Civil Solidarity or Fragmented Identities? The Politics of Sexuality and Citizenship in France

This article examines the development of the Pacte Civil de Solidarité (PACS) in France, a legal construct which provides recognition in law to a range of relationship forms, including same-sex couples. The PACS is used as a means of interrogating the continuing importance of republicanism in contemporary French political discourse. The PACS provides a microcosm of wider issues concerning citizenship, marriage, communitarianism, multiculturalism and the meaning of French national identity in the context of globalization and transnationalism. Finally, the article considers the role of republicanism in shaping the constitution of a gay identity in contemporary France, and the impact of the PACS on that identity.

This chapter identifies ways researchers, policymakers, therapists, lawyers, and couples should attend to the role of gender and gender dynamics facing same-sex couples upon divorce or relationship dissolution. When same-sex couples marry, gender roles associated with a particular vision of different-sex couples—in reference to which the legal institution of marriage developed historically—may be projected onto same-sex couples both socially and by judges adjudicating their relationship dissolutions, often in a manner conflicting with couples’ intentions and practices. Thus, couples consisting of two men and couples consisting of two women may be differentially affected. Gender and gender dynamics are likely to affect the bases for dissolution (e.g., whether one of the spouses committed adultery or whether there is a basis for annulment); the financial aspects of dissolution; and determination of child custody. The chapter suggests directions for future research regarding the impact of gender on the dissolution of same-sex relationships.

The present paper aims at examining the extent to which Moroccan cinema could establish a diasporic visual discourse that cements national identity and contests the impact of westernization on migrants. Moreover, through the analysis the way in which independent identities are constructed in the host land, the article tries to incorporate a feminist discourse to highlight the role of the female subject in retrieving its own agency by challenging patriarchal oppression. Therefore, we argue that Mohammed Ismail’s feature-length film Ici et là (Here and There) has partially succeeded in creating a space for its diasporic subjects to build up their own independent identities beyond the scope of westernization and patriarchy.

A Rhetorics of the Word is the second volume of a three-part philosophy of Christian life. It approaches Christian life as expressive of a divine calling or vocation. The word Church (ekklesia) and the role of naming in baptism indicate the fundamental place of calling in Christian life. However, ideas of vocation are difficult to access in a world shaped by the experience of disenchantment. The difficulties of articulating vocation are explored with reference to Weber, Heidegger, and Kierkegaard. These are further connected to a general crisis of language, manifesting in the degradation of political discourse (Arendt) and the impact of new communications technology on human discourse. This impact can be seen as reinforcing an occlusion of language in favour of rationality already evidenced in the philosophical tradition and technocratic management. New possibilities for thinking vocation are pursued through the biblical prophets (with emphasis on Buber’s and Rosenzweig’s reinterpretation of the call of Moses), Saint John, and Russian philosophies of language (Florensky to Bakhtin). Vocation emerges as bound up with the possibility of being name-bearers, enabling a mutuality of call and response. This is then evidenced further in ethics and poetics, where Levinas and Hermann Broch (The Death of Virgil) become major points of reference. In conclusion, the themes of calling and the name are seen to shape the possibility of love—the subject of the final part of the philosophy of Christian life: A Metaphysics of Love.

This study deals with the political parties’ pluralism in Iraq under the Parties Law No. 36 of 2015. The importance of the study lies in the fact that it looks at a topic that is at the heart of democracy and it is necessary for the success of any democratic processes. The study focuses on parties’ pluralism in Iraq since the establishment of the Iraqi state in 1921 until the end of the Baath Party regime in 2003, it also covers the period after 2003 and pays particular attention to the Parties Law No. 36 of 2015. It focuses on the legal framework of political parties after the adoption of the Political Parties Law and studies the impact of this law on parties’ pluralism in Iraq after its approval in 2015. The study concludes that Law No. 36 of 2015 is incapable of regulating parties’ pluralism for reasons including: the lack of commitment by the political parties to the provisions of the law, the inability of the Parties Affairs Department to take measures against parties that violate the law the absence of a strong political opposition that enhances the role of political parties, the association of most Iraqi parties with foreign agendas belonging to neighboring countries, and the fact that the majority of Iraqi parties express ethnic or sectarian orientations at the expense of national identity.

