnson pulls together multiple threads—the ontological mysteries of consciousness, medical uncertainty about unconsciousness, ableist bias, withdrawal of treatment in neurointensive care, and the rarely questioned view that consciousness is essential to personhood and moral status. Johnson challenges longstanding bioethical dogmas about DoC patients, and argues for an ethics of uncertainty for contexts where there is a need for decisive action in the presence of unavoidable uncertainty. The ethics of uncertainty refocuses ethical inquiry concerning persons with DoCs, placing less emphasis on their contested personhood, and more on inductive risk and uncertainty, on respect for autonomy, and especially on epistemic justice, and the duties of privileged epistemic agents. It is an approach with applications beyond brain injury, encouraging an expansive and humane approach that enables surrogate decision makers facing fraught, complex, risky choices to fulfill their obligations as moral and epistemic agents.

This paper critically investigates the ethical perspectives and practices of individuals and organizations who make persuasive technologies (“persuasive technologists”). An organization that claims to be at the forefront of ethical persuasion is behavioral software company Boundless Mind. Yet Boundless Mind sells ostensibly oxymoronic software products: an Application Programming Interface for third-party applications that optimizes the capture of end user attention, and an application for end users on how to make third-party applications less persuasive. Drawing upon Foucault’s interpretation of ethics as an “aesthetics of existence” and the related concept of “therapeutic authority,” I argue Boundless Mind justify the “poaching” and “protecting” of user attention based on a view of the human subject as fixable and their capability to instrumentalize user subjectivity to socially desirable ends. I walkthrough Boundless Mind’s technology-habit-breaking application Space and highlight a behavioral technique administered by Space called stimulus devaluation, which enables the user to develop a transformative relationship with their technology habits and persuasive applications. I conclude the paper by arguing that a persuasive technology ethics based on fixing the user obfuscates the power of persuasive technologists by limiting the scope of ethical inquiry to the activities of the user.

AbstractThe permissibility of nudging in public policy is often assessed in terms of the conditions of transparency, rationality, and easy resistibility. This debate has produced important resources for any ethical inquiry into nudging, but it has also failed to focus sufficiently on a different yet very important question, namely: when do nudges undermine a patient’s voluntary consent to a medical procedure? In this paper, I take on this further question and, more precisely, I ask to which extent the three conditions of transparency, rationality, and easy resistibility can be applied to the assessment of voluntary consent too. After presenting two examples, designed to put pressure on these three conditions, I show that, suitably modified, the three conditions can remain significant in the assessment of voluntary consent as well. However, the needed modifications are very substantial and result in a rather complicated view. To propose a tidier solution, I argue that nudging undermines voluntary consent if and only if it cannot be ‘interpersonally justified’ to the patient. I use the three modified conditions to motivate the idea of interpersonal justification and also to further specify the principles it involves. My resulting view is especially attractive because it builds on already existing insights from the debate on nudging, updates those insights with an eye to medical consent, and finally unites them in an elegant and simple framework.

AbstractJust war theory has traditionally focused on jus ad bellum (the justice of war) and jus in bello (justice in war). What has been neglected is the question of jus ante bellum, or justice before war. In particular: Under what circumstances is it justifiable for a polity to prepare for war by militarizing? When (if ever) and why (if at all) is it morally permissible or even obligatory to create and maintain the potential to wage war? What are the alternatives to the military? And if we do have militaries, how should they be arranged, trained, and equipped? These considerations are not about whether war making is justified, but about whether war building is justified. In Ethics, Security, and the War-Machine, Ned Dobos argues that we have not sufficiently calculated the true (noneconomic) costs of the military, and that if we did, having a standing defense force would not seem like as good an idea. Dobos pushes us to reflect on something we have taken for granted: that one of the biggest institutions in our society, which is supposed to keep us safe and allow us to lead our own lives, may in fact pose great dangers and risks to us physically, morally, and culturally. The essays in this symposium take Dobos's work as a starting point and show the importance, complexity, and richness of this new strand of ethical inquiry.
