After having invalidated the federal Defense of Marriage Act (DOMA), the U.S. Supreme Court “dropped the other shoe” inObergefell v. Hodgesby declaring the exclusion of same-sex couples from marriage at the state level unconstitutional. Written by Justice Kennedy, the majority opinion heavily relied on the dignity-bestowing character of marriage to show why this exclusion is so harmful. But this strategy comes with a cost: it inflicts a stigma even as it conveys recognition—a drawback that an equality analysis can avoid. Respondents had argued that opening marriage dangerously disconnected marriage from procreation, both the historical reason for and the essence of marriage. In finding that they had failed to provide evidence for the harmful outcomes they described, the majority not only provided the rational basis test with a new kind of “bite.” It also asserted that tradition or religious beliefs were not enough to justify exclusion. Once secular purposes define marriage and rational reasons are required to regulate access, the road to marriage equality opens wide. As the line of cases leading up toObergefellsuggests, and developments in Germany, Austria, and other jurisdictions confirm, equality works as a one-way ratchet—albeit without necessarily including polygamy and incest. Crucially, equality changes the focus: From an equality perspective, the harm lies not in the exclusion from a dignity-conferring institution, but in the suggestion that the excluded group is not worthy of participating in it and does not deserve the recognition and benefits associated with it. Instead of aspiring to achieve dignity through marriage, in this view same-sex couples claim recognition as free and equal citizens. Discrimination on the basis of race, gender, or sexual orientation subsumes an individual under a group category whose purported characteristics are systematically devalued, thus refusing to appreciate a person as an individual. It is this denial of recognition that conveys harm to the dignity of the individual above and beyond the respective disadvantage suffered. Thus taken with equality, dignity does not have the exclusive effect it has in isolation, as struggling against degrading exclusion stresses common traits.

This chapter studies the use of biblically inflected speech in political debate. It begins by examining the arguments raised by conservative Christian activists in their campaign to prevent the passage of the Marriage (Same-Sex Couples) Act 2013. Introducing the concept of 'communicative doubt', the chapter argues that there is a sense in which neither 'religious' nor 'secular' arguments are thought to be an appropriate means of conveying Biblical Truth to those who are not (yet) Christian, for what is needed is the intervention of a speaking God. It then explores this doubt as it manifested in the lives of two Christ Church members who had been involved in one of the Christian Legal Centre's earliest cases. Five years on, they remained unsure of whether or not it communicated the Good News they had hoped to share. These doubts, hesitations, and ambivalences speak to the contested place of public Christianity in contemporary England, and to the difficulties faced by those who insist that their faith must go public: the challenge of rendering Christianity legible not only to law and politics, but to the individual men and women who are subject to these worldly institutions.

In his campaign for president in 1992, Bill Clinton did something surprising: he advocated for gay rights. After winning the presidency, however, he was unable to integrate gay soldiers into the military as he had promised to do. Congress instead created a program known as Don’t Ask, Don’t Tell, which forced gay soldiers back into the closet. Congress also passed, and President Clinton signed, the Defense of Marriage Act, which prevented the federal government from recognizing same-sex marriages and allowed states to continue to deny marriage rights to same-sex couples. In 1997 television star Ellen DeGeneres came out as a lesbian both in person and in character on her TV show Ellen, becoming one of the most prominent out-of-the-closet gay people in the US.

This chapter argues that evaluating the arguments the parties made in Loving v. Virginia (1967), the iconic case in which the Supreme Court struck down Virginia’s anti-miscegenation law, aids in understanding puzzles about bigotry. Virginia attempted a modern, sociological defense of its racist law. Loving illustrates the role of generational moral progress in constitutional interpretation: laws justified by appeals to nature, God’s plan for the races, and children’s well-being were repudiated as rooted in racial prejudice, intolerance, and white supremacy. The chapter then considers Loving’s crucial (but contested) role in constitutional challenges to bars on same-sex marriage, first analyzing the successful challenge to Virginia’s defense of marriage law. It then analyzes the majority opinion in Obergefell v. Hodges, holding that same-sex couples have a fundamental right to marry; the dissenters argued Loving was inapt. The chapter concludes by discussing the role of moral progress and new insight in constitutional interpretation.

