Interview with Attaher Zacka Maïga

Attaher Zacka Maïga was born on 10 May 1963 in Bia, Bourem Cercle, Gao Region, Mali. He has spent his life in the service of the International Red Cross and Red Crescent Movement, joining the Mali Red Cross as a volunteer in 1987 before working for the International Federation of Red Cross and Red Crescent Societies as a nutritionist in a pilot centre for nutritional recovery and education in Bourem from January 1988 to June 1990. In 1990 and 1991 he acted as consultant to a number of organizations, including World Vision and UNICEF. In April 1992, Attaher Maïga joined the International Committee of the Red Cross (ICRC) as a “resident” (i.e. local) employee. Since then, he has held many positions. From 1996 to 2000, he was in charge of the Gao office, which employed almost 100 staff, both resident and “mobile” (expatriate). He then took charge of the ICRC's programmes in northern Mali from 2001 to 2006, ran the organization's office in the Malian capital Bamako from 2007 to 2008 and was responsible for the Mali communication programme between 2009 and 2011. From November 2011 to November 2014, he was head of the ICRC's northern Mali sub-delegation, one of the first resident employees to lead an ICRC sub-delegation. Since 2015, Attaher Maïga has been Networking Coordinator for the ICRC's Mali delegation. In 1996, Mr Maïga initiated the ICRC's post-conflict programmes in his country, covering the fields of agriculture, veterinary services and health. In 2009, he launched a pilot migrant project in Kidal, northern Mali. These much-appreciated initiatives resulted in his being invited to participate in the 2010 Montreuil meeting, which laid the foundations for the reforms currently underway. Attaher was the first Mali focal point for the ICRC's Unit for Global Affairs. This role gave him a deeper understanding of trends in the Islamic world and enabled him to help the ICRC adjust its dialogue with Jihadist armed groups. Our interview with Mr Maïga highlights his extensive experience with one of the oldest humanitarian organizations and is an opportunity for him to share his understanding of the ICRC's interaction with the armed groups that controlled northern Mali in 2012, when he was representing the ICRC in the region. Attaher Maïga holds a degree in public administration from the Institut de Gestion et des Langues Appliquées aux Métiers, Bamako.

In this Q&A, the Review talks to Delphine van Solinge and Massimo Marelli of the International Committee of the Red Cross (ICRC). Van Solinge is the ICRC's focal point for understanding how digital technologies and the spread of harmful information affect populations living in conflict environments, and what this means for humanitarian action. To this end, her portfolio is focused on exploring, on behalf of the ICRC and through partnerships, how to mitigate the risks that digital technologies bring in humanitarian settings and ensure relevant protection responses in the digital age. Marelli is Head of the ICRC's Data Protection Office (DPO). During his tenure with the ICRC, the organization has chartered new pathways for how it can carry out its operational work, while ensuring that the data of the affected people which it serves, as well those of its employees, are well protected. During this conversation, van Solinge and Marelli discuss how their areas of work complement and reinforce each other, forming two halves of the same coin with regard to how digital information and data can both be used for positive change and misused in humanitarian settings. Marelli highlights how humanitarian organizations process, protect and use data and digital information. Van Solinge discusses how through misinformation, disinformation and hate speech, information can be manipulated and spread using digital technologies – particularly in the age of the COVID-19, when populations are more reliant on digital communication technologies. Among the issues they discuss are how digital technologies can be used positively, the ethical considerations that humanitarian organizations should take into account, and the possible paths forward for public–private sector collaborations on this theme.

