As a member of the United Nations, Zambia is committed to the observance of human rights enshrined in the Universal Declaration of Human Rights of 1948. This is evidenced, among others, by the fact that Zambia is a signatory to the Convention on the Rights of the Child and the African Charter on the Rights and Welfare of the Child. Zambia has a permanent Human Rights Commission that includes a subcommittee on child rights whose focus is on child abuse and education. Zambia also has a National Child Policy and National Youth Policy whose main objectives are to holistically address problems affecting children and youth. This paper focuses on the progress and challenges currently facing Zambia and the role of open and distance learning in addressing those challenges.

This case note focuses on the justiciability as well as the impact of corruption on the realisation of the right to basic education. Through an assessment of the decision of the ECOWAS Court in SERAP v. Nigeria, it emphasises the role of states in ensuring that corrupt activities of government officials or third parties do not affect the enjoyment of the right. It equally emphasises the role of the Nigerian courts in ensuring a justiciable right to education.

The results of this article indicate that positive peace focuses on health, disease and the fight against disease, poverty, social and economic inequalities, and the realization of social justice and at the same time, the components of the third generation of human rights are trying to realize such things as the right to development, the right to education and the right to occupation that due to its functions, endowment plays an important role in providing the mentioned items. In conclusion, it can be said that endowment is effective in strengthening and promoting positive peace and the components of the third generation of human rights.

Covid 19 has brought economy, development and culture to its knees, the cornerstones of every nation. Internationally, Italy appears to be among the first countries to be infected, red areas signs regions from north to south, there is a real war. Every single individual appears destabilized, deprived of freedoms, compressed by reasons of collective health. Maintaining serenity in the family context appears difficult in this moment that has also taken away the possibility of honoring death by crying their dead.In this scenario “we are all aware of the challenge that the country is facing and in order to mitigate the situation of social isolation connected to the drama we are experiencing, the school is on the front line. The culture it is considered a decisive factor for our country to know how to fight overcome and win the battle in course”, says the note of Ministry of Education. The school imposes itself in the life of families in a new context, the home walls with the digital teaching, the fulcrum of this research, to allow teachers to maintain interaction ad instance with the pupil. The present research aims to highlight strengths and limitations of distance teaching, giving voice, through a specific questionnaire, to parents and pupils of sample classes in Naples. The results emerged testify to the undisputed role of the human teacher / learner relationship and the need for support the school audience with computer literacy, providing telematic means and tools.This is to guarantee today the right to education for all in full respect of art. 3 and 34 of the Italian constitution.

This paper aims to identify, analyze and elaborate on the role of the family in fulfilling the right to education during the Covid-19 pandemic as well as a model for family participation in fulfilling the right to education during the Covid-19 pandemic. This is a socio-legal research method or socio-legal research which examines the text and context with a statutory approach combined with the conditions in the community. The results show that online school is the best solution to guarantee the right to education as stipulated in Surat Edaran Nomor 15 of 2020 concerning Guidelines for Organizing Learning from Home in an Emergency for the Spread of Covid-19 and family role models in an effort to fulfill the right to education during the Covid-19 pandemic, which is in the form of awareness from parents or guardians to provide assistance during learning from home activities.

Human rights are the opportunities that people have from birth to death. Regardless of race, nationality, gender, every person has certain rights. These rights must be applied regardless of where and in what position people live. No one has the right to receive these rights from people. But there are also some restrictive cases in this area. If a person violates the law or acts contrary to the national security interests of the state, then it is inevitable to make decisions within the framework required by the law. Human rights are norms that seek to protect people from serious political, legal and social exploitation. The most important of these rights are freedom of religion, the right to a fair trial on criminal charges, the right not to be tortured and the right to education. The philosophy of human rights is understood to answer questions about the existence, essence, validity, justification and legal status of human rights. Human rights are relations that determine the place and role of a person and a citizen in society and the state, the essence of the realization of a person's own capabilities and limits established by the state, as well as ways of ensuring and protecting. At the same time, the legal status of a person includes socio-economic, civil, political and personal rights and freedoms. The subject of economic, social, and cultural rights has been greatly neglected. The evidence establishing customary legal norms in the area of economic, social, and cultural rights is very compelling and often as convincing, if not more so, as in the case of civil and political rights. Included in this category are the right to social security, to work, and the right to an adequate standard of living encompassing such necessities as food, clothing, housing, health and medical care, and water and sanitation. The right to education is also fundamental, with complex issues such as the role of parental choice in education. Education is not only an entitlement, it is also an obligation upon parents and children. Cultural rights are often associated with rights of minorities but their scope is much broader and more general, and includes the right to enjoy the arts and to benefit from scientific progress.

This chapter examines the right to education of refugees. International human rights instruments, including the International Covenant on Economic, Social and Cultural Rights (ICESCR) and the Refugee Convention, provide a framework for the right to education for refugees. As a social right, and as reflected in the ICESCR, the right to education is to be progressively realized and requires positive action and allocation of funding. Like all human rights, it is dependent on action by government, the availability of public resources, and enforcement mechanisms. The devolution of responsibility for the education of refugees to States through recent policy further entrenches the role of the State in respecting, protecting, and fulfilling refugees’ right to education. The chapter then explores the intersection of global and national frameworks for the right to education for refugees and its realization in the form of access to schools. Despite the widely embraced global articulation of the right to education for all refugee children, the realization of the right to education is highly variable, being largely dependent upon their State of asylum.