A complex system is composed of many interacting components, but the behavior of the system as a whole can be quite different from that of the individual components. An automobile is an example of a common mechanical system composed of a large number of individual components that are mechanically connected in some way and hence transmit vibrations to each other. This paper proposes a variety of inter-related analytical tools for the study of experimental data from such systems. In this work, experimental results of accelerometer data acquired at two locations in the automobile for two different kinds of tests are analyzed. One test is the response to impact on a stationary vehicle, and the other is the road-response to the vehicle being driven on a flat road at different speeds. Signals were processed via Fourier and wavelet transforms, cross-correlation coefficients were computed, and Hilbert transforms and Kuramoto order parameters were determined. A new parameter representing synchronization deficit is introduced. There is indeed some degree of synchronization that can be quantified between the accelerations measured at these two locations in the vehicle.

The judgment of the European Court of Human Rights in Eweida and others v United Kingdom1 related to two pairs of cases.2 The first pair concerned a British Airways check-in clerk and a nurse, each of whom complained that dress codes at their respective places of work prevented them from openly wearing a small cross on a chain around their neck. In the second pair, a registrar of marriages and a relationship counsellor refused to offer their respective services to same-sex couples on the basis that homosexual acts were incompatible with their religious beliefs. Having failed to obtain relief in the domestic courts, all four applicants took their claims to Strasbourg, which heard oral argument last September. Judgment was pronounced on 15 January 2013. This Comment considers the broad thrust of the judgment, particularly the threefold manner by which the Court has clarified and embedded the right to freedom of religion, the practical outcome in the individual cases, and the likely effect of the judgment upon future litigation in the domestic courts of the United Kingdom.

This article intends to talk about a democratic initiative of the Brazilian Bar Association to promote human rights and sexual diversity in Brazil.  Brazil is walking up the road to protect LGBTI citizens and to legally recognize same-sex couples.  The country has guaranteed many rights to homosexual couples and their children, but the lack of a specific act to rule these matters is a problem in a country whose legal system is still very dependent to legal acts and positivism.  This work tries to show the state of art of homosexual couples’ rights in Brazil and how the proposal of a new statute to protect the rights of LGBTI people, in all aspects of their daily life could protect them and contribute for a democratic society.

The article concerns the problem of birth certificates of children of same sex couples, which have been transcribed into the Polish register of civil status. Although such transcriptions, after the resolution of the Supreme Administrative Court of 2.12.2019, seem not to be allowed, a significant number of foreign certificates had already been transcribed beforehand. The author argues that there are limited grounds to eliminate such acts from the Polish register. Especially in cases, in which the transcribed birth act — generated in Poland — names the woman who gave birth to the child (which woman is always considered to be the mother according to Polish law), such acts can properly fulfill their role by proving the fact of the child’s birth and by explaining the motherhood. The fact that the other parent (of the same sex) is not mentioned at all or is mentioned only in an annotation to a birth act can be well reconciled with the rules of the Polish law.

108 Northwestern University Law Review Colloquy 110 (2013)This essay takes a critical look at the tax fallout from the U.S. Supreme Court's decision in United States v. Windsor, which declared section three of the federal Defense of Marriage Act (DOMA) unconstitutional. The essay is important because, while other federal laws will apply to some same-sex couples some of the time, the federal tax laws are a concern for all same-sex couples all of the time. The essay is timely because it addresses the recently issued IRS guidance regarding the tax treatment of same-sex couples. In this essay, I first describe the path that led to the decision in Windsor. Then, I turn to describing the ways in which the post-Windsor tax terrain may actually be worse for same-sex couples than the bleak tax landscape that they faced before that decision. Under DOMA, same-sex couples already faced a debilitating level of uncertainty in determining how the federal tax laws applied to their relationships. Post-Windsor, same-sex couples will see this uncertainty multiply -- even after receiving guidance from the IRS on the implementation of the Windsor decision in the federal tax context. They will have to grapple not only with lingering questions surrounding the federal tax treatment of relationships that are not recognized, but also with new questions regarding whether and how their relationships will be recognized for federal tax purposes. Moreover, it seems that dispatching discrimination designed to erode the progress of same-sex couples toward formal equality has served only to entrench the privileged status of marriage in our federal tax laws rather than fostering the recognition of a broader array of human relationships.
