AbstractThis paper targets an orphan topic in research ethics, namely the so called principle of the primacy of the human being, which states that the interests of the human subject should always take precedence over the interests of science and society. Although the principle occupies the central position in the majority of international ethical and legal standards for biomedical research, it has been commented in the literature mainly in passing. With a few notable exceptions, there is little in-depth discussion about the meaning and role of the principle. Several authors note that the principle is vogue, ambiguous and apparently conflicting with the accepted practice of conducting non-beneficial research on individuals unable to give consent. There are opinions that it is just “a vacuous figure of speech” and should be abandoned. This paper argues that the primacy principle is far from being “a vacuous figure of speech”, rather it should be seen as a threefold concept: a fundamental interpretative rule, a procedural rule, and a substantive rule aimed at protecting research subjects from instrumental treatment and unacceptable risks. This interpretation tracks back to the principle regulatory and normative origins in the Declaration of Helsinki of 1975, but also acknowledges changes in research ethics and practice, which took place at the turn on the twentieth and twenty-first centuries. Thus, the proposed reading of the principle is not only original, but also historically grounded and normatively fruitful. It provides a fresh and ethically rich perspective on extensively debated, but still controversial problem of an upper limit of permissible risks in non-beneficial studies.

Purpose. The purpose of the article is to analyze the Universal Declaration of Human Rights as an international legal instrument, which for the first time formulated the foundations of modern democratic status of a human being and its fundamental rights and freedoms. Methodology. The methodology involves a comprehensive study of theoretical and practical material on the subject, as well as a formulation of relevant conclusions and recommendations. During the research, the following methods of scientific cognition were used: dialectical, terminological, formal and logical, systemic and functional. Results. The study found that the main features of the Universal Declaration of Human Rights as a source of international legal mechanism for the protection of human rights are: 1) it is a fundamental, foundational and universal international human rights act of the United Nations; 2) it establishes a system of fundamental human rights; 3) it defines a common system of fundamental international human rights standards; 4) it determines the principles of legal identity of a human being; 5) it determines the fundamental basis and principles of international legal regulation in the field of human rights protection; 6) it acts as an international legal basis for the adoption of the latest legislation on human rights protection; 7) it acts as an international legal basis for the codification of human rights legislation. Scientific novelty. The study found that the Universal Declaration of Human Rights points to the natural origin of human rights, which must be binding on all States and for the whole population, regardless of citizenship, in order to ensure the human rights protection in a democratic and rule-of-law State. Practical importance. The results of the study can be used to improve Ukrainian legislation on human rights and fundamental freedoms.

У рамках імплементації Конвенції про охорону нематеріальної культурної спадщини вивчено заходи культурної політики, що заклали основи для втілення новітніх політичних підходів, механізмів і програм. У контексті виконання міжнародно-правових стандартів UNESCO та положень Конвенції визначено курс на аналіз, збереження й розвиток культурного розмаїття та надбання. Умотивована необхідність формування стратегії культурної політики у галузі збереження нематеріальної культурної спадщини, що полягає у проектуванні й затвердженні культурних проектів національного й регіонального спрямування. Враховано наявну ускладнену ситуацію щодо ролі місцевої влади та обмеженість бюджетного фінансування в країні загалом. Встановлено, що дії, що сприятимуть виявленню елементів нематеріальної культурної спадщини, організації та реалізації заходів щодо її збереження в Україні повинні стати цільовими пріоритетами. Cultural policy measures within the framework of the implementation of the Convention for the Safeguarding of the Intangible Cultural Heritage are examined. A course on the analysis, conservation and development of cultural diversity and heritage in the context of the implementation of UNESCO international legal standards and the provisions of the Convention has been determined. The necessity of developing a strategy of cultural policy formation in the field of preservation of the intangible cultural heritage, which consists in the design and approval of cultural projects of national and regional orientation, is substantiated. The complicated situation regarding the role of local authorities and the limited budget financing in the country are taken into account. It is established that the priority should be given to actions that will help identify elements of the intangible cultural heritage, develop and implement measures for its preservation in Ukraine.

