The Caspian Sea: Quest for a New Legal Regime

One of the most controversial contests over the allocation of shared natural resources is now being waged by four former Soviet Union republics (Azerbaijan, Kazakhstan, Russia, and Turkmenistan) and Iran over the riches of the Caspian Sea. The bilateral regime established by the former USSR and Iran governing the Caspian Sea, though technically still existing today, is inadequate to deal with the present-day complex issues of the use and allocation of natural resources. The situation is aggravated by unilateral claims of the states bordering the Sea. Although the coastal states are currently discussing how the regime of the Caspian Sea might be resolved, the issue is not yet settled and the positions of the parties remain divergent.

The aim of the research is to present oil dependence of Azerbaijan and Kazakhstan from 2000 till 2017. The analysed countries represent two former Soviet Union countries in the Caspian Sea region and are among the world’s top 15 oil dependent economies. It is shown that both countries generate high oil rents to GDP ratios. Moreover, the paper reveals that their fuels export constitutes a huge portion of total merchandise export. It implies that majority of Azerbaijani and Kazakhstani export revenues come from resources extraction. The empirical analysis of co-movements between the crude oil prices and chosen macroeconomic indicators shows that correlation between oil prices and Kazakhstani and Azerbaijani public debt to GDP ratios is negative, strong and significant. In addition, there is significant relationship between oil prices and Kazakhstani exchange rate and GDP growth rate.

Abstract This article focuses on the regulations of the Convention on the legal status of the Caspian Sea (hereinafter as Caspian Sea Convention), which was adopted in 2018. It regulates the development and access to Caspian fossil fuel resources and protects its environment, which are important factors for the sustainable development of the region. The main finding of this article is that the Caspian Sea Convention, having established the maritime zones, has, for the first time ever, recognized the territorial sovereignty of the individual riparian states in the Caspian Sea and defined its territorial scope. After presenting to the riparian states’ their rights and obligations within the newly defined maritime zones, the article analyses the new legal framework for the development and use of the natural resources of the Caspian Sea. It also elaborates on the new legal regime for the transportation of resources by means of vessels and submarine pipelines.

After twenty-two years of negotiations, in Aktau on August 12, 2018, Kazakhstan, Azerbaijan, Iran, Russia, and Turkmenistan signed the Convention on the Legal Status of the Caspian Sea. The preamble of the Convention stipulates, among other things, that the Convention, made up of twenty-four articles, was agreed on by the five states based on principles and norms of the Charter of the United Nations and International Law. The enclosed Caspian Sea is bordered by Iran, Russia, and three states that were established following dissolution of the Soviet Union, namely Azerbaijan, Kazakhstan, and Turkmenistan.

AbstractThe absence of an acceptable legal regime for the division of the Caspian Sea among its five littoral states has created grounds for conflicts, crises, and wars in the Caspian region, a situation worsened since 2001 when Iran, Azerbaijan, and Turkmenistan found each other on a collision course over the ownership of certain offshore oilfields. The region has since been heading towards militarization, while the persistence of conflicts over the Caspian Sea's division has prepared the ground for military conflicts. Fear of lagging behind in an arms and the manipulation of conflicts by the United States and Turkey have further encouraged militarization. Against this background, certain factors, including Turkey's efforts to deny Iran political and economic gains in the Caspian region, the growing American military presence in Eurasia, and the expanding American-Azeri military ties since 11 September 2001 will likely contribute to the creation of a suitable ground for a military conflict in the Caspian region.

This article focuses on the problem of public administration in the countries of the former Soviet Union. It reveals the economic development issues of the states of the post-Soviet space, considers the main common and distinctive features for the newly independent states. The central problem raised in the article is the determination of the current state of the modernization process in post-Soviet societies. The author assumes the presence of demodernization and presents an argument in confirming his opinion. In addition, the article reveals the issues of the modern political state of such countries of the former USSR as Russia, Ukraine and Uzbekistan. The author traces the process of demodernization and dependence of political and social development on the governing elitist groups, leading to authoritarianism as opposed to the supposed democracy and modernization.

Azerbaijan is a nation with a Turkic population which regained its independence after the collapse of the Soviet Union in 1991. It has an area of approximately 86 000 km2. Georgia and Armenia, the other countries comprising the Transcaucasian region, border Azerbaijan to the north and west, respectively. Russia also borders the north, Iran and Turkey the south, and the Caspian Sea borders the east. The total population is about 8 million. The largest ethnic group is Azeri, comprising 90% of the population; Dagestanis comprise 3.2%, Russians 2.5%, Armenians 2% and others 2.3%.

Twenty five years after the dissolution of the former Soviet Union and the reemergence of the Central Asian Republics as independent States, this region continues to be the scene of rivalries amongst the big powers (Russia, China, the European Union, USA, India, Japan, Turkey and Iran) competing in a sort of a “new Grand Game” to increase their geopolitical and economic influence in the region. Its geography, diverse and rich natural resources, like oil and gas, explain the ongoing hidden rivalries. Despite its common historical and cultural past, Central Asia constitutes a heterogeneous region with a multiethnic and multi-linguistic composition and a low degree of physical, economic and trade integration. The lack of mutual trust, the persisting tension over borders and the use and sharing of natural resources, as well as different levels of economic performance have so far jeopardized the development of genuine regional cooperation. Against this background, the idea behind the Chinese OBOR Initiative to develop rapid transportation, if well implemented, could theoretically, by improving interregional connectivity, develop the Central Asia regional market and foster intergovernmental cooperation and people-to-people contacts within the region. In this context, could we expect that the ambitious Chinese OBOR Initiative will boost geopolitical stability and promote shared economic and trade benefits in Central Asia? What are the conditions for that need to be fulfilled?The author analyzes in depth certain crucial political, economic and institutional requirements for the successful implementation of the OBOR Strategy and concludes, however, that three years after the launching of this crucial instrument of the Chinese “globalization without democracy” model, its implementation faces major problems and thus raises more doubts than certainties.

This chapter examines the politics of the natural resources of the Caspian Sea as littoral states vie for dominance on energy resources and its routes to the world markets against a background of climate change, region-wide sustainability challenges, and local pollution. The Caspian is in full transformation and solving these problems will require a shift in regional politics towards environmental cooperation and political integration. However, the inherent challenges of such a new approach are compounded by the landlocked position of Caspian countries, uncertainty among littoral states as to each other’s intentions and a decaying infrastructure, last updated in the Soviet era.