Tackling the role of state symbols in negotiating national identity and political development, this research focuses on Belarus where the alternative white-red-white flag became instrumental in protests against the dominant political discourse. Since 1995, oppositional mass media have been reporting about cases of this tricolor being erected in hard-to-reach and/or politically sensitive places. These actions were mainly attributed to some “Miron,” whose identity remained concealed and served as a simulacrum of a national superhero in non-conformist discourse. The image of Miron immediately acquired multiple functions: condemning the Soviet colonial past, struggling for the European future, and creating a nation-state rather than the Russian-speaking civil-state of Belarus. Yet, first and foremost, Miron became a means for contesting the authority of the president who has been in power since 1994. Concentrating on the methods employed for the construction of the counter-hegemonic fakelore project of Miron and its aims, this article explores the vernacular response to its creation.

The research presented in this paper has been developed within the European project MeLa* (“European Museums in an age of migrations”), which focuses on how contemporary migratory movements come to reshape the role of museums and archives as the privileged places of national identity and cultural memory.[1] The fundamental consideration on which the research is built is that today, under the impact of globalization and an increasing awareness of the positive role played by cultural diversity, museums can no longer pretend to represent culture in exclusively national or local terms, because they are facing the challenge of an increasingly diverse, transcultural and multilingual European society.

Acknowledging that the youth of Spectrum tend to disclose their sexual and gender identities to parents at a relatively young age, this chapter explores the role of family in the formation of these youths’ sexualities and genders. It was often the case with Spectrum youth that, rather than rejection, they encountered loving support about their sexuality from their parents. The youth of Spectrum are of a generation of kids who are the first to grow up in a society in which same-sex couples and genderqueer parents rearing children have become significantly socially acceptable. The chapter argues that young people are sharing their queer sexual and gender identities with their parents at a younger age because of gender non-conformity that leads parents to make assumptions about their child’s sexuality because they are more frequently exposed to LGBTQ family members and loved ones and because these particular parents do not conform to the white, middle-class, heteropatriarchal regime of the Standard North American Family. Queer family formation has broad implications not just for same-sex couples but for the way U.S. society understands and recognizes family in general.

This chapter reviews the emerging field of couple interventions for same-sex couples. It outlines the evidence base for couple relationship education and couple therapy based on research with heterosexual couples. It reviews data pertaining to relationship stability and relationship satisfaction of same-sex couples and also the similarities and differences in the predictors of relationship outcomes between heterosexual and same-sex couples. The differences suggest modifications are required, including addressing the role of external influences on couple functioning, the role of dyadic coping to buffer effects of minority stress, non-monogamous relationships, and managing disclosure of one’s relationship. Currently, there is modest uptake of couple services among same-sex couples, and this chapter offers suggestions to enhance the relevance and inclusivity of couple interventions. It concludes by proposing a number of future research directions, including examining the efficacy of couple interventions for same-sex couples and evaluating innovations to increase same-sex couples’ access to services.

This chapter discusses the role of consensual dispute resolution (CDR), which allows parties to resolve their disputes outside of the judicial system, in same-sex relationship dissolutions. Two forms of CDR are mediation and collaborative law. In mediation, the parties meet with a neutral professional who helps the parties identify and resolve their disputes. In collaborative law, each party is represented by a collaborative attorney. The chapter, outlines characteristics of mediation and collaborative law, including their similarities and differences, and the tenets of a collaborative divorce. It then describes how the history of discrimination in the courts has affected LGBTQ families and made the use of CDR a more satisfactory and safe way to uncouple. It examines the unique issues that arise for some LGBTQ clients. Lastly, it reviews the skills a CDR professional needs to work with LGBTQ clients.

This chapter argues that evaluating the arguments the parties made in Loving v. Virginia (1967), the iconic case in which the Supreme Court struck down Virginia’s anti-miscegenation law, aids in understanding puzzles about bigotry. Virginia attempted a modern, sociological defense of its racist law. Loving illustrates the role of generational moral progress in constitutional interpretation: laws justified by appeals to nature, God’s plan for the races, and children’s well-being were repudiated as rooted in racial prejudice, intolerance, and white supremacy. The chapter then considers Loving’s crucial (but contested) role in constitutional challenges to bars on same-sex marriage, first analyzing the successful challenge to Virginia’s defense of marriage law. It then analyzes the majority opinion in Obergefell v. Hodges, holding that same-sex couples have a fundamental right to marry; the dissenters argued Loving was inapt. The chapter concludes by discussing the role of moral progress and new insight in constitutional interpretation.
