Abstract: Al-Qāḍī Abū Ya‘lā ibn al-Farrā’ (380-458 A.H / 990-1065 C.E) is regarded as the most prominent Hanbali scholar and one of the early Muslim jurists who played dynamic roles in formulating a systematic legal framework and constitutional theory on Islamic system of government during the first half of the 5th/11th Century in Baghdad, and which are still found to be relevant in the modern day constitutional legal theories. Attempt would, therefore, be made in this paper to examine the contributions of this Leading Legal Luminary to the Legal theory of Islamic civilization and sciences of jurisprudence of the Ḥanbali Madhhab (Hanbali School of Law). Other areas of relevance critically examined in this paper are his education and legal background, contemporary pursuits of intellectuals and prominent fuqahā’ (jurists) of his time, as well as a detailed account of his notable students, works and influence in the development of the Ḥanbali Madhhab  Key words: Islamic Civilization, Islamic Jurisprudence, Hanbali Madhhab, Hanbali Scholars, Legal theory.

As an intellectual process, critical thinking plays a dynamic role in reconstructing human thought. In Islamic legal thought, this intellectual tool was pivotal in building a full-fledged jurisprudential system during the golden age of Islamic civilization. With the solidification of the science of Islamic legal theory and the entrenchment of classical Islamic jurisprudence, this process abated somewhat. Recent Islamic revival movements have engendered a great zeal for reinstituting this process. The current state of affairs in constructing and reconstructing Islamic jurisprudence by and large do not, however, reflect the dynamic feature of intellectual thought in this particular discipline. Thus this article attempts to briefly delineate this concept, unveil the reality on the ground, and identify some hands-on strategies for applying critical thinking in contemporary ijtihad.

The purpose of this study was to analyze the legal consequences of the agreement of power sell off made in the manufacture of an agreement of sale by Notary. Legal theory used in this study, among others: justice theory, the theory of authority and responsibility theory. The approach used in this study is primarily sociological juridical approach. Sociological juridical approach is to identify and conceptualize law as a social institution that is real and functional in a real life system. The results of this study finally provides the answer that the certificate authority to sell off which made the authorizer to the Proxy should still be subject to and required for payment of taxes from the sale of land and / or buildings that have been sold such, it thus obliged Notary socialize at the time the parties face because it is concerned responsibility by agreement authorized to sell he made in the manufacture of an agreement of sale in accordance with the provisions stipulated in the Indonesian Government Regulation No. 36 of 2016 regarding Income Tax on Income From the Transfer of Rights to Land and / or Buildings, And Agreements sale and purchase Land And / Or Building Along with its amendment.Keywords: Certificate Authority To Sell; Agreement Of Sale; Notary.

This basic question has been given considerable attention in contemporary constitutional theory and has been the focus of the pragmatist law as literature movement born of the interpretive turn in legal theory. At issue is the very purpose of constitutional practice: is it to recover the truth of a set of foundational, moral ideals from the constitution and apply it to a particular factual conflict? Or is it to preserve continuity between the various elements of our cultural practices, to keep the peace?

In the Philosophical Transactions for 1826, Part II. Mr. Herschel has given a detailed account of observations, which were made in the month of July, 1825, for the purpose of ascertaining the difference of the meridians of the Royal Observatories of Greenwich and Paris, with a computation of these observations, from which the most probable value of the difference of longitude appears to be 9 m 21 s. 6. But I have perceived that in the copy of the observations delivered to him from the Royal Observatory of Greenwich, an error of one second has been committed; as the true sidereal time of the observation made there on 21st July, ought to be 17 h 38 m 57·12 in place of 17 h 38 m 56 s. 10, set down in the Table p. 104, which he informs me was computed at the Observatory, and officially communicated to him from the Astronomer Royal. This error seems to have had its origin in the little Table at the bottom of page 103; for, on subtracting the error of the clock, 47 s. 37, from the time 18 h 8 m 30 s. 40, the true sidereal time is 18 h 7 m 43 s. 03, instead of 18 h 7 m 42 s. 03, there given. The error in the result of that day’s observations, arising from this cause, has been partly compensated by a mistake of three tenths of a second, which has occurred in calculating the combined observations of the same day, the gain of mean on sidereal time being stated to be — 4 s. 54 (pp. 120 and 122), in place of — 4 s. 24. On checking the other observations, a few trifling alterations appear to be necessary upon the Greenwich Table of sidereal time, from the data given along with it. These seem to be occasioned by different methods of calculation, and indeed are hardly worthy of notice. The French astronomers not having given the data on which the calculations of the sidereal times at Paris are founded, they are assumed to be correct.