AbstractDigitalization and new technologies have an increasingly important role in today's humanitarian activities. As humanitarian organizations become more active in and reliant on new and digital technologies, they evolve from being simple bystanders to being fully fledged stakeholders in cyberspace, vulnerable to adverse cyber operations that could impact on their capacity to protect and assist people affected by armed conflict or other situations of violence.This shift makes it essential for humanitarian organizations to understand and properly map their resulting cyber perimeter. Humanitarian organizations can protect themselves and their activities by devising appropriate cyber strategies for the digital environment. Clearly defining the digital boundaries within which they carry out operations lays the groundwork for humanitarian organizations to develop a strategy to support and protect humanitarian action in the digital environment, channel available resources to where they are most needed, and understand the areas in which their operational dialogue and working modalities need to be adapted for cyberspace.The purpose of this article is to identify the unique problems facing international humanitarian organizations operating in cyberspace and to suggest ways to address them. More specifically, the article identifies the key elements that an international humanitarian organization should consider in developing a cyber security strategy. Throughout, the International Committee of the Red Cross and its specificities are used as an example to illustrate the problems identified and the possible ways to address them.

This chapter explores the evolving role of forensic genetics in human rights investigations and as a technology of postmortem identification for missing persons in ongoing conflict and post-conflict societies. How has DNA’s increasingly privileged place as a line of evidence impacted the field in terms of both medico-legal standards and heightened expectations among surviving kin and their communities? Drawing on interviews with leading figures in the field of forensic science and human rights/transitional justice (e.g., the International Commission on Missing Persons, the International Committee of the Red Cross, the Equipo Argentino de Antropología Forense, and the Colibrí Center for Human Rights), buttressed by ethnographic analysis of exhumation and identification efforts in Bosnia and Herzegovina and Uganda, the chapter provides an overview and commentary about the technology’s complicated place in unearthing truths and effecting repair.

AbstractArmed conflict and deprivation of liberty are inexorably linked. Deprivation of liberty by non-state armed groups is a consequence of the predominantly non-international character of contemporary armed conflicts. Regardless of the nature of the detaining authority or the overarching legality of its detention operations, deprivation of liberty may nonetheless have serious humanitarian implications for the individuals detained. Despite a need for humanitarian action, effective engagement is hampered by certain threshold obstacles, such as the perceived risk of the group's legitimization. Since the formative work of the International Committee of the Red Cross (ICRC)'s founder, Henry Dunant, the ICRC has sought to overcome these obstacles. In doing so it draws upon its experience of humanitarian action in state detention, adapting it to the exigencies of armed groups and the peculiarities of their detention practice. Although not without setbacks, the ICRC retains a unique role in this regard and strives to ameliorate the treatment and conditions of detention of persons deprived of liberty by armed groups.

AbstractApplying the humanitarian principles of humanity, impartiality, neutrality and independence in a relevant manner in concrete operational settings is a constant challenge for humanitarian organizations. Bound by this set of norms, the International Committee of the Red Cross (ICRC) has incrementally developed over the years a rational framework that allows its leadership and staff on the ground to act according to these principles while developing adapted solutions and pragmatic approaches. This article begins by describing the history and development of the humanitarian principles; it then explains how the strategic choices of the ICRC are informed by these principles, and what the consequences are for the organization's capacity to act in favour of victims of armed conflicts.

AbstractPrivate security and military companies have become a ubiquitous part of modern armed conflict and post-conflict reconstruction. Their diverse clients include governments in the developed and developing world alike, non-state belligerents, international corporations, non-governmental organizations, the United Nations, and private individuals. The implications of this proliferation of private security and military companies for international humanitarian law and human rights are only beginning to be appreciated, as potential violations and misconduct by their employees have come to light in Iraq and Afghanistan. The author critically examines the theoretical risks posed by private military and security company activity with respect to violations of international humanitarian law and human rights, together with the incentives that these companies have to comply with those norms. Empirical evidence is also presented to expand on this theoretical framework. Taking a multidisciplinary approach, the author draws on law, international relations theory, criminology, economics, corporate strategy and political economy, as well as psychology and sociology, to analyse the competing “risk-factors” and “compliance levers” that interact at each level of private military and security company activity to enhance or reduce the likelihood of a violation occurring. These findings are then applied by the author to assess emergent measures to deal with private security and military companies outside the legal sphere, including a programme of the International Committee of the Red Cross and the advent of the International Peace Operations Association.

