Many scholars have analysed bargaining between supervisory bureaucracies and Chinese large and medium-sized factories. Walder identified a web of informal, semi-bureaucratic relationships that structures negotiations over revenues, payments and subsidies. Granick and Tidrick pointed out that divided bureaucratic control increases the parties to bargaining, while conflicting interests present opportunities to play supervisors off against each other. Huang found collusive behaviour that occurs when local government agencies and firms rob the state treasury by increasing central subsidies and reducing central exactions in exchange for fees that go directly to local coffers. Numerous authors have noted that the focus of bargaining has shifted from material to financial transfers and have used (or questioned using) Kornai's “soft budget constraint” to explain the persistence of bargaining since the onset of reform.

With the increasing cost of and dissatisfaction with services provided by government agencies, a new notion has appeared that gives hope to some and instills fear in others. Many believe that privatizing government services is the answer to the ills associated with today’s government-provided services. County road commissions in the state of Michigan are one of the many government entities examining privatization. High cost and poor service are concerns that have thrust road commission operations under the privatization spotlight. Snow and ice removal from roads is one operation currently under scrutiny. To come to conclusions about privatization and the winter maintenance services that road commissions perform, one must fully understand the road commission concept and how it functions within the state of Michigan as well as the idea of privatization. The nonquantitative factors that affect privatization at the local government level are described. Two road commissions in the state of Michigan and their winter maintenance operations are examined so that judgments can be made about the value of private delivery.

I consider the application of János Kornai’s soft budget constraint (SBC) concept to the state capitalist economy. I argue that interaction of SBC with agency problems within the government bureaucracy helps explaining a major feature of state capitalism – failure to privatize underperforming state-owned enterprises (SOEs). Bureaucrats supervising the failing SOEs prefer to keep them afloat and gamble for resurrection; in contrast, privatization would involve recognizing the loss, which would result in acknowledging the bureaucrat’s failure that is disincentivized by the state. This endogenously emerging preferential treatment of state-owned firms creates a competitive advantage against private firms; this explains why in state capitalism privatization may result in lower rather than higher productivity and therefore remain unpopular.

Abstract Amendment to the Act on special rules of preparation and implementation of investment in public roads resulted in an accelerated mode of acquisition of land for the development of roads. The decision to authorize the execution of road investment issued on its basis has several effects, i.e. determines the location of a road, approves surveying division, approves construction design and also results in acquisition of a real property by virtue of law by the State Treasury or local government unit, among others. The conducted study revealed that over 3 years, in this mode, the city of Krakow has acquired 31 hectares of land intended for the implementation of road investments. Compensation is determined in separate proceedings based on an appraisal study estimating property value, often at a distant time after the loss of land by the owner. One reason for the lengthy compensation proceedings is challenging the proposed amount of compensation, unregulated legal status of the property as well as imprecise legislation. It is important to properly develop geodetic and legal documentation which accompanies the application for issuance of the decision and is also used in compensation proceedings.

AbstractFollowing the completion of the process of decentralisation of public administration in Poland in 2003, a number of tasks implemented previously by the state authorities were transferred to the local level. One of the most significant changes to the financing and management methods of the local authorities was the transfer of tasks related to culture and national heritage to the set of tasks implemented by local governments. As a result of the decentralisation process, the local government units in Poland were given significant autonomy in determining the purposes of their budgetary expenditures on culture. At the same time, they were obliged to cover these expenses from their own revenues.This paper focuses on the analysis of expenditures on culture covered by the voivodship budgets, taking into consideration the structure of cultural institutions by their types, between 2003-2015. The location quotient (LQ) was applied to two selected years (2006 and 2015) to illustrate the diversity of expenditures on culture in individual voivodships.

SummaryTheme conflicts of interest is one of the major reasons for concern local government, regional and central administrative and criminal legal implications aiming to uphold the integrity and decisions objectively. Also, most obviously, conflicts of interest occur at the national level where political stakes are usually highest, one of the determining factors of this segment being the changing role of the state itself, which creates opportunities for individual gain through its transformations.