AbstractContract for practical investment are made in two forms, direct and indirect. Both of the contracts havedifferentiation so does the guaranteed interest condition for them. In the first method, which is the interest of direct investment, the owner of the capital is an investment agentand only interested investors are determined in terms and conditions. In this case from investment, interest is guaranteed by the fact that the investment recipient is committed to buy products produced at price that guarantee logical interest for investors. The accuracy of this guarantee condition is to ensure in term of Islamic law and jurisprudence because commitment to purchase is necessary condition. However in the second form, unlike the first, investor interest is indirectly decided and guaranteed and conditions are increasingly attractive by carrying out industrial and manufacturing activities. This form of interest is also considered legal and valid both in Islamic law and Iran's Civil Law and practically based on the principles of conditions and article 234 of Iran's civil law. Pada metode pertama, yang merupakan bunga investasi langsung, pemilik modal adalah agen investasi, dan hanya bagi investor yang tertarik ditentukan dalam syarat dan ketentuan. Dalam hal investasi, bunga dijamin dengan fakta bahwa penerima investasi berkomitmen untuk membeli produk yang diproduksi dengan harga yang terjamin. Kondisi jaminan ini dipastikan baik dari segi hukum dan yurisprudensi Islam, karena adanya komitmen untuk membeli adalah syarat mutlak yang diperlukan. Namun dalam bentuk kedua, tidak seperti yang pertama, minat investor secara tidak langsung diputuskan dan dijamin dan kondisinya semakin menarik dengan melakukan kegiatan industri dan manufaktur. Bentuk minat ini juga dianggap sah, baik dalam hukum Islam dan Hukum Perdata Iran, serta sangat praktis berdasarkan pada prinsip-prinsip kelayakan dan pasal 234 hukum sipil Iran. У этих двух инвестиционных методов есть различия, и условия гарантированного процента для них также отличаются. В первом методе, который представляет интерес прямых инвестиций, владелец капитала также является инвестиционным агентом, и только заинтересованные инвесторы определяются по положениям и условиям. В случае инвестиций, интерес гарантируется тем фактом, что получатель инвестиций стремится покупать продукты, произведенные по гарантированным ценам. Условия данной гарантии обеспечиваются с точки зрения исламского права и исламской юриспруденции, поскольку обязательство по покупке является необходимым условием. Но во второй форме, в отличие от первой, заинтересованность инвестора определяется  и гарантируется посредственным образом, а условия становятся все более привлекательными при осуществлении промышленной и производственной деятельности. Эта форма также считается законной и действительной как в исламском праве, так и в гражданском праве Ирана и практически основана на принципах обладания правом и статье 234 гражданского права Ирана. Итак, главный вопрос этого исследования состоит в том, насколько верны условия гарантированного интереса в иранской юриспруденции и Иранском праве.Ключевые слова: условия гарантированной прибыли, юриспруденция, иранское право, мудараба

