The King’s Power Dominating Society—A Re-examination of Ancient Chinese Society

Abstract In terms of social formation, the most important characteristic of traditional Chinese society was how the king’s power dominated the society. Ever since the emergence of written records, we see that ancient China has had a most prominent interest group, that of the nobility and high officials, centered around the king (and later the emperor). Of all the kinds of power exerted on Chinese society, the king’s was the ultimate power. In the formation process of kingly power, a corresponding social structure was also formed. Not only did this central group include the king or emperor, the nobles, and the bureaucratic landlords, but the “feudal landlord ecosystem” which was formed within that group also shaped the whole society in a fundamental way. As a special form of economic redistribution, corruption among officials provided the soil for the growth of bureaucratic landlords. At the foundation of this entire bureaucratic web was always the king and his authority. In short, ancient Chinese society is a power-dependent structure centered on the king’s power. The major social conflict was therefore the conflict between the dictatorial king’s power and the rest of society.

Abstract: Confucianism is a doctrine that emerged in ancient China, which affected not only politics, but also ethical and political norms of government. His doctrines had an incredible impact on the development of not only political life, but also the social structure and spiritual culture of China, during the period of the country's emergence as a separate state. This article considers not only the private life of Confucius, but also the period of its formation as a spiritual leader, and also tells about the obstacles that he had to overcome in order for his work and the skills that were offered to them to be realized. The article follows changes in the paradigms and institutional context of Hungarian sociology of social structure, as formed by Hungary’s double dependence on Soviet and Western cores throughout the second part of the twentieth century. It demonstrates that as a result of those changes, the concept of class has been absent from the sociology of social structure from the early 1970s on. Thinking towards a possible reconstruction of twentieth-century Hungarian social formation in a class-sensitive perspective embedded in the dynamics of the capitalist world system, we point at a typical effect of global hierarchies on the description of local social structure: the tendency to identify a “double structure” in local society. This gesture places various characteristics of local society on two different ontological levels—for example, Western versus Eastern, future versus past. We argue that in order to conceive of local social formation as part of an integrated global history, this internalized effect of global hierarchies needs to be transcended.

In order to study a process of group formation among young children, six 2-year-olds were observed during the first four weeks of a daily play group. Results suggested that the children formed a dominance structure that corresponded with increased group stability. The dominance hierarchy appeared to reflect a more general social structure than just an ordering for who could successfully aggress against whom; it was correlated with centrality orderings for non-agonistic behaviors. The absence of a co-ordination between hierarchic orderings for different forms of agonism, however, suggested that the group was not characterized by a fully unified structure, at least not by the end of fourweeks. Analyses also indicated that social asymmetry or status was not the only factor that systematically affected the resolution of social conflict. Prior possession of an object too seemed to constitute an important social norm.

The practice of judges’ resolution of extra-procedural applications during the entire period of their existence has not been of great interest to the representatives of criminal procedural science. This is understandable: such activity is only indirectly related to criminal proceedings, and its tacit nature excludes substantive criticism without special empirical research in the courts. However, any extra-procedural application is always an attempt to exert pressure on a judge in charge of the criminal case, and therefore it poses a threat to a fair and impartial resolution of a social conflict, thus necessitating the establishment of a single mechanism to respond to such applications, based on the principle of judicial independence. The purpose of the paper is to develop theoretical provisions substantiating the need to optimize and simplify the existing procedure of judges’ resolution of extra-procedural applications. The paper uses the methods of system analysis, synthesis, sociological survey and generalization. Results: on the basis of the statistics, results of judges' questionnaires and examination of non-procedural applications, the author concludes that the judicial practice of resolving such applications is very difficult, owing to gaps and uncertainties in the law, and its scale is indicative of the emergence of a new, hitherto unknown course of action for judges.
