Patents, Invention and Democracy in Britain and the United States to 1852

Abstract This paper surveys the American and British patent systems in the period prior to the latter’s reform in 1852 and coinciding with the period of the first industrial revolution. It has been suggested that the British system’s archaic application procedure, extortionately high fees and hostile courts were indicative of an oligarchic socio-political system that purposively sought to restrict access to patent protection, as was apparently typical across Europe. Conversely, the American system was an open and democratic one, intended to provide patent protection to as many sections of society as possible. This paper argues for a less stylized comparison. British courts were not so hostile to patents (and patentees) as has been commonly supposed. Neither was it so difficult to obtain patent protection: for all its faults, the evidence that the British patent system was designed to restrict access to its provisions is nugatory. Consequently, explanations for America’s technological catch-up and eventual supplantation of Britain and Europe as global technological leader cannot invoke ‘superior’ patent institutions as a contributory factor.

This chapter analyses the striking changes in the geographical distribution of manufacturing production amongst countries and across continents since 1750, a period that spans more than two-and-a-half centuries, which could be described as the movement of industrial hubs in the world economy over time. Until around 1820, world manufacturing production was concentrated in China and India. The Industrial Revolution, followed by the advent of colonialism, led to deindustrialization in Asia and, by 1880, Britain became the world industrial hub that extended to northwestern Europe. The United States surpassed Britain in 1900, and was the dominant industrial hub in the world until 2000. During 1950 to 2000, the relative, though not absolute, importance of Western Europe diminished, and Japan emerged as a significant industrial hub, while the other new industrial hub, the USSR and Eastern Europe, was short lived. The early twenty-first century, 2000–2017, witnessed a rapid decline of the United States, Western Europe, and Japan as industrial hubs, to be replaced largely by Asia, particularly China. This process of shifting hubs, associated with industrialization in some countries and deindustrialization in other countries in the past, might be associated with premature deindustrialization in yet other countries in the future.

The article deals with a unique legal phenomenon that requires regulation in the context of protecting the rights of inventors to the results of scientific activity — patent trolling. Due to the imperfection of the patent system and patent legislation, the subjective rights of “bona fide inventors” in the field of scientific and innovation activities are constantly violated by “patent trolls”. On the example of the law enforcement practice of the United States of America, legal methods of countering this phenomenon are illustrated, the conditions conducive to its occurrence are analyzed. A conclusion is presented on the need to take into account the experience of the United States when amending the legislation of the Russian Federation on patent protection. It is noted that in the era of the fourth industrial revolution, the issue of combating “unscrupulous” copyright holders becomes one of the most acute. The criteria for assessing the “bad faith” of a patent infringement claim, developed by an American legislator, can become the basis for the development of similar legal norms on Russian soil and throughout the post-Soviet space.

The article examines the possibility of transfer to bipartisan system in Russia. The authors assess the benefits of the two-party system that include first of all the ensuring of actual political competition and authority alternativeness with simultaneous separation of minute non-system forces that may contribute to the country destabilization. The authors analyze the accompanying risks and show that the concept of the two-party system as the catalyst of elite schism is mostly exaggerated. The authors pay separate attention to the experience of bipartisan system implementation in other countries, including the United States. They offer detailed analysis of the generated concept of the bipartisanship crisis and show that this point of view doesn’t quite agree with the current political practice. The authors also examine the foreign experience of the single-party system. They show that the success of the said system is mostly insubstantial, besides many of such systems have altered into more complex structures, while commentators very often use not the actual information but the established myths about this or that country. The authors also offer practical advice regarding the potential technologies of transition to the bipartisan system in Russia.