Key words: European ecocriticism, Canadian ecological identity, federation, European nature, European identity, diversity, fragmentation, bioregional network, eco-comparatist, multilingual ecocriticism European ecocriticism is distinguished from ‘ecocriticism made in USA’ by geo-physical fragmentation, the absence of shared encounters of the human with the non-human, and linguistic and political heterogeneity. There is no unitary continental consciousness. However, linguistic and cultural diversity can be an asset rather than a disadvantage, if it is allowed to steer European ecocriticism in a new direction. The European terrain invites ecocritics to become multilingual eco-comparatists, paying special attention to how linguistic representation aids and hampers environmental consciousness.  Palabras clave: eco crítica europea, identidad ecológica canadiense, federación, naturaleza europea, identidad europea, diversidad, fragmentación, red bioregional, eco-comparatista, eco crítica multilingüe. La ecocrítica europea se distingue de la ecocrítica ‘made in USA’ por la fragmentación geofísica, la ausencia de encuentros compartidos de lo humano con lo no-humano y por la heterogeneidad lingüística y política. No hay una conciencia continental unitaria. Sin embargo, la diversidad cultural y lingüística puede ser una ventaja más que una desventaja si se la permite dirigir la ecocrítica europea en una nueva dirección. El terreno europeo invita a los ecocríticos a convertirse en eco-comparatistas multilingües, prestando especial atención a cómo la representación lingüística ayuda y obstaculiza a la conciencia medioambiental.

Abstract: Electronic policy or e-policy is an insurance contract that happends due to an electronic commercial transactions. But e-policy has been in Indonesia although there is no clear legal framework related to the existence of these e-policy. The purpose of this study are 1) Determine and analyze how the legality of e-policy according to the law in Indonesia. 2) Determine and analyze how the strength of e-policies evidence in the event of a dispute between the parties. Judicial review of electronic policy in the insurance agreement, namely: 1) E-polis as a form of agreement which could be interpreted is not qualify as legitimate e-policy agreement contrary to KUHDagang to be equivalent for sub law. So, insurance agreement can be interpreted is not meet objective conditions of an agreement that could result in the agreement is null and void (Article 1320 of KUHPerdata). 2) The strength of evidence on e-policy will have a strong legal force if the e-policy is made in the form of a deed in writing and acknowledged by both parties entered into an agreement, but if e-policy just softfile that send by email then e-policy does not have the strength of evidence because it was not in accordance with the provisions of Indonesian laws. Keywords: Agreement, E-policy, The Insurance Agreement Abstrak: Polis elektronik atau e-polis merupakan kontrak asuransi yang terjadi akibat suatu transaksi komersial elektronik. Namun e-polis telah berada di Indonesia meski belum ada payung hukum yang jelas terkait adanya e-polis ini. Tujuan Penelitian ini ialah 1) Mengetahui dan menganalisis keabsahan e-polis menurut hukum di Indonesia, 2) Mengetahui dan menganalisis bagaimana kekuatan pembuktian e-polis dalam hal terjadi sengketa antara para pihak. Tinjauan yuridis terhadap polis elektronik dalam perjanjian asuransi, yakni : 1) E-polis sebagai suatu bentuk perjanjian yang dapat diartikan tidak memenuhi syarat sah perjanjian karena e-polis bertentangan dengan KUHDagang yang setara dengan Undang-Undang. Sehingga perjanjian asuransi tersebut dapat diartikan tidak memenuhi syarat objektif suatu perjanjian yang dapat mengakibatkan perjanjian tersebut batal demi hukum (Pasal 1320 KUHPerdata). 2) Kekuatan pembuktian pada e-polis akan memiliki kekuatan hukum yang kuat apabila e-polis dibuat dalam bentuk akta yang tertulis dan diakui oleh kedua belah pihak yang mengadakan perjanjian, namun apabila e-polis tersebut hanya berbentuk softfile yang dikirim melalui email maka e-polis tersebut tidak memiliki kekuatan pembuktian karena tidak sesuai dengan ketentuan-ketentuan hukum positif Indonesia. Kata Kunci : Perjanjian, E-polis, perjanjian asuransi

Say’s Law maintains that there can never be a superabundance of all goods (if any good were available in greater supply than needed, such as water or air, it would no longer be an economic good at all) and that if there is an excess of some items that are still goods, it will be matched with an insufficiency of others. The reputation of Keynes (1936) was made in part on the basis of a supposed refutation of Say’s Law. This paper attempts to probe the irrationality of Keynes’ position by examining his concept of money and its relationship to his theory.