Abstract The use of cyber operations during armed conflicts and the question of how international humanitarian law (IHL) applies to such operations have developed significantly over the past two decades. In their different roles in the Legal Division of the International Committee of the Red Cross (ICRC), the authors of this article have followed these developments closely and have engaged in governmental and non-governmental expert discussions on the subject. In this article, we analyze pertinent humanitarian, legal and policy questions. We first show that the use of cyber operations during armed conflict has become a reality of armed conflicts and is likely to be more prominent in the future. This development raises a number of concerns in today's increasingly cyber-reliant societies, in which malicious cyber operations risk causing significant disruption and harm to humans. Secondly, we present a brief overview of multilateral discussions on the legal and normative framework regulating cyber operations during armed conflicts, looking in particular at various arguments around the applicability of IHL to cyber operations during armed conflict and the relationship between IHL and the UN Charter. We emphasize that in our view, there is no question that cyber operations during armed conflicts, or cyber warfare, are regulated by IHL – just as is any weapon, means or methods of warfare used by a belligerent in a conflict, whether new or old. Thirdly, we focus the main part of this article on how IHL applies to cyber operations. Analyzing the most recent legal positions of States and experts, we revisit some of the most salient debates of the past decade, such as which cyber operations amount to an “attack” as defined in IHL and whether civilian data enjoys similar protection to “civilian objects”. We also explore the IHL rules applicable to cyber operations other than attacks and the special protection regimes for certain actors and infrastructure, such as medical facilities and humanitarian organizations.

Since 2011, the humanitarian impact of the crisis in Syria has continued to worsen. The conflict is characterized by frequent violations of international humanitarian law (IHL): indiscriminate attacks in urban areas, the targeting of civilians and essential services such as water supply and health care, and the use of prohibited weapons, to name just a few. All of these have devastating consequences for the Syrian people, who are caught between the opposing sides. The conflict has brought not only bombs and missiles but also harsh living conditions, displacement, lack of access to food, water and medicine, uncertainty regarding the fate of missing or detained loved ones, and interruption of all aspects of life, including the education of a generation of Syrian children. Many people have fled, while others have stayed and attempted to live their lives amid the chaos of war.In the face of these overwhelming needs, humanitarian organizations such as the International Committee of the Red Cross (ICRC) struggle to respond. The ICRC is helping people both inside Syria, who are facing extremely difficult conditions because of the conflict, and the hundreds of thousands of Syrian refugees in Jordan, Lebanon, Iraq and elsewhere. In partnership with the Syrian Arab Red Crescent, the ICRC distributes food and other essentials, restores water supplies and supports medical services.In this interview, ICRC president Peter Maurer reflects on the complexities of the armed conflict in Syria, the difficulties of providing a neutral and impartial humanitarian response in this context and the importance of the parties to the conflict upholding their obligations to the civilian population.

The International Committee of the Red Cross (ICRC) has been assisting the victims of the conflict in the former Yugoslavia since June 1991. Six years on, its delegates are still active in the region, addressing the lasting consequences of the conflict, but as the situation has evolved so has the nature of their work. This is particularly true of dissemination, which began as a concerted effort to promote greater understanding of international humanitarian law and the ICRC's role and mandate, but which has now been redirected towards meeting the needs of the post-conflict environment. This paper sets out to describe and analyse the development of dissemination in the present context. Though the ICRC's activities during the conflict were predominantly in Croatia and in Bosnia and Herzegovina, and there are similar dissemination initiatives in both these areas, this paper focuses on Bosnia and Herzegovina. Where relevant, reference may be made to dissemination activities in other parts of the former Yugoslavia.

Abstract This article examines the presence of 605 armed groups in today's conflict environment by bringing new evidence based on internal research. It looks in particular at the way these non-State entities provide varying degrees of services to the population in the spaces that they control, and how this might impact the way a humanitarian organization like the ICRC engages with them in a dialogue over time. This model of analysis is then used to situate and better explain armed groups’ positions on the COVID crisis.