Статья посвящена исследованию опыта оказания бесплатной юридической помощи осужденным к лишению свободы в США, а также проведению сравнительного анализа данного и отечественного опыта. Целью работы является изучение основных организационных аспектов и правовых основ оказания юридической помощи такой категории граждан, как осужденные, с целью установления закономерностей и выявления возможности использования положительных аспектов указанного опыта в российском законодательстве. Методы, использующиеся при написании статьи: диалектический, анализ, синтез, сравнительно-правовой. В статье последовательно изучается организация оказания бесплатной юридической помощи осужденным и их родственникам в различных регионах (штатах) США. Особое внимание уделяется субъектам оказания помощи, а также специфике отдельных механизмов и особенностей работы организаций по оказанию безвозмездной помощи осужденным. В качестве особенности американской системы оказания правовой помощи автор особенно выделяет предметный (специализированный) подход к вопросам оказания помощи - отдельные организации занимаются оказанием помощи по выбранному узкому кругу вопросов. Исследование российского опыта правовой помощи осужденным позволяет отметить некоторые преимущества. Вместе с тем, анализ проблем, существующих в системе оказания бесплатной юридической помощи осужденным к лишению свободы, позволил сделать вывод о необходимости совершенствования системы юридической помощи в России. В результате работы выявлен положительный опыт, возможный для применения в российском законодательстве. The article is devoted to the study of the experience of providing free legal assistance to those sentenced to imprisonment in the United States, as well as to the comparative analysis of this experience and that available in domestic practice. The purpose of this work is to study the main organizational aspects and legal foundations of providing legal assistance to such a category of citizens as convicts in order to establish patterns and identify the possibility of using the positive aspects of this experience in Russian legislation. Methods used in this study: dialectical method of cognition, analysis, synthesis, methods of comparative law. The article consistently examines the organization of the provision of free legal assistance to convicts and their relatives in various regions (states) of the United States. Great attention is paid to the subjects of assistance, as well as the specifics of individual mechanisms and features of the work of organizations to provide gratuitous assistance to convicts. As a feature of the American system of providing legal assistance, the author especially highlights the subject (specialized) approach to assistance issues - individual organizations are involved in providing assistance on a selected narrow range of issues. The study of the Russian experience of legal assistance to convicts reveals some advantages. At the same time, the analysis of the problems existing in the system of providing free legal assistance to those sentenced to imprisonment made it possible to conclude that it is necessary to improve the system of legal assistance in Russia. As a result of the work, a positive experience was revealed that could be applied in Russian legislation.

This study is the first to systematically examine the educational differentials in fertility levels and timing across four 5-year cohorts among Generation Xers in the United States. Little attention has been paid to the relationship between U.S. women’s educational attainments and fertility behaviors among those born after 1960 by previous studies. Results reveal that the cohort Total Fertility Rate among college graduates is lower than those of the less educated. However, there is evidence of an emerging trend: an increasing proportion of college-educated women with two children have transitioned to a third. Although college-educated women postpone first births, they tend to ‘catch up’ by spacing higher-order births closer to first births compared to the less-educated.

Abstract: The profound changes experienced by the international political system from 1988 to 1992, subsumed under the rubric ``the fall of Communism,'' suggest an opportunity for changes in the way North American television news would report on events in Cuba. This article examines major network news coverage of Cuba in Canada (CBC and CTV) and in the United States (ABC, CBS, and NBC) from 1988 through 1992. Given the different histories of Canadian-Cuban and U.S.-Cuban relations since the revolution, the extent of similar negative coverage of the island in both countries' reporting is somewhat surprising. Also, it is apparent that the end of the Cold War did not change, in any fundamental way, the frames employed by television news in its coverage of Cuba. Résumé: Les changements profonds dans le système politique international qui ont eu lieu de 1988 à 1992, et qu'on décrit généralement comme marquant la "chute du communisme", indiqueraient la possibilité d'un changement dans la façon que les chaînes nord-américaines auraient de rapporter les événements dans leurs programmes d'information sur le Cuba. Cet article examinera les programmes d'information des chaînes canadiennes les plus importantes (CBC et CTV) et de celles des États-Unis (ABC, CBS et NBC) de 1988 jusqu'à 1992. Étant donné l'évolution différente dans les relations Canada / Cuba et États-Unis / Cuba depuis la révolution cubaine de 1959, nous avons été frappés par le degré de ressemblance entre les reportages négatifs sur le Cuba faits par les chaînes des deux pays nord-américains. En plus, il est évident que la fin de la guerre froide n'a pas changé de manière fondamentale le point de vue des reportages télévisés sur les événements cubains.

The “tions” came to the United States in the closing decades of the nineteenth century: industrialization, urbanization, immigration, centralization, and bureaucratization. As befits such an impersonal suffix, these developments have been analyzed as parts of a systematic reorganization of society. Processes, not persons, have figured as the sources of motivation in the story of America's transformation from a rural society of loosely connected communities to an industrial nation integrated by corporations, communications, and the regulations of a government trying to catch up with the pace of change.
