Instrumentation to Understand the Child Protective Services Decision-Making Processes

When children come to the attention of the child welfare system, they become involved in a decision-making process in which decisions are made that have a significant effect on their future and well-being. The decision to remove children from their families is particularly complex, yet surprisingly little is understood about this decision-making process. As a result, instrumentation has been developed and adapted over the past 20 years to further understand variations in child welfare outcomes that are decision-based and, in particular concerning the removal decision, in order to provide a more thorough understanding of the intersecting factors that influence caseworker decisions. This chapter presents research and the development and use of this instrument, drawing from the decision-making ecology as the underlying rationale for obtaining the measures. The instrument was based on the development of decision-making scales used in multiple studies and administered to child protection caseworkers in several states. This effort is part of a larger program of research that seeks to better understand decision-making processes in child welfare systems in order to promote fairness, accuracy, and improved outcomes among children and families.

In the contexts of family neglect or maltreatment, the State intervenes by safeguarding the development and well-being of the child or young person in danger. In more severe situations, the intervention may lead to the child’s removal from the family. The Portuguese Law on the Protection of Children and Young People in Danger (Law 142/2015 of September 8th) favours the placement of the child in a family environment, especially for children up to the age of six. Despite this, in Portugal, in 2015, 8 600 children were in out-of-home care, only 3.5% of which were placed in foster care, while the remaining children were in residential care. Therefore, one of the fundamental rights of the child – living in a family environment – is compromised in practice. This study aims to understand the decision-making process of 200 higher education students in domains related to child protection, and those of 200 professionals who are responsible for providing case assessments and recommendations for intervention in the Portuguese child protection system. Using the Child Welfare Attitudes Questionnaire (Davidson-Arad & Benbenishty, 2008, 2010), the study aimed to identify the participants’ attitudes regarding removal of at-risk children from home, reunification and optimal duration of alternative care, children’s and parents’ participation in the decision-making process, and assessment of foster care and residential care, with the purpose of promoting children’s development and well-being. We concluded that both sets of participants (professionals and students) can be divided in two groups, one which is pro-removal and the other, which is less so. In comparison with students, professionals less often favour the removal of the child and more often defend reunification. There are no significant differences among participants regarding their opinion about the role of foster and residential care, and the participation of the child in the decision-making process. However, professionals tend to support parents’ participation in the decision-making process more than students do. Finally, we present some implications of our findings for the practice of child protection.

Initial child welfare screening decisions, traditionally made by an individual worker, determine if a family will receive further intervention by child protective services. A multi-disciplinary team (MDT) decision-making approach for child welfare referrals aims to provide a more thorough assessment of needs and strengths and to connect families to appropriate community-based providers. This study examined 159 child welfare referrals handled by MDTs compared to 331 referrals handled via the traditional screening approach. The study used a pseudo randomization procedure to assign referrals to the study conditions: Referrals logged on 2.5 days of the week were assigned to the treatment group; all others were assigned to the comparison group. Referrals handled by an MDT were more than four times as likely as those not handled by an MDT to be referred to community-based organizations ( OR = 4.32, p < .001). There were no statistically significant differences in families’ engagement with community-based organizations or child welfare outcomes. MDTs are a promising step in the initial process of connecting families to services, although they did not affect this study’s longer-term outcomes.

Worldwide, there has been a push toward reforming or abolishing child welfare systems because of systemic bias against families. Few studies have examined the role of bias in decision-making processes among child welfare practitioners, especially in child welfare systems in processes of change/reform. This qualitative study utilized discussion groups with child welfare teams to examine how professionals navigated the decision-making process in cases of child maltreatment. A grounded theory analysis revealed that professionals deconstruct macro, mezzo, and micro biases as they make decisions. Implications for global social work, such as self-reflection and structural changes, and for future research are explored.

Front-line public “Child Welfare” caseworkers, also known as emergency response or investigative caseworkers, play a significant role in the “Child Welfare” system. Placed in an intermediary role within the system, investigative caseworkers are tasked with making critical decisions while attempting to advocate for families and uphold the system’s policies. To understand the caseworker decision-making processes more in-depth, a qualitative study was conducted with eighteen investigative caseworkers in four different counties. The guiding research question of the current study was: “What impacts the decisionmaking processes in which child protective service workers investigate and substantiate referred cases of child maltreatment?” Findings revealed several nuances and extensive complexities in how workers navigated often contradictory roles within the system. Important emerging themes include caseworkers’ use of surveillance during investigation and multi-institution partnership indecision-making processes. This Comment discusses the ways in which caseworkers react to and navigate ambiguity and parental resistance during investigations, lending an often-overlooked exploration into various nuances within the decision-making apparatus. Understanding nuances in the complex web of decision-making and information-gathering may lead to novel ways of thinking about how the “Child Welfare” system addresses child protection.

The aim of this chapter is to clarify how decision-making processes within the context of child welfare and child protection could be improved by decision-making theories (i.e., Decision-Making Ecology [DME] and decisional conflict model), with specific interest in methods intended to support practitioners based on these theories, in particular methods of structured decision-making and actuarial methods. Existing studies indicate that structured decision-making methods have a limited effect on the decision-making process, as well as on the reliability and validity of the judgments and choices made by professionals in cases of suspected child abuse and neglect. Actuarial methods may be more precise in making valid judgments but may ignore factors relevant to decisions concerning treatment and intervention. The DME framework reveals that other factors—in addition to rationally weighing information and arguing—influence the decision-making process and outcomes. Especially the influence of decision-maker factors seems to be ignored in structured decision-making methods. Although systematic methods and instruments do have some value, several additional options are available that take decision-maker factors more into account. This chapter discusses the potentials of critical thinking, team decision-making, systematic feedback, and shared decision-making.

Participatory practice is acknowledged as increasingly important in empowering families in the decision-making process. Yet parental participation in child protection and welfare settings remains a complex and multi-dimensional practice, dependent on a range of individual factors including willingness to engage; understanding of need, as well as system factors including power dynamics and resource constraints (Darlington et al., 2010). Parents can feel ‘powerless and helpless’ when not involved in decision-making processes (Hardy & Darlington, 2008). In addition to practice wisdom emerging from literature in the field, this paper examines the findings of a research study commissioned by Tusla (the Irish, national, statutory Child and Family Agency) on parental experiences of Child Protection Conferences (CPCs) in Counties Galway and Roscommon. Analysis of findings of a series of qualitative interviews (n=14) with parents who have attended CPCs, found that parents in the study felt unprepared for CPC, unclear of the implications for their families and felt marginalised by the CPC process. While many parents recognised their right to reply, most reported wanting to appear cooperative. The paper proposes recommendations including the development of a protocol for CPC preparation; participation supports for parents to ensure their voices are heard throughout the process; debriefing as a structured phase of the CPC; and continuous intensive engagement with parents post-CPC.

This article explores child welfare workers’ experiences of children’s participation in decision making in the child protection system. The systematic review follows the principles of the Preferred Reporting Items for Systematic Reviews and Meta-Analyses statement and includes 12 peer-reviewed articles published in academic journals from 2009 to 2019. Findings indicate that children’s participation in decision making is generally limited or nonexistent. The age of the child is an important determining factor concerning whether the child is given the opportunity to participate in decision making. Potential harm for children that may result from participation is considered when deciding on whether to include a child in the decision-making process.