Schopenhauer explores the paradoxical nature of the aesthetic experience of the sublime in a richer way than his predecessors did by rightfully emphasizing the prominent role of the aesthetic object and the ultimately affirmative character of the pleasurable experience it offers. Unlike Kant, Schopenhauer’s doctrine of the sublime does not appeal to the superiority of human reason over nature but affirms the ultimately “superhuman” unity of the world, of which the human being is merely a puny fragment. The author focuses on Schopenhauer’s treatment of the experience of the sublime in nature and argues that Schopenhauer makes two distinct attempts to resolve the paradox of the sublime and that Schopenhauer’s second attempt, which has been neglected in the literature, establishes the sublime as a viable aesthetic concept with profound significance.

AbstractResearch ethics committees in Germany usually don’t have philosophers as members and if so, only contingently, not provided for by statute. This is interesting from a philosophical perspective, assuming that ethics is a discipline of philosophy. It prompts the question what role philosophers play in those committees they can be found in. Eight qualitative semi-structured interviews were conducted to explore the self-perception of philosophers regarding their contribution to research ethics committees. The results show that the participants generally don’t view themselves as ethics experts. They are rather unanimous on the competencies they think they contribute to the committee but not as to whether those are philosophical competencies or applied ethical ones. In some cases they don’t see a big difference between their role and the role of the jurist member. In the discussion section of this paper I bring up three topics, prompted by the interviews, that need to be addressed: (1) I argue that the interviewees’ unwillingness to call themselves ethics experts might have to do with a too narrow understanding of ethics expertise. (2) I argue that the disagreement among the interviewees concerning the relationship between moral philosophy and applied ethics might be explained on a theoretical or on a practical level. (3) I argue that there is some lack of clarity concerning the relationship between ethics and law in research ethics committees and that further work needs to be done here. All three topics, I conclude, need further investigation.

Researchers, as well as individuals and institutions that oversee their conduct, sometimes have conflicts of interest that weaken or render ineffective efforts to protect human research subjects. This article analyzes United States and international standards used to address conflicts of interest and reviews evidence regarding compliance. It finds current standards are insufficient and recommends that the federal government and international organizations adopt stronger legal standards that require resolving most significant conflicts of interest and specifying how to manage conflicts of interest not resolved.

Homoeopathy is the system of medicine founded by Dr. Samuel Hahnemann (1755-1843) of Germany. It is based on the principle that “like cures like”. In practice, this means that a medicine capable of producing certain effects when taken by a healthy human being is capable of curing any illness that displays similar effects. In pediatric practice; attention deficit disorders (ADHD/ADD) are the most common serious psychosocial problems prompting parents to seek help for their children. Since the ability to pay attention and concentrate is a basis prerequisite of child development, forming the foundation of all learning and thinking as well as of emotional and social interaction, the suffering of these children as well as their siblings, parents, teachers, and fellow pupils is often considerable.

Abstract The emergence of the LGBTI+ movement has faced considerable challenges in the Turkish sociopolitical context due to the dominance and oppression of the long-established traditional and conservative institutions such as religion, family, and state. In Turkey, translation occupies a central position in the way knowledge is produced and organized to subvert heteronormativity and homo/transphobia, and struggle for rights. LGBTI News Turkey is the most conspicuous LGBTI+ organization in relation to this, since the platform focuses exclusively on translation. I discuss the role of the activist translators in the representation of LGBTI+ individuals globally by constructing a “narrative” (Baker 2006a) for the LGBTI+ community in Turkey. I also elaborate the concepts of fidelity and invisibility within activist translation, and the methods activist-translators employ to create and disseminate a counter narrative against the dominant public narrative, and question how they position themselves in the LGBTI+ movement.
